ROLL CALL: PRESENT: Chairman Bullis, Commissioners Tantan., Powell, t7illiv cs, Sherlock, Steftan. ABSENT: Commissioners Dawson, Mellquist. MINUTES: Not read. OLD BUSINESS: None. CORRESPONDENCE, 1. A letter was read from Mr. Gardner Bullis, Town Attorney in reference to Mr. Cain's property. It was the attorney's opinion that this is not a Record of Survey but a Sub- division and should be processed as such. 2. There will be a Workshop with the Board of Supervisors of Santa Clara County with the City Planning Commissioners on April 10, 1957, at 7:30 - 10:30 P.M. in the Supervisors Chambers, Civic Center, First and Rosa Streets, San Jose. Commissioner Sherlock will write a letter accepting the invitation and delegates will attend. 3. The Tri -County Planning Council sent a copy of the minutes of the November 30, 1956 conference held in San Francisco. The AW Commissioners will try to attend future meetings and conferences. 4. A letter was read from Gardner Bullis, City Attorney addressed to the Mayor of the City of Los Altos, in reference to the legality of requiring dedication of a strip of land for street widening purposes. It was the opinion of Mr. Bullis that such authority does exist as 1' as the action is not arbitrary or capricious. -2- 5. The following letter from Chairman Richard \lir Bullis to Mayor Sidney 1-1. Treat was put in the minutes by unanimous commission action for reference. Dear Mr. Treat: The following are loose ends that should be cleared up as soon as possible to make the work of the Planning Commission fair and equitable to the subdivider and the Commission: First Priori 1. Make�dme t8 to Subdivision Ordinanc . 'rundgMan it iethe ouncil's plan to transmit its individual members suggestions to the Planning Commission. After digesting and resolving we will address our proposed amendments to the town attorney via you. Any further changes desired by the council will be decided by a committee made up of two "planners" and two Council members. Until the above is accomplished the Planning Commission will strive to abide 6. by the present ordinance. 2. Council adopt, en ine ri a cog for new road and nage cons ruction. (See memo of Road Commission of 1-30-57 These standards should be drawn by the Town Engineer and submitted to the Council as soon as possible for adoption by resolution. The engineer may wish to discuss with the Planning and Road Commission prior to his submission to ycn. j. Council adopt as an interim resolution as town standards these non -engineering regulations such as set backs, lot design, right of way of public primary and secondary roads, etc. Later these may be included in the amended Subdivisior Ordinance or new zoning ordinance. These standards were made up and submitted to the Council quite some time ago. They do include parts of (2) above. , 4. Council adopt a Town Road Plan designating certain roads as primary (such as West ` Fremont and Moody Roads) and designating �r all others as secondary. This can be very simple and can be revised after further study as time goes on- -2- -3- 5. Fix policy by Council to make certain that improvements on already approved subdivisions ` o have been or will be carried out as specified. Further check to see that easements and dedi- cations, etc., already made are proper as to legal form and properly recorded. Secondary Priori 1. Zoning ordinance which is ready for submission for Council consideration after the above is resolved: 2. Mester plan which is a simple matter as per town attorney. 3. Checking improvements on future subdivisions as (5) above. Will the new Building Inspector handle? Concluaioa: I purposely have not touched on details such as drainage assessments and already accepted town road improvement next to or through new subdivisions. All these loose ends will be solved as they are details included in the priority items listed above. L *I I have also omitted mention of the need for a paid part time planning consultant as I realize the question is possible too controversial at this time. Richard Bullis NEW BUSINESS: 1. Hereafter, the Commission will consider first on the agenda maps that have been previously discussed by the Commission and are ready for approval. After, as time allows, maps presented for preliminary discussion will be considered. 2. RESOLUTION - Moved by Richard Bullis, seconded by tart Passed unanimously. "4W That in the future the provisions of the Town %I Standards and the Subdivision Ordinance as to dedications and improvements.to existing public roads will be automatically required of all subdividers. Mention will be made in approval of maps only when exceptions are needed to the Subdivision Ordinance and Town Standards. 3•. Mrs. Hal Williams was elected the new secretary of the Planning Commission, due to the resignation of Commissioner Richard S. Dawson. -3- -4- 4, Since it will benefit the orderly proceedings of City business to have copies of County maps of this area, the Building Inspector was requested to contact the County to see what is available and at what cost. 5. Commissioner Thomas Sherlock was appointed the new Chairman of the Map Study Committee. 