The Town's zoning ordinance requires a 4n -foot front set back from the property line. The plot plan submitted by the Harris', was revior.; on June 18, 1974. The revised plan does not meet the necessary findings the Commission must make in granting the Variance. The revised plan requires ,;necessary removal of existing buffer vegetation, and the front yard en- croachment is greater than necessary. The Santa Clara Valley Mater District .s reviev:2d the plan, and has requested the tennis court be located in such a aj that there will be a minimum of 8 -feet between the top of the bank and the court, and they have submitted a suggested drawing that would accomplish this requirement. The staff is recommending the variance requested, as shown on the revised plan, be denied without prejudice. The existing house and carport were constructed prior to current setback requirements.
