Study Session The Study Session of the Environmental Planning Commission of the Tam of Los Altos Hills net at C:nn P.J. , with Chairman 'ic^eynolds oresiding. A. ITEMS FOR DISCUSSIO k Mr. Hader reviewed the recommendations of the reorganization Committee regarding the division of responsibilities bet.•ieen the Environmental Planning Commission and the Board of Planning Adninistration. He stated that it was the intention of the City Council to remove sub- divisions for four lots or less from the thn Environmental Planning Conmissic and give those items to tSe Board of Planning Adninistration. He further stated that, according to the City Council minutes the Board of Planning Administration h::d responsibility for all building site approvals, variances and minor subdivisions. The Commissioners expressed the opinion that su`divisions should not be split and the Environmental Plannino Commission should have all subdivisions come before the Commission regardless of the number of lots involved. They felt especially strong on areas where an EIR would be involved. End of Study Session Return. to Regular'�eeting Chairman McReynolds called the regular meeting of the Environmental Planning Commission of the Town of Los Altos Nills to order at 8:A5 p.m. in the Council Chambers of the Torn Hall, 26379 Fremont Road., Los Altos Hills, California. APPROVAL OF MINUTES: July 25, 1973 NOTION SECONDED AND CARRIED: Commissioner '-iueller moved, seconded by Commissioner Perkins and carried with a majority vote that the minutes of July 25, 1973 be approved with Commissioner Carico and "iagruder abstaini CONTINUING BUSINESS: 1. PUBLIC HEARING ON THE LANDS OF RROEKHOFF: File flo. 4n1-73 fir. H. Broekhoff, Owner/Developer, fir. John Riley, Engineer George Rader informed the Commission that the required ten day waiting period on the determination of the EIR for Broekhoff had passed with no objections from the public or other agencies. PUBLIC HEARING Of! THE LANDS OF C. L. ROCKWELL: File 393-73 Thomas Barton, Owner/Developer, Mr. Paul Nowack, Enqineer. George Mader informed the Commission that the required ten day waiting period on the determination of the EIR for Rockwell had passed with no objections from the Public or other agencies on the negative declaration. MOTION SECONDED AfP CARRIED: Commissioner Mueller moved, seconded by Commissioner Perkins and carried with a majority vote with Commissioner Carico abstaining that the Request for approval of the Rockwell Subdivision be approved and the neqative declaration be completed and filed with the county. PUBLIC HEARING OP THE LAND OF ALAN KINKEAD: File No. 400-73 Mr. Alan Kinkead, Owner/Developer, C,eoege S. Nolte, Engineer. fir. Hader reviewed t',e action taken at previous Environmental Planning Commission meetings on the Kindead Subdivision. He further reviewed the staff memo of August 2, 1973 and stated that Condition 4, removal of the old barn had already been accomplished,according to 1r. Kinkead. !OTION, SECONDED AND CARRIED: Commissioner 'iueller moved, seconded by Commissioner Magruder and carried with a majority vote with Commissioner Carico abstaining that the tentative map and checklist for the Lands of Ir. Kinkead , dated August 2, 1973, be approved. 4. PUBLIC HEARING Of! THE LANDS OF f1ARCUS STEMIAN: File 393-72 Bahl Homes, Developer, George S. Nolte, Enqineer. 3 - George Mader reviewed the request of Marcus Stedman as it relates to the August 6, 1973 staff memorandum. Ile further read correspondence received in connection with this request from the various City and County agencies and the report submitted by Arvid Johnson, Toon Geologist. After discussion by the Commission, several areas of concern were brought out. The Commission felt that the steep slopes could cause severe drainage problems. They were further concerned over access roads for the Fire Department and development of the slopes. The Commission directed that a letter be sent to the Fire Commission asking for a description of how the requested fire access road could be physically installed on the steep hillsides. iiOTIO11, SECONDED AND CARRIED: Commissioner Perkins moved seconded by Commissioner Mueller and unanimously carried the request for approval of the Lands of Harcus Stedman be continued to two weeks in which time the Commissioners should take field trips to the proposed site for subdivision. The Commission also indicated a draft EIR report will be required to be furnished by the applicant. 