Chairman Spencer called the meeting of the Planning Commission to order in the
Auditorium of Fremont Elementary School, 26300 Ortega Drive, Los Altos Ilills, at
7:40 P.I1.

Upon inquiry by Chairman Spencer, City Engineer Russell revie�.:ed the action
taken by the Variance and Permit Commission earlier in the eveninn on the
Lands of SChaner, request for modification to Cie approved "Check List" of
conditions for the Building Site .Annroval on the Archibald property, north-
east corner of iiranda and Fremont.

Plan, Noise, Scenic !tighriay and Seismic Safety,are required by State lam to
be adopted by September 20, 1974. Prior to adoption, public hearings must
be held on each element by both the Planning Commission and the MY Counci
and suggested the public hearings be scheduled either :Aunust 28 or Septembe
11, 1974.
A discussion was held concerning when the public hearings on these three
elements would be held and what action could he taken against the Toren if
these elements were not adopted by the September 21) deadline. It was sugge
the public hearing on the Scenic Highwav Element be held on Senterber 11,
the public hearing on the "loise and Seismic Safety Elements be held on Oc4c

the Planning Commission ten days nrior to the public hearing date.
During the discussion, Commissioner Perkins suggested these three elements
of the General Plan be scheduled for discussion under "Study Session" at the
meeting of August 23, 1974.
Lndlrman Spencer stated he had asked the Planning commissioners Lo suonnc
subjects they felt should be discussed by the Commission durinq the Study
Session portion of the meetings, and suggested the following (1) there is a
need for clarification of the easements on Fremont Road and (2) should study
the Page 11ill Road - Noody Road area in terms of what the Town wants in the
way of development of this area.
Commissioner Perkins stated he would like to make the following suggestions
(1) a review of the ordinances concerning subdivisions, site development and
zoning, (2) study on non -conforming uses, which must end on January 27, 1976,
(3) study road standards, (4) study path s'a•,dards, (5) study Fremont Road
for possible bike paths, which are badly needed, (i) review the open space
needs and desirac of the Town, and (7) there is a need to set priorities in
maintain' q C)e ru-1 atmosp�I :r-. '•f the Tovr:.
Commissioner Young statedhe would like to have discussions on (1) policies
and actions of neighboring agencies and their effect on the Town, (2) review
the Site Development Committee, its duties and responsibilities, and (3) the
possibility of an architert ❑l design control committee for reviewing new
residences, se the residences will fit the land.
Commissicner Carico stated she could like to have a report from the Planning
Policy Committee once a month.
Chairman Spencer stated that Commissioner Carico had been appointed to the
Planning Policy Committee, as the Town's representative.
Commissioner Phillips stated he would like to study (1) w',,at is meant by the
tern "rural atmosphere", and (2) the To!an's corrlittee structure and whether
the Town needs a Planning Commission, or if this function could be carried
out by the City Council.
Planning Consultant Fader suggested the Commission should reviej (1) the
trails and path elements of the Town and (2) the budget aporoved by the City
Council, in the area that affects the Planning Commission.
RECESS
Chairman Spencer declared a short recess at 8:42 P.1., and reconvened the
meeting at 3:54 P.'t.

City Engineer Russell stated a letter by !dayne Hiller, 25§fl Fremont Read,
addressed to the City Council, had been referred by the Cour:cil to the Plan-
ning Commission for study and recommandation on whether or not tie Town
IiiAW should ahandoh the pathway adjacent to the hiller property. The pathr,zy in
question is in the public 'right -of -pray.
Following a general discussion on the pathway, Ilayne hiller spoke on the rea-
sons for his request for either abandonment of the pathway or improvement of

the pathway, including improvement of the fence, the catch basin and the
culvert.
During the following discussion, City Engineer Russell reviewed some of the
problems of the pathway and the flooding, including the deterioation of the
path and thea fence and drains^e of water from rain.
!lotion was made by Commissioner PEP,KIIIS, seconded by Commissioner CARICO,
that since the path alone the ,tiller nronerty on Fremont is a vital nart of
the path system and shouldrot be abandoned, and 'Ir. ?4iller is willing to
cooperate in arriving at a satisfactory engineering solution, the Commission
urges the Council to take immediate action 0th the staff and with the appli-
cant in arrivino at a solution. iiotion was carried by the following roll cal

Assistant Planning Consultant Vlasic stated a letter, dated July 23, 1974,
had been received from E. A. Morgan, requesting his tentative subdivision
map be exempted from the moratorium, as it is only a lot line change, there
will be only minimum grading, no trees will be removed and there will be no
now roads. The staff, in the August 3, 1974, me- -randum, is recommending the
Commission recommend to the Council this tentative subdivision be exenoted
from the subdivision moratorium, since it does not raise significant question
regarding the subdivision problems enumerated in the moratorium resolution,
such as grading and building site suitability.
Discussion followed on the tentative subdivision and the moratorium resolution:
on subdivisions.
Lotion was made by Commissioner YWM, seconded by Commissioner CARICO, the
Comission recommend to the City Council this tentative subdivision be ex-
empted from the moratorium on subdivisions. "lotion was carried by the follow