6. Hereafter, copies of Planning Commission minutes will be sent to all Councilmen, and it is hoped Council minutes will be sent to all Commissioners. VARIANCES: 1. Robert H. Worcester - Variance (V-1-57) Existing house was built under County standards - 25' from side yard. New addition will have the same setback. His request for a variance on setback has the signed approval of all neighbors. Motion: Powell; Second: Tantau; Vote: Passed UnanimousIv RECOMMENDATION: That this Variance be granted. 2. Don Harris - variance (V-2-57) This property is located on La Loma Court on the end of a cul-de-sac. Owner is concerned about keeping home on solid ground and on a south-east exposure. Commissioners Simrell, Ffilliams, Stedman inspected and recommended approval. Mr. Harris wants a variance setback of 15' on one property line and 20' on the other because of a very steep slope. All neighbors are agreeable to the variance in signed letters. Motion: Tantau; Second: Sherlock; Vote: Passed Unanimcus'P Commissioner Powell abstaining as an interested party. RECOMMENDATION: That the Commission accept the recommendation of the sub -committee and grant this Variance. SUBDIVISIONS: 1. This was previously approved as one lot, developers are now requesting division into 11 building sites. 160 Approval of the Health Department has been received but there are no letters from the *sire Chief or the City Engineer. It was pointed out that Arastradero is situated within the County and will be brought up to County Standars by the subdivider. Notion: Powell; Second: Tantau; Vote: Passed Unanimo,i::i; RECOMMENDATION: r hat this map be approved subject to setting up 5' easement along the northerly line of Lots 8,7,5 4,3 and north to the common line between Lot;2 and 3. This will be an easement and not deducted from the net acreage. A pathway will be constructed by the subdivider and rolled as per the Town Engineer's specifications. 2. -Broadmoor Estates (73-57) Subdivision Tentative Map dated January 4, 1957. 23 lots. Engineer: Rheinoehl The Planning Commission decided to with -hold action on this map until the Town Engineer can check with the County Engineer to check the status of O'Keefe and improvements which may be required for O'Keefe. This map was also re- ferred to the City Attorney for clarification of Town requirements for access to a subdivision over substandard County road and status of O'Keefe Lane. RECORD OF SURVEY. 1. R.O. Ilood (36-56) Record of Survey dated June, 1956. P acres. Engineer: Nolte. Note was taken that this map does not show location of existing structures on surrounding lots. W Notion: Tantau; Second: Sherlock; Vote: Passed Unanimously RECOMMENDATION: That this record of survey for 2 building sites be approved as submitted taking note that the Health Department has not given their approval until adequate water supply is available. This Record of Survey map is approved for 4 lots subject to the dedication as outlined by the Town Engineer. Peripheral roads will be brought to Town Standards to specifications of Town Engineer. Rote was teken of opinion of Town Attorney regarding questi%u of dedication raised by the attorney for Mr. Clsrx. Copy of letter attached to file. 3. Clarholm (69-57) Record of Survey dated Abe nuary,-%'557`—Engineer: McMillen & McMillen. 2 building sites. Lot §2 is substandard in width (100') Access - substandard easement (16') Adjacent owner not listed. This map was returned to the Town Engineer for further check as to actual recording of this property in San Jose to determine if this parcel was recorded as one or two sites at the time of incorporation. 5, J. Engineer: Mark Thomas Motion: Sherlock; Second: Powell; Vote: Passed Unanimously RECOMMENDATION: This map approved for two lots subset to widening of E1 Monte by developer and bringing to Town Standards. Final map must be in the proper form. 7. R.A. Howe (62-56) Record of Survey dated September, M, . Iacres, 2. building sites. Engineer: Nolte This is an irregular piece of property and Mr. Bowen wants to divide it into two building sites. Motion: Sherlock; Second: Powell; Vote: Passed Unanimously RECOMMENDATION: Move the approval of this map. The road is to be private. PRELIMINARY DISCUSSIONS of various problems of citizens planning future submission to Commiss'_nr. 1. Mrs. Hyman b' -acres. Mrs. Hyman will have to return to the Planning Commission with a record of survey showing the lot division in order to get a permit to move a small house. There are presently two houses on this 6 acres. 2. C.D. McDonald Engineer: Reinoehl This division of 3 lots was referred to a map study committee. 3. L.C. Lonason The tentative map was discussed as to the question on road width and improvements meeting our Ordinance requirements. MEETING ADJOURNED: 11:30 P.M.
