ROLL CALL Present: Commissioners CARICO, LACHENBRUCH, PHILLIPS, SCHICK, SPENCER, YOUNG. Absent: Commissioner PERKI11S. STAFF City Manager Lawson, City Engineer Russell, Assistant Planning Consultant Vlasic, Secretary Huffstetter. APPROVED USE PERPIIT FOR LANDS OF LAHr,, FOR SECOr!D DUELLING ON 5.439 ACRES AT Assistant anning Consultant Vlasic stated the Lands of Lang are requesting a conditional use permit for a second dwelling, with full kitchen facilities on 5.439 acres, at 26790 Taaffe Road, as per the plot plan dated March 15, 1974. The surrounding property owners have indicated they have J objections to the proposed construction. The staff is recommending approval of the con- ditional use permit, subject to the conditions listed in the memo of June 18, 1974, and the Pathway Committee recommendations made at their meeting on June 24, 1974, which consists of a natural nathway, 10 -feet wide, along Taaffe Road i.jl the westerly side of the property line. The applicant has taken ,xcaptionto the recommendations of the Pathway Committee. It is also recommended this project be found categorically exempt from the requirements of the CEQA. Harold Wright, attorney for the Langs, stated the main dwelling on this pro- perty is a legal non -conforming use, as it )as been used for two separate dwelling units since 1926. He also reviewed the recommendations of Pathway Committee, stating the pathway along the westerly side of the pro- perty should not be granted. One reason is that it will int -r- zrawith the apricot orchard and the second is there used to be a pathway easement along the other side of the property and it was abandonded. He read a letter from David Packard, stating Mr. Packard would not give the Town any additional pathways through his property. Mr. Lang spoke in favor of granting the conditional use permit and against the Pathway Committee's recommendation for the pathway along the westerly -,roperty line. ` Cdr. Joseph Dochnahl, representing the Pathway Committee, spoke on the Com- hw mittee's reasoning for requesting the two pathways. Discussion followed on the requested 10 -foot pathway easement along the westerly property line of the Lang property and the Rosehill Estates Sub- division. -1- PLANNIAG COMMISSION - June 26, 1974 Mr. aright presented a letter from Mr. Shibuya, also objecting to the path- way along the westerly property line. Chairman Spencer read the contents of the letter. Commissioner Lachenbruch stated therewere four points to be considered by the Commission, (1) is a conditional use permit needed, (2) should the primary dwelling be considered legal, (3) should there be a pathway easement along Taaffe Road, and (4) should there be a pathway easement along the westerly property tine. He elaborated on each of the four points, stating there should be a conditional use permit issued, and it did appear the primary dwelling was established prior to the County's zoning regulations. He also felt there should be a pathway easement along Taaffe Road, but not along the westerly property line. Following discussion, motion was made by Commissioner LACHENBRUCH, seconded by Commissioner YOU"IG, that a pathway easement be required along Taaf'� Road, but not along the westerly property line, the primary dwelling be con- sidered as a non -conforming use, to be abandoned by January 27, 1976, al,d a conditional use permit be issued for the second dwelling, subject to the conditions listed in the staff memo dated June 13, 1974. Motion was carried by the following roll call vote: AYES: Commissioners SCHICK, LACHENBRUCH, PHILLIPS, YOUNG, CARICO, SPENCER. H,� Comiissioner NONE. ABSENT: Commissioner PERKINS. RECESS Chairman Spencer declared a short recess at 9:25 P.M., and reconvened the meeting at 9:30 P,,' -I. ��.���»,����� month "June" should be added before 12, 1974. Commissioner Schick also stated on Page 8, Faith Vanguard should be changed to "Faye Baungarten" and Carol Gotlee should be changed to "Carol Gottlib", and in the first paragraph LaReha should be changed to "Lagena". On Page 11, paragraph 4, Commissioner Schick stated she wanted the minutes to stere that she, not Planning Consultant Mader read from Page 64 of the Revised General Plan. Commissioner Carico stated the word "cleanliness" should be inserted before the last word "stables" in paragraph 2, Page 9. Chairman Spencer stated the Minutes of June 12, 1974, would stand approved as corrected. Councilwoman Miller state et" the southern end of the owns limits, outside the limits, there are 12 acres of land owned by Paul Radic. The American Tennis Association is proposing to buy this land and make I. into a tennis kftw club, consisting of 18 tennis courts, several swimming pools, a club house and a dining room. The only access to the property would be by Eastbrook - 2 - PLANNING CDNMISSIDN - June 26, 1974 Avenue. Although this land is in t`.= County, 1t is in the Town's Sphere of Influence. The properties neighboring these 12 -acres feel the Town's z,ning shout/ apply to this land. The County zoning on this property is R -1-E, which would allow this type of development. This matter will appear before the Santa Clara County Planning Commission on July 18. Mrs. Miller briefly outlined the courses of action the Town could take (1) oppose the c!evelopment and (2) request this be covered under the Community Service Zoning (which the Town does not have at the present time). She feels the Town should fight this, as this development is not in the best interests of the Town. During discussion on this matter, City Manager Lawsonelaborated on the Ur- ban Service Area and the Community Service Zoning and what these areas cover. Chairman Spencer requested the City Manager send a letter to the Santa Clara County Planning Commission, stating the Los Altos Hills Planning Commission requests this matter be referred to the Town for study and comments. City ai.ajer Lawson stated each year, in September, LARD asks each city if it wishes to change its service area boundaries. Perhaps the Commission shcutd look at this in regards to planning for the Town, and maybe suggest to the Council the Community Service Area 5a changed to be the same as the Urban Service Area. Councilwoman Miller requested the Planning Commission, at its nert meeting, be furnished with a map showing the area at the south end of Town and East- brook Avenue, where the property under discussion is and the road problems that are present. City Manager Lawson stated that public hearing notices have to be mailed ten days prior to the meeting, and a definite time has to be stated on the no- tices for the hearingsHowever, any time the Commission decides upon can be set for public hearings. Chairman Spencer stated the study session should be held first, followed by matters that will only take a short period of time, them matters that are length,, and before the agenda is made up, he should be consulted, Commissioner Phillips suggested the meeting be scheduled to begin at 7:38, an - this would give the Commission fifteen minutes more. During the discussion on this matter, Chairman Spencer read some rotes made by Commissioner Perkins, including that no iteup at them should be brought Meetings unless the proper background material hrd been sent to the Planning Cormissioners prior to the meeting. Chairman Spencer stated he felt field trips were important, and should be scheduled any time the staff feels there may be problems on a tentative sub- division. Discussion followed on the merits of field trips and when they should be c-aduled. Discussion was also held on staff meetings. City Manager Lawson stated staff meetings are held when needed, on Thursdays, at 1:30 P.M. If any %m- missioners are interested in attending, they should contact the office to check if there will be a meeting that week. Chairman Spencer stated that in reviewing the minutes, he felt th=y were too limp and could be shortened if some of the detail was eliminated and more condensing was done. City Manager Lawson stated the minutes were being done in the manner the Com- mission had asked for. If the Commission desired to have the minutes con- densed, the secretary will do so. The Council will be reviewing the Citizens Budget P.eview Report.
