HomeMy WebLinkAbout378 ORDINANCE NO. 378 AN URGENCY ORDINANCE OF THE TOWN OF LOS ALTOS HILLS REGARDING BYRNE PRESERVE WHEREAS, in order to increase safety, especially during fire season, and reduce damage to Byrne Preserve, the Town wishes to place restrictions on the use of Byrne Preserve; and WHEREAS,the provisions of this ordinance need to go into effect immediately to protect the public health, safety and welfare so that Byrne Preserve will be adequately preserved; NOW, THEREFORE,the-City Council of the Town of Los Altos Hills does ORDAIN as follows: 1.. Amendment Of Code. Section 12-1.03 is hereby added to Chapter 1 (Parks, Preserves and Public Areas) of Title 12 (Parks and Recreation) of the Los Altos Hills Municipal Code to read: 12-1.03. Byrne Preserve. It shall be unlawful for any person to be in Byrne Preserve when the preserve is closed as set forth below. (a) Hours. Byrne Preserve shall be closed to the public every day from a half hour after sunset until a half hour before sunrise. (b) Fire Danger. The City Manager shall have authority to close Byrne Preserve to the public on any day deemed to be a day of high fire danger by the City Manager. In such a case, the City Manager shall post notice of the closure at entrances to the preserve. 2. Severability. If any part of this ordinance is held to be invalid or inapplicable to any situation by a court of competent jurisdiction, such decision shall not affect.the validity of the remaining portions of this ordinance or the applicability of this ordinance to other situations. 3. Finding;'Effective Date. The City Council finds that there is'a current and immediate threat to the public health, safety and welfare of the Town, and accordingly enacts this ordinance effective immediately. This ordinance shall be posted within the Town of Los Altos Hills in three (3) public places..
