Exempt from Fee per Government see13354eee■ AMT I PA I D Code Sections 27381 and 6103 BRENDA DAVIS RDE # 014 ; When Recorded, Mail to: SANTA CLARA COUNTY RECORDER 7/02/1996 Recorded at the request of 2:49 PM City Clerk City Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, CA 94022 • RESOLUTION NO. 29-96 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS TO VACATE SUMMARILY THE SANITARY, PUBLIC UTILITY, RATER & STORM DRAIN EASEMENT ON LANDS OF WINNER WHEREAS, for the benefit of the general public; a- sanit:ry, - - - public utility, water and storm drain easement ("Original Easement") was dedicated to the Town by Tract No. 8331 filed for record in the Office of the Recorder of the County of Santa Clara, State of California, on November 14, 1991, in Book 632 of Maps, at Pages 13, 14, and 15. WHEREAS, JEFFREY B. WINNER and STEPHANIE WINNER, the current owners ("Owners") of the Property described as Parcel 1, as shown on that Parcel Map filed for record in the Office of the Recorder of the County of Santa Clara, State of California, on April 27, 1992, in Book 636 of Maps, Pages 24 and 25 ("Property") where the Original Easement is located, have requested that the Original Easement be vacated because it will be superseded by relocation; and WHEREAS, concurrently herewith, the Owners will dedicate to the Town a new public utility easement over the Property for sanitary, public utility, water and storm drain purposes ("New Easement") , which offer will be accepted by the Town at this time; and WHEREAS, the City Council of the Town now desires summarily to vacate the Original Easement. NOW, THEREFORE, the City Council of the Town does RESOLVE as follows: 1 3\lah\res\winner.res P022149g f 1. The City Council of the Town, pursuant to California Streets and Highways Code, Division 9, Chapter 4, Section 8333, et seq. , hereby vacates the Original Easement and finds that the Original Easement has been superseded by relocation and no other publicfacilities are located within the easement. 2. The Tract Map showing the location of the Original Easement was filed on November 14, 1991, and is on file in the Santa Clara County Recorder's Office in Book 632 of Maps at Pages 13, 14, and 15. A legal description of and plat map indicating the Original Easement is attached hereto as Exhibit A. 3. From and after the date this resolution is recorded in the Santa Clara County Recorder's Office, the Original Easement shall no longer constitute a public easement.
