Piotion was made by Commissioner PERKIRS, seconded by Commissioner YOUNG,
the Minutes of lay 0, 1974, be approved as submitted. lotion was unanimously
approved.

a variance in order to build an addition to an existing residence, which
will consist of a bathroom within the 17 -foot side yard property line and
a garage addition within the 25 -foot side yard property line. All contig-
uous property owners have indicated they have no objection to the proposed
variance. The proposed additions will not have any effect on the views
of the neighbors as the surrounding residences are on the down-slope from
the Roe residence. The staff is recommending approval of the variance,
however it is noted that any further development of this property to the
northwest should not be permitted, as this could be considered a special
privilefindingge" and thatthisproject affect is exemptnfroman
neighbors.

Commissioner Young asked if the acreage of .8918 included the access road
to the property, Is'this should not be included under the present ordinance.
Assistant Planning Consultant Vlasic stated the road..iay was excluded from
the net acreage, leaving a net acreage of .891.
Commissioner Perkins inquired if the formation of this lot pre -dated the
incorporation of the Town.
Assistant Planning Consultant Vlasic stated it did. ...
Commissioner Young inquired if further additions to the residence are
planned for the future.
Jackson Roe, applicant, statad no further development of the residence is
planned.

Curing the discussion, Assistant Planning Consultant Vlasic stated if any
further additions to the residence are planned, they should not be to the
rear of the house, only to the front.
?lotion was made by Commissioner YOUNG, seconded by Commissioner PERKINS,
the requested variance be approved, subject to the staff notation that
further development of the northwest corner of the parcel not be permitted,
and that this project be found categorically exempt from an EIR Report.
Motion was approved, with Commissioner Perkins abstaining, stating he was
acquainted with the architect retained by Mr. Roe.

ommissioner erkins requeste the onmigs on d scuss the question of grant-
ing variances to small lots, under one acre. The Planning Commission and
this Commission should have guidance on where to draw the line as there
are lots in the Town that are less than one acre, and these do create prob-
lems and hardships on both the applicant and the Commission when the owners
want to develop their property further.
Assistant Planning Consultant Vlasic reviewed some of the problems that the
Town has had to deal with when considering variances for lots under one
acre, i.e. the size of the lot, placement of buildings and trees and the
setback requirements of the Town. Nhen the staff is revietiing a requested
variance,they look more at the size of the lot before considering other
factors such as the shape of the lot and the topography.
Commissioner Perkins asked what the size of the lot should be when the set -
4W back can no longer be maintained i,ihen an applicant requests a variance,
and if a change can be made inthe ordinance to deal with this problem.
Assistant Planning Consultant Vlasic stated that when he reviews a requested
variance, be looks at the history of the area and any precedences that have
been set. When the setback requirements were studied some time ago, it
was decided that some consideration should be given to small lots and
that other factors should serve. as guidelines, i.e., if the lot was created
when the County only required one-half acre lots and only 20 -foot setbacks
instead of the 40 -foot setbacks that the Tonin reouirps.
During discussion, Commissioner Perkins asked that an inventory be prepared
showing all the lots that exist which are under one acre in size.a.nd %!hen ,
they •.,ere created. Also, the Planning Consultant should prepare a recom-
mendation on the standards the Commission could use when considering
variances for thse lots.
Commissioner Carico requested the list include the surrounding lots and
their sizes.
Commissioner Young stated the ordinance does deal with the shape lines of
lots, and this could be a controlling factor when considering variances,
i.e., could require certain straight lines when considering variances for
lots one-half to one acre in size.
+w` Commissioner Carico .requested this list be prepared for the COmmnssion by
the next meeting. The list should include all lots under one acre in size
within the Town's limits and should list the size of all irnediately adjoin-

Assistant Planning Consutlant Vlasic stated this kind of study would take
` a great deal of tine to prepare, and as there are many other items his firm
is working on that have deadlines to meet, they could not do it at this
time.
Commissioner Carico requested this matter be brought to the attention of
the Town Manager and Town Engineer; and if it is not possible to compil()
this information by the next Commission "fleeting, a definate date when this
information will be available be conveyed to the Commission. (NOTE: City
Manager stated this information will be completed and distributed in 45
days.)
Commissioner Perkins stated he did not think the Los Altos Villa group
needed to be included in the list.
Commissioner Carico stated if there were any other 'groups of lots that are
under one acre, they should be noted, but they did not need to be included
in the list.
