ORDINANCE NO. 376 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS TO AMEND AND REPEAL CERTAIN SECTIONS OF THE LOS ALTOS HILLS MUNICIPAL CODE WHEREAS, certain sections of the Los Altos Hills Municipal Code should be amended or repealed so that procedures and charges in the Town's two sewer basins are merged; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows: 1. Amendment of Code. The following sections of the Los Altos Hills Municipal Code regarding sewer facilities are hereby amended to read: (a) The name of the title of Article 1, Chapter 3, Title 3 is hereby amended to read "Sewer Fund." (b) Section 3-3.101 of Article 1, Chapter 3, Title 3 is hereby amended to read "There is hereby established a special fund to be known as the'Sewer Fund."' . (c) Section 3-3.102 of Article 1, Chapter 3, Title 3 is hereby amended to read: "All funds collected pursuant to the provisions of Sections 6-4.202 and 6-4.203 of Article 2 of Chapter 4 of Title 6 relating to sewer connection and service charges, as well as any additional sums authorized by the Council, shall be deposited into the Sewer Fund." (d) Section 3-3.103 of Article 1, Chapter 3, Title 3 is hereby amended to read: "All funds received and held in the Sewer Fund shall be used exclusively for the maintenance, operation, repair, construction, acquisition of property and administration of sanitary sewer facilities." (e) Section 6-4.202 of Article 2, Chapter 3, Title 3 is hereby amended by striking the words"Los Altos Basin" from the second to last sentence of this Section.. (f) Section 6-4.203 of Article 2, Chapter 4, .Title 6 is hereby amended to read: "(a) A sewer service connection charge shall be charged to pay for rights of capacity and use in the City of Los Altos sewage facilities; which charge shall be due and payable as a condition precedent to connection to the sewer facilities of the Town, unless such a connection charge has been . previously assessed and paid for.
