APPROVAL OF MINUTES: March 27, 1974:
Planning Consultant Tom Vlasic noted that the action taken by the
Commission on the LANDS OF JAGER request for building site approval
was incorrect. The Commission had moved that the request would be
referred to the Health Department for study and comment in order to
get more information, and not for further percolation tests, as stated.
The Commission agreed that this had been the decision.
MOTION SECONDED AND CARRIED: Commissioner Young moved, seconded by
Commissioner Carico and unanimously carried that the Minutes of March 27,
1974, be approved as corrected.
REQUESTS FOR VARIANCE:
1. Thomas Keller - File $Var. 7003-74, John Riley, Engineer
Planning Consultant Tom Vlasic said that Mr. Keller was requesting a
variance for a swimming pool within the setback lines. Reasons given
were that if the setback requirements were strictly adhered to, the
result would be a less attractive site development, excessive shading
of pool by trees on property. He also stated that the subject lot was
undersized and created prior to the Town's incorporation.
In a memo to the Commission dated April 4, 1974, Staff recommended the
granting of this variance under the conditions recommended therein,
specifically:
1. Additional landscaping shall be introduced alonq the northeastern
property line to provide visual buffering between the pool area
and the Joakimides residence. Landscaping plans shall be submitted
with the building permit application satisfactory to the City
Manager, and plants shall be installed and maintained.

2. Within the setback area, the proposed fence shall be no
higher than six (6') feet, the maximum height permitted by
Section 9-5.503(b) of the zoning ordinance. Staff also recommended
that the Commission find that this project is categorically
exempt from requirements of the CEQA.
Commissioners directed questions to Staff pertaining to any precedents
set regarding this type of variance, whether any objections had been
received from neighbors, and the type of landscaping to be used as a
buffer.
Mr. Vlasic stated that several variances had been granted of a somewhat
similar nature, but that most variances were unique; that neighbors had
indicated no objection to the granting of this variance; and that the
City Manager would review the landscaping plans at the time the building
permit was granted.
After several questions had been directed to the applicant, Mr. Keller,
Commissioner Young moved, seconded by Commissioner Carico and unanimously
carried to grant this request for variance subject to the conditions
stated in the Staff memo of April 4th and related above, and that the
project be categorically exempt from requirements of the Environmental
Quality Act.
REQUESTS FOR BUILDING SITE APPROVAL:

Mr. Vlasic gave background of this request and said that Staff had sought
further information from the Health Department regarding the septic
tank system. The comments of the Health Department are contained in the
Staff memo of April 4, 1974. He also commented that Staff stands by the
original recommendations made concerning this request contained in the
memo of March 22, 1974, specifically: That the request for building
site approval be granted subject to the following conditions:
1. A site development permit shall berequired.
2. Prior to issuance of a site development permit, a soils
engineering investigation shall be prepared to the satisfaction of
the Town Engineer and Town Geologist.
3. Prior to the issuance of a site development permit, potential
problems that could result from uncontrolled storm water runoff down
the driveway from the subject site to Canario Way shall be investigated
and any necessary mitigative measures implemented to the satisfaction
of the Town Engineer.
4. That portion of the driveway serving the subject site which, by
way of recorded easement, also serves the Arnold parcel, shall be
improved to Town road standards, including a minimum pavement width
of 16 feet, to the satisfaction of the Town Engineer. The remainder

of the driveway will be improved to Town driveway standards.
5. Water for domestic purposes shall be obtained from the
Purissima Hills County blater District.
6. The septic tank sewage disposal system shall be developed
and maintained at all times in accordance with Town standards,
contained in Title 6, Chapter 4 of the Municipal Code. Specifically,
minimum drainfield requirements shall be 500 feet, plus area for
100% expansion. In addition, minimum septic tank capacity shall
be 1500 gallons. .
7. In -lieu park and recreation fees shall be paid as required by
Section 9-4.306 of the Municipal Code.
S. Storm Drainage Assessment Fund fees shall be paid as required
by Section 9-4.905 of the Municipal Code.
9. A bond shall be posted to the satisfaction of the Town Engineer
for all required improvements. All required improvements shall be
completed within one year of the effective date of BSA approval as
required by Section 9-2.07 of the Municipal Code.
Staff also recommended that the site be declared categorically exempt
from the provisions of the Calif. Environmental Quality Act.
Discussion ensued between Commission, Staff and Mr. John Naqee, builder.
MOTION SECONDED AND CARRIED: Commissioner Young moved, seconded by
Commissioner Carico and unanimously approved to grant the building site
approval subject to the conditions contained in the Staff memo of March 22nd
and listed herein, and that the project be declared categorically exempt
from the provisions of the CEQA.
ADJOURNMENT:
The meeting adjourned to the next regular meeting of the Commission on
Wednesday, April 24, 1974. Time: 7:30 P.M.
