Commissioner Young called the meeting of the Variance and Permit Commission to
order in the Auditorium of the Fremont Elementary School, 26800 Ortega Drive,
Los Altos Hills, at 6:58 P. M.
ROLL CALL
Present: Commissioners PERKINS, LACHENBRUCH, YOUNG.
Absent: NONE

Motion was made by Commissioner PERKINS, seconded by Commissioner YOUNG,
the Minutes of August 14, 1974, be approved as submitted. Motion was
carried with Commissioner Lachenbruch abstaining.

Assistant Plano 44 Consultant Vlasic stated that Mr. Russi has requested
Building Site Approval for Lot 6, Tract 2578, located on the corner of
Hilltop and Colina Drive, consisting of 1.00 net acres of land. The staff,
in a memo dated August 21, 1974, recommends approval, subject to the condi-
tions listed in the memo, and that this site be found categorically exempt
under the provisions of the California Environmental Quality Act.
City Engineer Russell reviewed Condition 1 for road improvements to Hil"iCo.
and Colina Drive, and requested the condition be changed to read, "Road
improvements consisting of crack sealing 35 linear feet, along Hilltop
Urive, adjacent to the property; cleaning, resurfacing and seal coating a•:
area 4 feet ty 26 feet on the east side of Colina and cleaning the gutter
along tha west side of Colina for the length of the property.
Assistant Planning Consultant Vlasic stated one of the conditions recomme�;de�
was for a pathway within a ten -foot easement. However, there is a distance
of 25 feet between the edge of the pavement on Hilltop Drive and the edge or
the public right-of-way, and it is the staff's opinion the pathway can br.
constructed within this 25 foot public right-of-way, without requir,ng an
additional 10 foot easement.
During the discussion, Commissioner Lachenbruch stated he did not feel the
easement should be required if the pathway could be constructed with a mini-
mum of 10 feet separation between the edge of the pathway and the edge of th;
roadway.
Mr. Russi, applicant, stated he had no objection to the pathway being IO fee
from the roadway pavement as there is 25 feet between the pavement and his

property line.
Discussion continued on the pathway requirement and the location.
Motion was made by Commissioner PERKINS, seconded by Commissioner LACHENBRUCI
the application for Building Site Approval for the Lands of Russi be approve,
subject to the conditions listed in the staff memoranda of August 21, 1974,
and the revision of Condition 1, to reflect the City Engineer's recommenda-
tion for road improvement, Condition 5, to reflect the pathway be parallel
to Hilltop Drive and have a minimum separation between the roadway pavement
and the edge of the pathway of 10 feet, and that this site be found categor-
ically exempt from the California Environmental Quality Act. Motion was un
animously approved.

Court and La Barranca Way, consisting of 1.013 net acres of land. The staf
in the memo of August 22, 1974, recommends approval, subject to the condi-
tions listed in the memo, and that this site be found categorically exempt
under the provisions of the California Environmental Quality Act.
Mr. Saladino, applicant, inquired if all the conditions recommended had to
be met prior to the issuance of a building permit.
` City Engineer Russell stated all of the approved conditions had to be met
within one year as in Cection 9-2.07; or a written agreement could be enterr
into, as outlined in Section 9-2.06 of the Municipal Code, secured by cash
or a security bond.
Discussion followed concerning the pathway recommendation.
Motion was made by Commissioner LACHEHBRUCH, secondad by Commissioner 'PERK."

requested gE;logy report, but the Town Geologist had not completed 1,rs re-
vizw of the report. The staff is requesting this item be continued to the
neeting of Scptamber 11, 1974, at which time a ful'i report will be made.

%r City Enginzer Russe 1 stated due to the opening of school, meetings will
no longer be held at the Fremont Elementary Scnool. n11 future meetings,
until further notice, will be held in the Board Room of Foothill College,
12345 E1 Monte Road, Los Altos Hills.

engineer Russell stated he recommended all Commissioners, if possible,
make an on-site inspection of the parcel of land for the Lands of Haop.
There are drainage problems on this land. However, most of the problems are
caused by other properties, adjacent to the Happ property.
Discussion followed on this matter.
NOTED PROBLEMS CONCERNING DELIVERY OF COMOISSIONERS' PACKETS
Commissioner Lachenbruch stated e had to pay postage on his Commission
packet. Apparently the postman had taken the packet out of the mail box, an(
would not relinquish ossession until postage was paid.
City Engineer Russell stated this problem had occurred before, and he would
request the Town's Security Patrol Officer, who delivers the packets to
both the Planning Commission and the City Council, to place the packets on
the front porch, instead of leaving them in the mail box.