the Lands of -,&M Ridge Estates, to tae Citv Council. On lurch 21), the Coal,
referred the proposed subdivision map back to the Planning Commission for
further study, and on April 10, the Commission denied the c ;; .,i t"-,-. ri: -.rrj,,

proposed lots 2 and 3. The Commission indicated they felt 3 lots vouid be rc,
appropriate to the land. On July 111, the Planning Comission accepted for
1160 filing a revised tentative subdivision map, rtith the lot lire between lots 2
and 3 eliminated. After reviewing the revised tentative 3 -lot sabdivisirn T -.,-
dated June 13, 1974, and the associated drainage channel play , the staff is
recommending approval of the tentative 3 -lot subdivision map, subject t) the

conditions listed in the staff memo datel July 18, 1074. The conditions
�. 'recommended in the memo are the same as recommended for the original tenta-
tive subdivision nap, except they have been modified to reflect the elimina-
tion of one lot. It is also recommended the draft EIR be approved, with the
modification indicating the project now consists of 3 lots instead of 4.
Discussion folloued concerning the revised tentative 3 -lot subdivision map for -
Dawn Ridge Estates.
!lotion was made by Commissioner CARICO, seconded by Commissioner YOUNG, the
revised 3 -lot tentative subdivision map for the Dawn Ridge Estates, dated
June 18, 1974, be approved, subject to the conditions recommended in the
staff memo of July 18, 1974, and with the recommendation on the Environmental
Impact Report. Motion was carried by the following roll call vote:

Assistant Planning Consultant Vlasic stated that each year, during October an,
November, LAFCO reviews the Urban Service :Areas of cities. The Council has
requested the Commission review the Toc!n's Urban Service Area, ahich is the
same as the Town's limits, and the Town's Sphere of Influence, which includes
areas outside of the Tour's limits, and make a recommendation to the Council
on whether the Town should change its Urban Service Area to include all areas
within its Sphere of Influence. The Sphere of Influence boundaries are bound-
aries adopted by LAFC0, which delineate limits beyond which a city cannot
annex territory. The Urban Service Area consists of land, within a city's
Sphere of Influence, which is now served by existing urban facilities, utili-
ties and services, or proposed to be served within the first 5 -years of a
city's adoption of a Capital Improvement Program. Vie pointed out on a map
the Town's Urban Service Area and the Sphere of Influence boundaries, stating
the areas inside the i,. Sphere of Influence are already developed and are
receiving urban services.
During discussion, Chairman Spencer requested both the Torn staff and the
Planning "consultants provide more information concerning these areas.
Notion was made by Commissioner SCHICK, seconded by Chairman SPE"CER, this
matter be continued to the meeting of August 28, 11)74, for further discussion
Motion was carried with Commissioners Young and Carico voting no.

City Engineer Russell stated the Town had received a notice from the Countv
of Santa Clara, Planning Department, of a requested zone chanoe of property
located southeast of the Town and bounded by the Expressway, flagdal�ne, Summer
hill and Adona Play, frori RIE -10, 10,000 square feet per lot, to RIE -29, 2%n0')
square feet per lot. On August 9, 1974, a letter was sent to the County
thanking them for informing the Town of the pending zone change, and that the
`, dovmzoning of this area was in keeping with the Town's one -acre minimum lot
size zoning.
A brief discussion was held on the requested zone change, and Ccmmissier:o:•
Phillips recommended the staff be commended for the letter, sent to the County

Planning Department concerning the notification, of this rezoning.
Assistant P arming Consultant Vlasic stated his office had begun some prelim-
inary work on suggested revisions to the subdivision ordinance, however a
contract has not been received by the Office of �lilliam Spangle. He reviewed
what work had been done to date.
Chairman Spencer stated there should be a Subcommittee of the Plannino Com-
mission to assist in the work, and appointed Commissioners Schick, Perkins
and Spencer to the Subcommittee, with Commissioner Perkins as Chairman of
the Subcommittee.
After discussion on the work to be done, Chairman Spencer set Saturday, Augus'
17, at MO A.1., at the entrance of Parkside Subdivision for a field trip
to look at completed subdivisions, with all Conmiissioners invited, to gather
ideas on what constitutes a "good" or a "bad" subdivision.
During the following discussion, Commissioner Perkins listed four items he
felt should be looked at (1) cuts, (2) paths and road separation, (G) road
standards and design, and (4) lot size.
During further discussion, the question was raised on when is a tentative sub.
division map considered "accepted". Assistant Planning Consultant Vlasic
stated the City Attorney had given the opinion, according to the Toon's P1uni-
cipal Code, the tentative subdivision map is not "accepted" until the Plannin
Commission accepts the map at a meeting.

Chairman Spencer stated he was appointing Commissioner Lachenbruch to the VarL
iance and Permit Commission, to replace Commissioner Carico, who had served
for nine months. Also, within the next few months, he will appoint replace-
ments for Commissioners Young and Perkins, as they have served for several
months already.
Discussion was held on the possibility of holdinn the Variance and Permit Csm-
mission meetings at a different tine or only once a month, however no dec"ssi,7n
was reached.
