RESOLUTION NO. 25-96
RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS ACKNOWLEDGING BUT
REJECTING IRREVOCABLE OFFER OF
DEDICATION OF INTEREST IN
LANDS OF WAYMAN
WHEREAS, ROBERT P. WAYMAN and SUSAN H. WAYMAN, Trustees of the
Wayman Family Trust dated May 6, 1987, ("Waymans") have offered to
dedicate a Sanitary Sewer Easement to the Town on the Lands of
Wayman; and
WHEREAS, the City Council of the Town has read and considered
that Irrevocable Offer of Dedication of Sanitary Sewer Easement.
NOW, THEREFORE, the City Council of the Town does RESOLVE as
follows:
1. The City Council of the Town of Los Altos Hills hereby
acknowledges the Irrevocable Offer of Dedication. The Town chooses
not to accept this offer at this time, but reserves the right to
accept the Irrevocable Offer of Dedication by resolution of the
City Council at any time in the future.
2. The City Clerk is hereby directed to record the
Irrevocable Offer of Dedication executed by the Waymans, a copy of
which is attached hereto. -- -

IRREVOCABLE OFFER OF DEDICATION OF SANITARY SEWER EASEMENT
This Irrevocable . Offer of Dedication of Sanitary Sewer
Easement ("Offer of Dedication") is granted by ROBERT P. WAYMAN and
SUSAN H. WAYMAN, Trustees of the Wayman Family Trust dated May 6,
1987, ("WAYMANs") in favor of the Town of Los Altos Hills, a
municipal corporation of the State of California ("Town") ,
effective as of the date of execution.
RECITALS
A. The WAYMANs own several adjacent parcels of property in
the Town of Los Altos Hills, California described as follows:
Lot 5 and Lot 8 as said Lots are shown on that certain
map of .Tract 8207 as recorded on March 1, 1990 in Book
611 ' of Maps at pages 39 through 41, Santa Clara County
Records.
Parcel B of Parcel Map Tally Ho Subdivision, filed
October 16, 1985 in Book of Maps 550, Page 37, in the
Official Records of Santa Clara County.
B. The WAYMANs are. constructing a private sanitary sewer
system, and if one of these parcels is sold, a portion of the
sanitary sewer system must become public.
C. Town does not -wish to accept this Offer .of Dedication at
this time, but wishes to reserve the right to accept the Offer of
Dedication in the future if one of the parcels is sold.

NOW, THEREFORE, the WAYMANs declare as follows:
1. The WAYMANs hereby irrevocably offer to dedicate to the
Town an easement for the purpose of constructing, installing,
using, inspecting, maintaining, and replacing a sanitary sewer and
related facilities on, under, over, and along those portions of Lot
5 as more particularly described and shown on Exhibit A attached
hereto and Lot 8 as more particularly described and shown on
Exhibit B attached hereto together with a right of access thereto.
2 . The WAYMANs understand that this Offer of Dedication can
only be accepted by Resolution of the City Council of the Town
pursuant to California Streets and Highways Code Section 1806, and
that recordation of this Offer to Dedicate shall not and will not
constitute acceptance of this Offer to Dedicate.
3. This Offer to Dedicate shall be irrevocable, and shall
run with the land and be binding upon the heirs, representatives,
successors and assigns of the WAYMANs. The provisions of this
Offer to Dedicate shall inure to the benefit of all successors and
assigns of the Town.
IN WITNESS WHEREOF, the WAYMANs have executed this Offer of
Dedication on the dates set forth bel.w.
