Use Permit, and the revisions the applicant wished to make.
Copies of the Planning Commission's 11inutes of !jay 30, 1973, containing
the conditions for approval of the Use permit were given to each of the
Commissioners. Planning Consultant ?`ader revie!ed each of the conditions,
and advised the Cormission a letter, dated February 1, 1974, had been
sent to the City :Attorney, requesting a legal opinion on the question of
separating the total contiguous land holdings into te^o separate parcels.
Plannino Consultant Hader stated a a!ritten reply to the letter had not
been received, but the City Attorney had talked with Assistant Planning
Consultant Vlasic. The City Attorney stated in his opinion the total
land holdings should be considered as one parcel, and could not be separ-
ated.
It was the consensus of the Commission the City Attorney submit his opin-
ion in writing.

Discussion followed among the Commissioners, staff, Mr. Bellucci and the
audience.
;'lotion was made by Commissioner SPENCER, seconded by Commissioner PERKINS
the lands of the Los Altos Racquet Club be considered as one parcel, not
as two. lotion was unanimously approved.
Commissioner Spencer noted that t%�,o of the proposed tennis courts were
within the set -back areas, and asked "1r. Bellucci if he planned to request
a variance for the two courts.
`1r. Bellucci stated the map could be redra,rin, with the tennis courts
moved to the right so they would not be located within the set -back areas.

Commissioner Perkins reauested a study be undertaken on the property to
show what the best use of the land might be, ie. recreation club, subdi-
vision, etc.
Commissioner Perkins also stated the Draft EIR was poorly done, as it
did not answer some of the questions being discussed by the Commission,
or resolve some of the problems raised by the audience. He requested a
committee be formed to study these questions and problems.
Chairman ikicller appointed Commissioners Lachenbruch, Perkins, Carico and
staff members City Attorney Gi111o, City Engineer Russell and Planning
Consultant Mader, along with Por. 9elluccito work on the Committee.
Planning Consultant Hader stated a clarification would have to be made by
the City Council relative to reimbursement for his services.
Discussion followed as to the type of questions and problems to be inves-
tigated by the Committee, such as (1) look into the past permits issued
to �Ir. Bellucci for this property, (2) the history of this property. (3)
the possibility of the To -m buying the land for use as open space, (4)
what would be the impact on this land and the surroundinn areas if a sub-
division was developed as compared to the land being used for recreation,
(5) what kind of recreation used could or should be developed on this
land.
Upon 71r. Bellucci's inquiryif he would have to pay for the staff's time
for working on the Committee, Chairman dueller stated he would not be
required to reimburse the Town for the staff's time.

'motion was made by Commissioner SPE°ICER, seconded by Chairman MUELLER, the
meeting be adjourned. The meeting was adjourned at 9:43 P.M.
