RECEIVED EXPLANATION OF ELECTRONIC VOTING SYSTE7 Hr. 1onroe 11. Postman gave a brief outline of how the mechanical voting system operates, and demonstrated the workings of the system. ROLL CALL went: Commissioners LACIIENBRUCH, PERKINS, YOU'IG, MUELLER M_env Commissioners CARICO, MAGRUDER, SPENCER, PHILLIPS STAFF PRESENT 7t anager Lawson, City Engineer Russell, Planning Consultant Mader, Assistant Planning Consultant Vlasic, Secretary Schilpp. MINUTES —Chairman hueller stated the riinutes of December 12, 1973, should be cor- rected to read Commissioner Perkins, not himself, seconded the motion to submit the General Plan to the City Council. Commissioner Lachenbruch stated in the same motion, the word "by" should be changed to "be". Commissioner Perkins stated he wanted the Minutes to show the questions he had asked on Dawn Ridge. "Have solutions been presented to the problems of underground water and underground structures on this property?" Answer "No". "Has the Planning Commission considered the previous application on this subdivision, submitted in 1968?" Answer "oto". Tom Vlasic stated the Minutes should show that the request for continuance on the Stedman Subdivision was to January 23, 1974, not January o, 1974. Motion was made by Commissioner PERKINS, seconded by Commissioner YOUNG, the dinutes of December 12, 1973, be approved as corrected. 'lotion was carried, with Commissioner Lachenbruch abstaining. Assistant Planning Consultant Vlasic stated a letter had bFen received from John Riley, Engineer for the Lands of Doyle, requesting a con- tinuance, until January 23, 1974. Motion was made by Commissioner LACHERBRUCH, seconded by Commissioner PERKINS, this matter be continued until January 23, 1974, (lotion was unanimously approved. Murphy, Engineer for this subdivision, was not able to attend the meeting. It was the concensus of the Commission this matter be continued to January 23, 1974. Whib 9—sistant Planning Consultant Vlasic br!efly outlined the Dawn Ridge Subdivision, reviewing some of the drainage problems of the property. Discussion followed between the Commission and Town staff. fir. Hetzel, representing the applicant, spoke requesting the Commis- sion approve the tentative map, excepting for the item having to do with the water drainage problems. Following disucssion, motion was made by Commissioner YOUNG, seconded by Commissioner LACHENBP.UCH, the Commission accept the Tentative Map, with the provisions the plans and specifications be approved by the Town Engineer and Town Geologist, relative to solutions of ground and underground water, before the Commission gives final approval to the flap, and that all conditions, except M10, of the Staff recommendations of January 4, 1974, be met. Motion was carried, with Commissioner Perkins voting no. The staff recommends approval of the Tentative ;tap, subject to the conditions listed in the staff report of January 3, 1974. Commissioner Perkins stated he would abstain from taking part on this matter as a Commissioner, but would participate from the audience, as he had a personal interest in this matter. lotion was made by Commissioner LACHEMBRUCH, seconded by Commissioner YOUNG, this matter be continued until January 23, 1974, because with Commissioner Perkins's abstaining in this matter, a nuorum was not present. Motion was unanimously approved. Paul Nowack, Engineer for the applicant, agreed to the continuance of this public hearing, until January 23, 1974. The staff recommends approval of the Tentative flap, subject to the conditions listed in tiia staff report of January 2, 1974. Mr. Vlasic revie..wed the subdi- 2 vision, including the three exceptions requested for the subdivision. Commissioner Lachenbruch requested the slope density calculations be refigured, as there was an error in them, and requested that Page 2 of the Slope Density Calculations Form be changed to show the name of the subdivision involved. Following discussion, motion was made by Commissioener PERKINS, sec- onded by Commissioner YOUNG, the Tentative flap for the Lands of Gen- eral Chesarek be approved, subject to the conditions listed in the staff recommendations of January 2, 1974, and the "Check List"; the three exceptions be granted; the slope density calculations be veri- fied by the City Engineer; the applicant shall notify purchasers of the lots within the subdivision that they are responsible for mainten- ance and repair of the Drivate cul de sac road and Venedo Lane; right of use of the existing 30 -foot right-of-way, including the existing pavement of Venedo Lane, where adjacent to the nnrthern property line of the subdivision site, shall be obtained for all lots within the subdivision (verification of right of use shall be submitted to the satisfaction of the To!•m Engineer and Town ,Attorney prior to recorda- tion of the final map); and the present owner of the subdivision site shall become a responsible part of the existing maintenance agreement for Venedo Lane as r^.presentative for all parcels within the subdi- vision (upon sale of each lot the new owner shall become the responsi- ble party to the maintenance agreement as representative for his respective lot, thus releasing the present owner of obligation for that site). notion was unanimously approved. DISCUSSED NOISE PROPLMS RELEVENT TO DEER PARK ACRES Assistant annin9 onsu tont as c state an evaluation of the impact of noise generated by Interstate 280 was included as part of the draft envir- onmental impact report submitted on December 7, 1973. Discussion followed eoncarning how, control of noise from IS 280 could. be handled. Chairman '•lueller requested the staff schedule a study session on this mat- ter. January 30, 1974, for a joint work session of the City Council and the Planning Commission. It is requested all members of the Commission attend this meeting, to be h_ld in the Council Chambers, at 7:45 P.M. Copies of the agreement will be forwarded to the Commissioners.
