Chairman Spencer called the meeting of the Planning commission to order in the
Auditorium of Fremont Elementary School, 26800 Ortega Drive, Los Altos Hills, at
7:41 P.M.
ROLL CALL
Present: Commissioners SCHICK, LACHENBRUCH, PHILLIPS, YOUNG, CARICO, PERKIN
SPENCER.
Absent: Commissioner NONE.

MINUTES
chairman Spencer stated on Page 2, of the August 14, 1974, Minutes, second
paragraph, number (2) after the words "Moody Road Brea in terms of% should
read, "the scenic highways element of the General Plan", On page 5, third
paragraph, Chairman Spencer should be changed to Commissioner Perkins.
Assistant Planning Consultant Vlasic stated Paae 2, paragraph one, should
read after "Commissioner Perkins suggested", "the Scenic Highway Element",
not "these three elements".
Chairman Spencer stated the Minutes of August 14, 1974, would stand approved
as corrected.

rfi-airman Spencer inquired why the Hayne Miller property, 25561 Fremont Road,
pathway deterioration problem and Planning Commission's recommendation, had
not been brought to the attention of the City Council at their meeting of
August 21, 1974.
City Engineer Russell stated this item had been inadvercntly omitted from
the agenda for the August 21, 1974, Meeting. It is scheduled to appear on
the City Council's Agenda for September 4 1974.

Design
the General Plan has been reviewed b various agencies,
Design Committee has been the only Cornittee to respond to the Element. He
reviewed the Element, stating all roads have been included to some degree,
and reviewed briefly the main roads that are listed, in addition to Inter-
state Highway 280.
During discussion, Commissioner Perkins stressed that this element is a very
important element and should not be covered lightly.

As discussion continued, the matters of undergounding utilities and the need
for separate pathways along roads were discussed in depth. Commissioner Caric
requested the matter of pathways be included in Item 5, Page 2 of this Element

21, 1974, concerning the Town's Sphere of Influence and the Town's Urban Ser-
vice Area. He stated that if the Town wished to extend its Urban service Area
which at this time is the same as the Tan's limits, the request must be sub-
mitted to LAFCO by October 15, 1974, as LAFCO reviews all requests during Octo
her and November. LAFCO delineates the Sphere of Influence as the boundaries
beyond which a city cannot annex territory. The Urban Service Area consists
of land, within a city's Sphere of Influence, which is now served by existing
urban facilities, or proposed to be served within the first 5 -years of a city'
adoption of a Capital Improvement Plan. The staff is recommending this matte
be referred to the City Council for their determination.
During general discussion, Commissioner Carico reviewed information she had
received concerning County CS Zoning, including what influence the T -',n woul
er would not have on County land that is presently included in the Urban Sr_r-
vice Area. She stated the City Attorney had stated that any land included
in the Urban Service Area would not have to be provided additional services,
other than the services now provided within the Taun's limits.
Followina further discussion, Commissioner Spencer stated he would forward a
letter to the City Council stating the feelings of the Commissioners concerni:
this matter.

Assistant Planning Consultant Vlasic stated this tentative subdivision has bee
under review since January 23, 1974. At the meeting of May 8, 1974, the "cm -
mission had completed deliberation on most major items except the conserva-
tion easement. In addition to the conservation easement, the Commission also
needs to consider the appropriate findings for the "conditional exception" fir
approving C3untryway as a private road, the drainage provisions, as descrihed
in the drafc EIR, and the final EIR. •'sir. Stegner has been contacted regardir.r
an emergency access road across his property, but has stated he would not agr,,.
to this. Consequently, the emergency access road connection shown on the

Discussion follcwed on the possibility of the water tank and its location,
and Assistant Planning Consultant Vlasic reviewed the steps that could be use:

Assistant Planning Consultant Vlasic reviewed, in depth, the private read sta
of Countryway, stating it is necessary for the Commission to make findings

for the "conditional exceptions" for designating Countryway a private road in,
stead of a public road, as the number of lots on this cul de sac exceed 5,
as permitted by the Municipal Code, Section 9-4.601 (i).
Discussion was held on the Commission's reasoning for determining that Countr
way should be a private road.
Motion was made by Commissioner PHILLIPS, seconded by Commissioner YOUNG, this
matter be referred to the staff and the City Attorney, to come up with langu-

Assistant Planning Consultant Vlasic stated the Commission must state, for
the record, the "conditional exceptions" for Countryway as a private road.
Discussion continued on the question of private road versus public road.
Assistant Planinng Consultant Vlasic reviewed the staff's recommendation for
a conservation easement, and the areas it �,ould cover. He stated it is felt
this easement is needed to protect the steep slopes on lots 1 and 8 thru 15.
The recommended easement also includes the trace fault line that runs thru
lots 1 and 8 thru 15. He stated that according to the Town's Municipal Code,
no structures will be permitted in the conservation easement without prior
approval of the Planning Commission, however this approval would not require
a public hearing.
Don Bahl, applicant, spoke against the recommended conservation easement, as
this would restrict the usable building areas. He agreed there was arneedf:h-

Discussion followed on the question of a conservation easement and what area-
it should cover.
Notion was made by Commissioner LACHENBRUCH, seconded by Commissioner PERf:IP'°.

Assistant Planning Consultant Vlasic reviewed briefly the drainage provision
recommendation and stated there is no objection by the developer to this con-
dition.
Chairman Spencer, with the approval of the applicant, suggested the public
hearing be continued to the meeting of September 11, 1974, in order to resol,
the question of private versus public status of countryway, stating the staf%

requested to review previous subdivisions for any precedences which may
have been sct concerning "conditional exceptions" for private roads serving
more than 5 lots. Also, the Commissioners were requested to come up with
reasons for making Countryway a private road.

Motion was made by Commissioner PERKINS, seconded by Commissioner PHILLIPS,

imously approved.
Chairman Spencer stated the Commission would hear comments from the audience
concerning this tentative subdivision, at the meeting of September 11, lg74.

had been received from Bob Owen, requesting his tentative subdivision map,
Matadero Heights, be exempted from the moratorium, as he believed this sub-
division does not raise any of the significant points covered in the Morator-
ium Resolution. Assistant Planning Consultant Vlasic reviewed the tentative
subdivision map and the possible problems that might be encountered in the
subdivision, as outlined in the staff memorandum of August 22, 1974, He
stated the staff is recommending exemption from the moratorium resolution be
denied.
Bob Owen, applicant, stated he was requesting exemption as he did not believe
there would be any problems with this subdivision, and he had already put
quite a bit of money and time into this subdivision.
Discussion ensued on the possible problems which might arise with the subdi-
vision.

be exempted from the moratorium, as this had been an on-going subdivision
project since December, 1969. Assistant Planning Consultant Vlasic reviewer,
the tentative subdivision map and the possible problems that might be encount-
ered in the subdivision, as outlined in the staff memorandum of .August 22, 19,

giving the history on the tentative subdivision. He stated it would be a
financial hardship on the owners to deny the requested exemption.
