Mr. Peters has submitted new plans for the tennis court with a reduction in the setback area from 110n square feet to 300 square feet, as shown on his plan dated February 22, 197x. The staff is recommending approval of the variance requested on the map dated Febru- ary 22, 1974, with the conditions listed in the memorandum dated March 22, 1974. City Manager Lawson declared the Public Hearing opened. Mr. Collin Peters stated he agreed to the conditions imposed in the memo of March 22, 1974. Secretary Schilpp read a letter received from Mr. and Mrs. John J. Harvey, dated March 26, 1974, stating they were in favor of the variance as origi- nally applied for, as they were planning the landscaping of their property around the tennis court. Mr. Peters stated he would prefer the variance be as outlined on the map dated January 29, 1974. `►' Commissioner Carico reported she had talked with the surrounding neighbors and they were all in favor of the variance as shoran on the map dated Janu- ary 29, 1974, and after checking Mr. Peter's property, she was also in favor of this variance. -1- ,I,: , `F 'L' 11:S-.^..I;?ST7'ATI-1 L'UITES - ..arch 27, 1974 Planning Consultant Vlasic stated if the Board approved the variance, as shaven on the map of January 2g, 1974, the conditions recommended would remain the same, except for the encroachment area. There being no one else in the audience wishing to speak on this matter, City Manager Lawson closed the Public Hearina. Commissioner fiueller stated after reviewing both the maps of January 29, 1974,and February 22, 1074, he could only recormend the variance on the map of February 22, 1774. :btion was made by Commissioner MELLER the variance be granted, as amended by the map dated February 22, 1974. John Nagy, tentative buyer of the Lands of Jager, stating the staff Is recommending approval of the request, subject to the conditions listed in the staff memorandum of "iarch 22, 1974. Eglash spoke on the application, concerning the drainage problems in the area, and asking hmi they might be solved. 2 - 011,1r r.F ?L" i.'1Iiar "T I'.!ISTR."u I`.'! `T IiT-'-.c - "arch 27, 1^7A Assistant Planning Consultant Vlasic stated a report had been received from the Santa Clara County Health Department, stating percolation tests had been performed on this lot in 1960, and they were recommending approval, subject to the irstallation of a 1500 gallon sceptic tank, with a 5^4 foot drain - field, plus 100 percent drainfield expansion area. Motion was made by City Manager LA'.?SON, seconded by Commissioner MUELLER, this building site approval request be referred back to the Santa Clara County Health Department for further study and new percolation tests, and this matter be continued until the meeting of April 10, 1474. notion vas unanimously approved.
