HomeMy WebLinkAbout03/07/1957PLANNING COMMISSION IL TOWN OF LOS ALTOS HILLS MINUTES OF REGULAR MEETING March 7, 1957 The meeting was called to order by Chairman Richard Bullis on Thursday, March 71 1957, at 7:30 P.M. ROLL CALL: PRESENT: Chairman Bullis, Commissioners Tantau, Powell, Williams, Sherlock, Stedman, ABSENT: Commissioners Dawson, Mellquist AGENDAS Old Business: 1. Hereafter, the Commission will consider maps that have been previously discussed by the Com- mission and are ready for approval, and then maps presented for preliminary discussion. 2. The following letter from Chairman Richard Bullis to Mayor Sidney V7. Treat was requested to be put into the minutes: Dear Mr. Treat: The following are loose ends that should be cleared up as soon as possible to make the work of the Planning Commission fair and equitable to the sub- divider and the Commissions First Priority 1. Make edme ts t� �ubdiviaion Ordinance. I understand it is the Councils' plan to transmit its individual members suggestions to the Planning Commission. After digesting and re - 40 solving we will address our proposed amendments to the town attorney via you. Any further changes desired by the council will be decided by a committee made up of two "planners" and two Council members. Until the above is accomplished the Planning Commission will strive to abide by the present ordinance. f 2. Council adopt engineering standardsfor new 4/ road and drainage construct on. See memo of Road Commission of 1-30-57). These standards should be drawn by the Town Engineer and submitted to the Council as soon as possible for adoption by resolution. The engineer may -2 - wish to discuss with the Planning and Road wr Commission prior to his submission to you. 3. Council wn standards athopt san interim r esenon non -engineering regulationsesolution as such as setbacks, lot designs right of way of public primary and secondary roads, etc. Later these may be included in the amended Subdivision Ordinance or new zoning ordinance. These stan- dards were made up and submitted to the Council quite some time ago. They do include parts of (2) above. 4. Council adopt a Town Road Plan designating certain roads as primary (such as Vwest Fremont and Moody Roads) and designating all others as secondary. This can be very simple and can be revised after further study as time goes on. 5. Fix policy by Council to make certain that improvements on already approved subdivisions have been or will be carried out as specified. Further check to see that easements and dedi- cations, etc. already made are proper as to legal form and properly recorded. Lr Seconder v PrJority 1. Zoning ordinance which is ready for submission for Council consideration after the above is resolved. 2. Master plan which is a simple matter as per town attorney. 3. Checking improvements on future subdivisions as (5) above. Will the new Building Inspector handle? Conclusion I.purposely have not touched on details such as drainage assessments and already accepted town road improvement next to or through new subdi- visions. All these loose ends will be solved as they are details included in the priority items listed above. I have also omitted mention of the need for a paid part time planning consultant as I realize the question is possibly too controver- sial at this time j4V Richard Bullis -3- 4W CORRESPONDENCE: 1. A letter was read from Mr. Gardner Bullis, Town Attorney in reference to Mr. Cain's property. It was the attorney's opinion that this is not a Record of Survey but a Subdivision and needs to be processed as such. 2. There will be a Workshop with the Board of Super- visors of Santa Clara County with the -City Planning Commissioners on April 10, 1957, at 7:30 - 10:30 P.M. In the Supervisors Chambers, Civic Center, First and Rosa Streets, San Jose. Commissioner Sherlock will write a letter accepting the invitation and delegates will attend. 3. The Tri -County Planning Council sent a copy of the minutes of the November 30, 1956 conference held in San Francisco. The Commissioners will try to attend future meetings and conferences. 4. A letter was read from Gardner Bullis, City Attorney addressed to the Mayor of the City of Los Altos, in L reference to the legality of requiring dedication 4V of a strip of land for street widening purposes. It was the opinion of Mr. Bullis that such authority does.esist as long as the action is not arbitrary or capricious. NEW BUSINESS: Mrs. Uilliams will be the new secretary to the Planning Commission, due to the resignation of Richard Dawson. Record 2L S rve Maps 1. Fremont Lard Development Comoanv #1, Block G (68-57) Engineer, Brian. 