RESOLUTION NO. 5-96
RESOLUTION OF THE
CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS
ACCEPTING GRANT OF PATHWAY EASEMENT
ON LANDS OF MCNEES
WHEREAS, Sterling G. McNees and Mary Lee McNees,.as Trustees of the
McNees Family Trust("Owners")have received from the Town of Los Altos Hills (the
"Town") a site development permit("Permit") for construction of a residence on real
property owned by them at 24990 La Loma Drive(-Property");-and- -
WHEREAS,pursuant to a condition to approval of the Permit,the Owners are
granting the Town a pathway easement on, over and across the Property; and
WHEREAS,the City Council of the Town has read and considered that grant of
easement for pathway;

NOW,THEREFORE,the City Council of the Town does RESOLVE as follows:
1. The City Council of the Town hereby accepts the grant of pathway easement
on Lands of McNees on behalf of the public.
2. The Town of Los Altos Hills shall enter into and the Mayor is hereby
authorized and directed to execute the Grant of Pathway Easement, a copy of which is
attached as Exhibit A.

GRANT OF EASEMENT FOR PATHWAY
Sterling G. McNees and Mary Lee McNees, as Trustees of the McNees Family
Trust as Owners of property located at 24990 La Loma Drive, do hereby grant to the
Town of Los Altos Hills, a general law city of the State of California, a perpetual right
and nonexclusive easement for public pathway purposes, including, without limitation,
pedestrian,bicycle and equestrian purposes,together with the right of ingress and egress,
in, on, under, over and along the real property situated in the Town of Los Altos Hills,
County of Santa Clara, State of California, described as follows:
See Exhibit A attached hereto and made a part hereof.
The above-mentioned easement shall remain open and free from all structures and
obstacles of any kind, including fences, landscaping, irrigation systems and
appurtenances thereto.
IN WITNESS WHEREOF,the parties hereto have executed this instrument.

Legal Description
All that certain real property situated in the Town of Los Altos Hills, County of
Santa Clara, State of California, being a pathway easement more particularly described
as follows:
Beginning at the most southeasterly point of Lot 6, as shown on the Map of Tract
No. 1275, Toyon Hills Estates, filed for record May 10, 1954 in Book 48 of Maps,
page 56, Santa Clara County Records.
Thence N. 11° 06' 48" E. , 21 .03 feet along the easterly property line of said Lot 6;
Thence leaving said property line N. 65° 25' 36" W., 52.34 feet;
Thence S. 45° 35' 23" W., 38.64 feet to a southerly property line of said Lot 6.
Thence along the southerly property line S. 82° 30' E., 30.24 feet;
Thence continuing along the southerly property line of said Lot 6 S. 74° 30' E.,
42.72 feet to the point of beginning.
Containing an area of 0.037 acres, more or less.
