PLANNING COMMISSION
MINUTES OF REGULAR MEETING
TOWN OF IAS ALTOS HILLS
May 18, 1957
The meeting was called to order by Chairman Richard
S. Bullis at 9:45 A.M. on Saturday, May 18, 1957, at
the Town Hall, 26379 West Fremont, Los Altos Hills.
Chairman Bullis officially welcomed Mr. Omar Spain
who has been appointed to the Commission to finish
the remaining one year and eight months of William
Simrell's term.
ROLL CALL: PRESENT: Chairman Bullis, Commissioners
Mellquist, Sherlock, Spain,
Tantau, Uilliams.
ABSENT: Commissioners Dawson, Powell.
ON LEAVE : Commissioner Stedman.
MINUTES: Regular Meeting, May 2, 1957, and Special
Meeting, May 7, 1957.
Motion: Sherlock; Second: Mellquist; Vote:
Passed Unanimously
RECOMMENDATION:
Approve minutes of May 2 and May 7 as stand.
CORRESPONDENCE:
1. Charles McCandless - May 15, 1957. Re: Drainage
problem on Magzaaena Avenue; complaint by David
Bates, 275 Page Mill Rd, Palo Alto. Mr. Bates
stated in a letter to Mr. McCandless dated May
10, 1957, that the drainage problem on Magdalena
is seriously endangering his home. Mr. McCandless
answered in his letter of May 15, 1957, that the
Town was in the process of correcting a number of
deficiencies on Magdalena as soon as the weather
permitted.
2. Charles McCandless - May 15, 1957. Letter addres-
sed to Don—Tibner, Road Commissioner, in reference
to physical condition of Magdalena Avenue; copy to
Planning Commission.

Mr. McCandless stated that "5,000 will be required
to reconstruct bad sections of Magdalena and
recommends that every effort be made to relieve
this road of truck traffic.
3. Gardner Bullis - i�pril 25, 1.957. Attorney Bullis
returned the deed from Frorhold and Teilhet to the
Town of Los Altos Hills, and requested to know
what addition is required by the Planning Commission.
Commissioner Williams willinvestigate this deed.
4. Morton P. MacLeod - May 6, 1957. Re: Application
Tor UseFermit for Day Nursery (V-4-5?) of Becky
H. Tuttle. Mr. MacLeod requested the opinion of
the Planning Commission concerning a new application
for this Use Permit or appeal the prior decision
to the Town Council.
The Commission agreed that inasmuch as the Use
Permit was denied because a majority of the
immediate .neighbors strongly opposed the granting
of this Use Permit, the Commission would stand
on its former decision. If the attitude of the
immediate neighbors becomes amenable to such a
Use Permit, Mrs. Tuttle should reapply for a day
L nursery. Mrs. Williams will write a letter to Mr.
M' MacLeod expressing the opinion of the Commission.
5. Richard S. Bullis Chairman Planning Commission
Maw, 1957.- t tter addressed to all area
engineers who may be engaged for map preparation in
the Town of Los Altos Hills. Enclosed in this
letter is a copy of: "Procedure for Filing Tenta-
tive and Final Maps for Subdivisions and Records
of Survey". (mimeographed forms available at Town
Hall) Also outlined are other stipulations required
for the orderly handling of maps by the Council and
Commission. This letter was unanimously approved
by the Planning Commission as it was felt that
the clarification of procedure will avoid future
delays.
I NEW BUSINESS:
1. Committee Reports:
a. Map Committee. Mr. Powell was appointed Chairman
of the Ma f dommittee to replace Tom Sherlock,
who is presently Chairman of the 'Zoning Ordinance
Committee.

Planning Committee. New members appointed to
this Committ' ee: 'Commissioner Omar Spain and
Commissioner Hart Tantau.

Report by Chairman of the I'lonning Committee:
40 Commissioner Mellguist - Condition of So. E1 Monte
Road.
Mr. Mellquist stated that the part of So. E1 Monte
connecting two Town roads, La Loma and Tepa !Jay, should
become a public road. There is a dead-end extension
of So. E1 Monte that might remain private. A subdivider
in this area, Mr. Colin Peters, has offered to organize
the residents on this extension and improve it before
asking the Town to accept it for maintenance. It was
suggested that the Planning Committee and the Town
Engineer draft a letter to Mr. Peters making specific
recommendations as to necessary improvements.
The current route of So. E1 Monte seems the best way
to get down the hill. If people now developing property
in this area contributed to a general fund for the road
some improvement could be made. The other possibility
mentioned was that each developer be asked to improve
his frontage at ,4.40 a lineal foot, thus developing
a few sections at a time.
Mr. McCandless will be asked to estimate how much it
would cost to grade, add rock and oil to So. E1 Monte
as an immediate solution.
�y Hugh Monohan, property owner on this road, stated
it was his opinion that the Commission hail previously
agreed to have the whole road fixed.
A Special Meeting was set for 'lednesday, May 22, 1957,
7:45 P.M., to make a formal report on the above to
the City Council.
VARIANCES:
1. Dr. Nathan Boartz (V-7-57)
Reduction of rear yard setback to 23'. No objections
from adjacent property owners.
Motion: Spain; Second: Mellquist; Vote: Passed Unanimously
That the Variance for Dr. Nathan Boartz for a reduction
of rear yard setback to 23' be granted.
2. Paul Szarvas (V-8-57)
r Reduction of sideyard setback to 20' and front yard

