Also, Commissioner Susi ck stated that Commissioner Carico ­ine,! the following added on Page 2, Paragraph 1, "I am sure the Planning Commission to a person feels exactly like the Traffic and Public Safety Committee does about protecting our Town, and only when we have been assured by Tom Vlasic that the General Plan is only a guideline, vie felt that the intent was not to change the Town or our streets and that we should send a thank you letter to the Committee for their in -nut". Commissioner Lachenbruch stated on Page 1, last Paragraph, under his comments, Number 4 should be changed to "the ordinance does not estab- lish explicit criteria for architectual acceptability", and Plumber 5 should be changed to "the ordinance does not clearly establish the purpose of establishing the body". Chairman Spencer stated on Page 3, fourth Paragranh from the bottom, second sentence, the words "on maps" should be inserted between "to and as". Also on Page 3, first line, there should be a period after the word "Committee", and a new sentence begiriii, viith "Nhile reject- ing the suggestions of the Traffic and Public Safety Committee, the Co^missioners...... Chairman Spencer stated the Minutes of October 23, 1974,viould stand approved as corrected. Chairman Spencer stated the rlinutes for October 39, 1974, aould stand approved as corrected. -1- &LIMNING, COMMISSION - November 13, 1974 CONTINUED PUBLIC HEARII'IC, FOP LA9DS OF MORONI, GERTH LANE AND OLD PAGE MLL ROAD TENTATIVE SUBDIVISIOTTJD_L=M_ZR � - Assistant Planning Consultant Vlasic stated as negotiations with the Santa Clara Valley Water District concerning the Morgan property have not been completed, the applicant has submitted a letter requesting the hearing be continued. Motion was made by Commissioner LACHENBRUCH, seconded by Commissioner SCHICK, this matter be continued to the first meeting in December. Fiotion was unanimously approved. REVIEW OF Assistant Planning Consultant Vlasic statea nppenoix u, udLeu nuvenueF ,, had been distributed to the Commissioners. It contained the basic concepts for changes to the ordinance and standards, as reviewed by the Commissioners at the Special 'leetings held on October 30 and Noverber 4. This Appendix needs to be reviewed so specific wording can be presented to the Cormission on November 25. He also distributed a memo, dated November 13, 1974, with Slope and Road Grade Information, as requested by the Planning Commission. Discussion followed on Appendix B, and sections entitled "General Provisions" "Lot Density and Distribution", and "Adantion of Houses to sites and Attend- ant Grading". Commissioner Lachenbruch requested the Commission look at tale anoroved bud- get for Planning at the next Study Session meeting, and make a list of priorities to be undertaken under the budget heading of "Snecial Studies". RECESS Chairman Spencer declared a short recess at 9:13 P.!'., and reconvened the meeting at 9:23 P.I. ty tanagerr ie stated the City Council referred the tentative subdivi- sion for the Lands of Stedman back to the Planning Corrission (1) so :Ir. Bahl could make proper application for conditional exception in the length of the road "Countryway" and the number of houses on the road, (2) there was a question concerning the Purissima Hills County 'later District's pro- posed 3 -million gallon water tank, which would probably he constructed on parts of Lots 3, 4 and 5 of the tentative subdivision. Councilwoman 'tiller stated the reason the Council returned the tentative subdivision to the Commission was that the approved Check List had not been signed by the Planning Commission Chairman, and the question of 1r. Bahl's appealing some of the conditions on the Check List. Chairman Spencer stated the Check List had been signed by him. Discussion followed on the question of the proposed water tank, its loca- tion, its impact on the area and on the tentative subdivision. Motion was made by Chairman SPENCER, seconded by Commissioner PHILLIPS, this tentative subdivision be referred back to the City Council in view of the fact that (1) the Check List had been signed and (2) the Points 'lr. Following discussion on the question of the effect of the proposed construc- tion of the water tank on this subdivision, Chairman Spencer amended his motion to add "(3) at the time the Check List was approved, the location of the water tank on the Lands of Bahl was brought to the Commission's atten- tion, but in view of the fact that the tank location was not definite, the Commission did not feel it could act upon this item, but if the site became definite, the map mould have to be changed prior to the final map being filed, and a provision was made in the Check List for this event". Commis- sioner Phillips seconded the amendment. Following further discussion on the question of the effect of the proposed water tank on the subdivision, Chairman Spencer stated his motion should read, "The Lands of Bahl be resubmitted to the Council in view of the fart that (1) the Check List had been signed, as approved by the Planning Cormis- sion, (2) the conditions that Mr. Bahl is asking execption to, had been re- jected a couple of times, and (3) while the possible presence of a water tank was known at the time of the approval of the Check List, it was not a definite fact, and part of the reasoning for asking that the map be submit- ted to the Planning Commission before the final map, was the possibility that the water tank might actually be in existance prior to the final map, which i-jould then require a major revision of the tentative nap". Following further discussion concerning the request for the conditional ex- ceptions by Mr. Bahl and the possibility of the water tank being constructed on part of the subdivision by condemnation of part of the lands in the sub- division, and the actions the Planning Commission should take, Chairman Spencer amended his motion to read, "That the Commission resubmit time Bahl Subdivision to the Council, and at that time lie will be prepared to point out the history of this subdivision". Following further discussion„ Commissioner LAC!IENCRUCH seconded Chairman Spencer's last amended motion. Motion was carried by the following roll call vote: AYES: Commissioners SCHICK, LACHENBRUCH, PHILLIPS, YOUip, SPENCER. NOES: Commissioner NONE. ABSENT: Commissioners CARICO, PERKINS. Planning Consultant Mader stat-nt the minutes should show that the Planning Commission had noted the letter received from William I. Cohen, dated !!ovem- ber 1, iS74, (Cooly Subdivision-Koo) concerning t.`le Lards of Stedman and sewer hook-up, but took no action. Mr. Baal spoke briefly on his understanding of what the procedure would be for condemnation of his property for the water tank. ;IT. These items included "(2) Review Drafts of Noise and Seismic Safety/Safety Elements of the General Plan; (2) Review Santa Clara County Open Space Action Program; (4) Review Private Road Re- quirements of Los Altos Hills, (5) Continued Review of the Open Space Lands of the Town". A lengthly discussion was held concerning the Purissima Hills County !later Distict's Final Environmental Impact Report on its proposed 3 -million gallon water tank, and the District's response to the comments posed by the Commis- sion concerning the impact of the water tank on the Town and the areas sur- rounding the proposed site, which is near Alexis Drive and Page !fill Road. notion was made by Commissioner PHILLIPS, seconded by "ommissioner YOUNG, the Town's Geologist, ililliam Cotton, review the Environmental Impact Re- port for the Proposed water tank and any other available material concern- ing this matter, and submit an evaluation to the Plannina Commission on the impact of the water tank on the area in which it will be constructed. flo- tion was carried by the following roll call vote: AYES: Commissioners LACHENCRUCH, PHILLIPS, Y)0e, SPENCEP. Discussion followed on this report and the recommendation, but no action was ta'<a:• by the Planning Commission.