11 acres on N.U. corner of tract #1. This was rr previously seen as one lot and are now requesting division into 11. They have the approval of the Health Department but there is no letter from the Fire Chief or the City Engineer. Arastradero is situated with the County; other roads will be taken care of by easement. It was moved by Commissioner Powell, seconded by r Commissioner Tantau, that this map be approved 4r subject to setting up a 5' easement along the northerly lite of Lots 8,7,5,4,3, and north to the common line between Lots 2 and 3. This will be an easement and not deducted from the net acreage and developed with base rock. -3- 7 'W W -4- 2. B. 04 Wood (36-56) 8area Engineer: Nolte Map does not show location of existing structures on surrounding lots. Motions Tantau; Second: Shorlock; Votes Passed RECOMMENDATION: That this record of survey be approved as submitted taking note that tho Health Dopsrtment has not given their approve'- until adecuate water supply is available. Also, no other agencies have given their approval. Carried voice vote. 3. Robert H. Worcester - Variance (V-1-57) Existing house was built under County standards - 25' from side yard. New addition will have the same setback. His request for a variance on setback has the signed approval of all neighbors. Motions Powellq Second: Tantau; Vote: Passed RECOMMENDATION: That this Variance be granted. 4. kM Harris (V 2-57) This property is located on La Loma Court on the end of a cul-de-sac. Owner is concerned about keeping home on solid ground and on a south-east exposure. Commissioners Simrell, Nilliams Stedman inspected. Mr. Harris wants a variance of i5' on one side and 20' on the other because of a very steep slope. All neighbors are agreeable to the variance. Motions Tantau; Second: Sherlock; Votes Passed RECOMM IDATIONs That the Commission accept the recommendation of the sub -committee and grant this Variance. Carried voice vote with Commissioner Powell abstaining. 5. $.M Clark (54-56) 4 building sites. Engineers McKay & Somps Motions Sherlock; Seconds Tantau; Votes Passed .RECOMMENDATIONS Move that this map be approved as a record of survey of 4 lots subject to the dedication as outlined by the Town Engineer. This map was returned to the Town Engineer for further check as to actual recording of this property in San Jose: one or two sites at the time of incorporation. g. Lots 1 & 2 are slightly substandard. 4W Motion; Stedman; Seconds Williams; Votes Passed RECOMMMATIONs That the new tentative map be approved with.the provision that the building on Lot #2 be 60' from the present building on Lot #1. Subject to all agency clearances. Carried voice vote - 9. proadlp2o ote.9.o Estates (62-57) Engineers Rheinoehl 3 to s. The Planning Commission decided to with -hold action on this map until the Tons Engineer can check with the County Engineer to check the status of O'Keefe and improvements which may be required it for O'Keefe. This map was also referred to the City Attorney. 10.(73-57) Engineers Thomas acres on E Monte at: the end of La Loma. Motions Sherlock; Seconds Powell; Votes Passed RLcommENDATION: Move we approve this map of two lots subject to widening of E1 Monte. Final map must be in the proper form. Carried voice vote. -5- -6- PRELIMINARY DISCUSSION: 1. *7 gym acres. Mrs. Hyman will have to return to the Planning Commission with a record of survey showing the lot division in order to get a permit to move a small house. Rayer (72-57) Engineer: Nolte This is an irregular piece of property and Mr. Oover wants to divide it into two building sites. Motions Sherlock; Second: Powell; Vote: Passed RECOMMMI ATION: Move the approval of this map. The road is to be private. Carried voice vote. MISCELLANEOUS BUSINESS: 1. Since it will benefit the orderly prooeedings of City business to have copies of County maps of this areas the Building Inspector was requested to contact the County to see what is available and at what cost. 2. Commissioner Thomas Sherlock is the new Chairman of the Map Committee. 3. Hereafter, copies of Planning Commission minutes will be sent to all Councilmen, and Council minutes to all Commissioners.