Letter from Mr. & Mrs. John Trice objecting in
principle to these vari.nuces.
Letter from Mr. Lind, Dir. McMaanus, and Mr. Sprunger
stating their approval of this variance. Mr. Lind
spoke from the floor in favor to the granting of
the variance.
Fire Chief Bassett protested this variance on the
basis that there is not adequate water in this area to
fight potential fires.

That the sideyard setback variance to 20' be granted,
but that the front yard setback variance of 60' be
denied.

RECODfMENDATION:
That this map be approved for planning purposes subject
to a formula to be decided upon by the Planning Com-
mission that will solve the problem of the private
extension of So. El Monte Road.

RECOMMENDATION:
That this map be arproved for planning purposes only,
with a 10' strip on Elena to be dedicated. Non -
access to Elena except for a 50' strip from the North
corner of the South -Easterly parcel.

That the Lloyd Copenhaver Record of Survey map be
resubmitted to the Council in the present form as
it had previously received Commission approval.
However, Final Map must show 100' reservation for drain
field as per Health Department stipulation. Fire
District objections have been clarified satisfactorily.
Requirements for road improvements stand as originally
specified.
4. William Henderson (39-56) Final record of survey
map dated -7711—, 1957. Engineer: George Nolte.
Planning Commission approved at meeting of January 21,
1957; seen at Council meeting May 13, 1957, and
referred back to Commission for clarification of Fire
District recommendation.
A letter from the Fire District objects to Fernhill
because of inadequate access in the wintertime.
Motion: Tantau; Second: Spain; Vote: Passed Unanimously
RECOMMENDATION:
That this Record of Survey be returned to the owner
and not be approved until adequate access is provided
for the Fire Department.

This map was referred back to the Commission by the
Council for clarification of the Fire District recomme-3-
dation, which stated that approval was contingent upon
the widening and grading of So. E1 Monte.
Letter received from the Health Department said
approval was contingent upon a rear yard setback
reservation of 100 feet.
Letter from Engineer McCandless stated that Mr.
Copenhaver has 361 feet frontage on E1 Monte and at
$4.40 per lineal foot, will have to deposit cash or
bond in the amount of $1,600.00 for road improvement
to the general road fund.
Mr. Paul Myers, Attorney, represented Mr. Copenhaver
and stated that 31,600.00 required for road improvement
is objectionable. He suggested that lot i/2 install a
fire hydrant, to be supplied with water from the
Toyon Hills Water Company.
Motion: Tantau; Second: Mellquist; Vote: Passed Unanimously
RECOMMENDATION:

This subdivision map is in proper order except for
receipt of cash or bond deposit for road improvement
extimated by Town Engineer to be $2,863.00
Motion: Williams; Second: Sherlock; Vote: Passed
Unanimously
RECOMMENDATION:
That this map be resubmitted to the Council when the
reauired cash or bond in the amount of "$2,863.00 is
posted by the subdivider, Merton Williams.
PRELIMINARY DISCUSSION:
1. James Claitor Subdivision of approximately 12 lots
on StStonebrook Avenue. Tommission recommended that map
be resubmitted when in proper form.
GENERAL DISCUSSION:
1. Pink Horse Ranch
Mr. Wendell Roscoe represented himself. The Planning
Commission ruled that a letter from the Health Depart-
ment anproving Unit #1 is required. The Town Clerk
is requested to write a letter to the Health Department
requesting this reply and endorsing approved map.
Compliance with the Commission's requirements on Unit
4/1 should be checked. The Commission gave tentative
approval to Unit 412. This map must have agency approval
to appear on the Council agenda and all requirements
for Unit #1 must be satisfied. The Commission urges
Mr. Roscoe to obtain the abandonment of easement rights
to El Monte. The Map Committee plus interested
previous members of the Commission should recheck
Pink Horse #2.
01 2. Fremont Hills Unit L - Block B. Tentative Map revised
ay 1 , IS37. �'ngineer: Br1-an. 44 lots.
This map is's modification of a previously approved
subdivision. Fremont Hills submitted a letter for
modification of lot design for Block B, Unit #4.
The Commission approved the re -design providing for the
elimination of a cul-de-sac in Block B, Unit #4, and
Lo access driveways. Specifically, 7treet E will be
eliminated in Block B and access driveways provided
to lots 7 and 1.

Due to the resignation of Mr. Dawson from the
Commission who was to be the next Chairman, the
Commissioners requested that Mr. Bullis continue the
chairmanship through June, 1957•