5. PUBLIC HEARI"r V THE LANDS OF J. N. PAPPAS: File 394-73 J. N. Pappas, Owner/Develoner, Gil Thoreson Eneineer. Mr. J. I1. Pappas was present and requested a continuance for two weeks. 'LOTION, SECOilDED AND CARRIED: Commissioner :Iueller moved, seconded by Commissioner iiagruder and unanimously carried that the Public Hearing on the Lands of J. 11. Paopas be continued to the next regular meeting of the Environmental Planning Commission at the request of '1r. Pappas. PUBLIC HEARING ON THE LAIDS OF CORBETTA: File 402-73 Louis P. Corbetta, Owner/Developer Paul Howack, Engineer George 'Mader reviewed the staff memo dated August 6, 1973, with the Planning Commission. Chiarman McReynolds opened the Public Hearinq. Speakers from the floor stated that the Public Hearing "otices had not been posted ten days prior to the date of the Public Hearing as required by law. MOTION, SECONDED AHD CARRIED: Commissioner "agruder moved, seconded by Commissioner Young and unanimously carried that the Public Hearing on the Lands of Corbetta be continued to the next regular meeting of the Environmental Planning Commission due to the late posting of the %blic Hearing Notices. kw -4- 7. PUBLIC HEARING ON THE LANDS OF SPECTOP: File Po. 403-73 Herman Spector, Owner/Developer, Paul Mowack Engineer. George Hader reviewed the staff memo of August 3, 1973, with the Planning Commission. He stated that an additional condition has been added since the date of the memo to become Condition 10. 10 A Stop Sign is to be installed at the private driveway and the intersection of Black Mountain Road. Mr. Mader reviewed the checklist with the Environmental Planning Commission. MOTION SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Commissioner Mueller and carried with a majority vote with Commissioner Carico abstaining that the tentative map checklist for the Lands of Herman Spector be approved. Such approval not to become effective until after final action on the Negative Declaration. MOTION, SECONDED AND CARRIED: Commissioner Aueller moved, seconded by Commissioner Magruder and unanimously carried that the subdivision of the Lands of Spector will have no significant effect on the environment and that a Negative Declaration be filed with the County of Santa Clara. D. NEI BUSINESS: 1. 1. CONSIDERATION OF C019ITIONAL USE PERMIT: David Bellucci File No. UP 369-73 (At request of David Bellucci) fir, Mader reviewed the request of Mr. Bellucci's Attorney Mr. Lagorio that the item be dropped from the agenda. He also reviewed the proposed phasing of development being considered by Fir. Bellucci. The members of the Environmental Planning Commission indicated they would not consider phasing of development or any modifications to the Conditional Use Permit without a Public Hearing or an amendment to the permit. They also indicated an EIR would be needed on the entire Conditional Use Permit. Chairman McReynolds commented on the Planning Commission sessions regarding the Bellucci matter stating that very few actual facts were presented in the written material submitted with the agenda from Mr. Bellucci. He feels the Commission should not spend a great deal of time on old issues or issues where planning data is not made available. Unless planning data is available it should not be placed on the agenda. E. ADDITIONAL BUSINESS: 1. The Environmental Planning Commission recommended that the City Council direct staff to take the necessary steps to implement the recomnenda- c tions for functions of the Environmental Planning Commission and the jW Board of Planning Administration as set forth in the August 9, 1972 minutes of the Reorganization Committee, Planning Functions, as modified by the City Council at its meeting of September 19, 1972. -s- The Commission indicated this would require certain planning ordinance amendments. The Commission also recommended a change in thy= report. The change would place all subdivision matters in the hands of the En- vironmental Planning Commission rather than assigning divisions of four and fet.ier parcels and lot line changes to the Ooard of Planning Administration. 2.
