Commissioner Carico called the meeting of the Variance and Permit Commission
to order in the Auditorium of Fremont Elementary School, 268no Ortega Drive,
Los Altos Bills, at 7:03 P.M.

Commissioner Carico stated the Minutes of June 12, 1974, would stand an

variance for a tennis court which would encroach 24 -feet into the front set
back area. The Town's zoning ordinance requires a 4n -foot front set back
from the property line. The plot plan submitted by the Harris', was revior.;
on June 18, 1974. The revised plan does not meet the necessary findings
the Commission must make in granting the Variance. The revised plan requires
,;necessary removal of existing buffer vegetation, and the front yard en-
croachment is greater than necessary. The Santa Clara Valley Mater District
.s reviev:2d the plan, and has requested the tennis court be located in such
a aj that there will be a minimum of 8 -feet between the top of the bank and
the court, and they have submitted a suggested drawing that would accomplish
this requirement. The staff is recommending the variance requested, as
shown on the revised plan, be denied without prejudice. The staff is also
suggesting the Harris' rraubmit their variance reauest, using t',,,-ir original
plot plan, as this does meet all the requirements the Commission must find
for granting a variance.

Assistant Planning Consultant Vlasic stated the 8 -fent set back requested by

set back is required, in order to construct a master bedroom and bathroom
addition on top of an existing carport. The existing house and carport were
constructed prior to current setback requirements. At the present time
there are three private road easements crossing the property, which severly
constrict the availability for land for further residential development.

Randy Eyler, applicant, spoke on his reasons for requesting the variance.
Motion was made by Commissioner YOUNG, seconded by Commissioner CAPICO, the

Mrs. Camenzind, applicant, also spoke requesting approval of the building
site.
Paul Nowack, E:gineer for the applicant, stated the driveway to this pro Perl.

think it fair to require the applicant to provide storm drainage for the
benefit of all the property owners.
City Manager Lawson stated the staff is recommending drainage imorovements
cause the drainage problem is caused by water running off o" Lot 21, and
since tuis is a private road the Town cannot do anything about the problem.

Mr. Cowan, and that the recommendations made by the Town Geologist be brought
to the attention of the Site Development Committee. Motion was unanimously
approved.

Hilltop Drive be continued until July 10, 1974. Motion was unanimously
approved.
