RESOLUTION OF THE CITY COUNCIL OF THE TOWN RECORDER C
OF LOS ALTOS HILLS TO VACATE PUBLIC ACCESS rn
EASEMENT ON LANDS OF KELLMAN AND
MCCREADY ADJACENT TO OAK PARK COURT

WHEREAS, for the benefit of the general public, a public access easement
("Original Easement")was placed on Lot 3 and Lot 4 ("Property") as shown on that
certain map of Tract 8331, which map was filed for record in the Santa Clara County.
Recorder's Office on October 24, 1990 in Book 620 of Maps, Pages 26 through 39
• ("Parcel Map"); and
WHEREAS, an application for a site development permit("Permit")to construct
a new residence on Lot 4 was submitted to the Town of Los Altos Hills ("Town"); and,
WHEREAS, in connection with the application for the Permit,the applicant
requested that the Original Easement be vacated; and
WHEREAS,the terrain over which the Original Easement is located is not suited
for an access easement and the Original Easement has never been used for the purpose for
which it was granted; and
WHEREAS,the City Council of the Town now desires to summarily vacate the
Original Easement;

NOW,THEREFORE,the City Council of the Town does RESOLVE as
follows:
1. The City Council of the Town hereby finds that since October 24, 1990,the
date the Original Easement was granted to the Town,the Original Easement has not been
used for the purposes for which it was granted.
2. Based on the above findings,the City Council of Town,pursuant to California
Streets and Highways Code,Division 9, Chapter 4, Section 8335,hereby vacates the
Original Easement.
3. The Parcel Map showing the location of the Original Easement is on file in the
Santa Clara County Recorder's Office in Book 620 of-Maps, Pages 26 through 39, a copy
of which is attached hereto as Exhibit A.

4. From and after the date this resolution is recorded in the Santa Clara County
Recorder's Office,the Original Easement shall no longer constitute a public service
easement.
PASSED AND ADOPTED this 17th day of January , 1996.
