City Manager Crowe stated the Town Geologist had not finished his re- view, but it would be submitted to the Commission as soon as it is available. He reviewed the element briefly, by section, including the map prepared by the Stata Department of Transporta- tion, showing noise zones along IS 280, and the implimentation steps out- lined in the element. During discussion, Commissioner Schick inquired about the 14110 -feet of Foot- hill Expressway that, according to some maps, is within the Town's boundar- ies. Assistant Planning Consultant Vlasic stated that a review of the original documents describing the Town's limits, no mention is made of the 1400 -feet of Foothill Expressway. Discussion continued on the Noise Element and the need to get input from the Town's Noise Abatement Committee concerning this Element. Motion was made by Commissioner PHILLIPS the Commission request comments from the Noise Abatement Committee. 'lotion died for lack of a second. Following further discussion, Chairman Spencer requested the staff forward a letter, under his signature to the Noise Abatement Committee, requestinq comments from the Committee, for the Planning Commission 1eeting of Decem- ber 11. Chairman Spencer stated he would contact the Chairman of the Noise Abatement Committee concerning the Committee's comments on the Noise Ele- ment. CONTItlUED REVIEI! During discussion on the work done by the Committee studying private roads in the Town in 1968, Chairman Spencer suggested this matter be continued to the first meeting in December, and the City Attorney be requested to submit a written opinion concerning private road agreements, for study at that meeting. RECESS Chairman Spencer declared a short recess at 8:40 P.11., and reconvened the meeting at 8:49 P.M. APPROVED TENTATIVE SUBDIVISON FOR LANDS OF CHESAREK, 2 -LOTS, gER!CEN_ALTA"10NT R0 D T!D i D L E Assistant Planning Consultant Vlasic stated on January 9, 1974, tFx Planning Commission approved a tentative 4 -lot %,:,division for the Lands of Chesarck. Since then,the applicant determined ;.his did not meet :,is requirements, and by letter, dated August 8, 1974, he submitted a revised tentative subdivi- [ `, sion map, consisting of 2 -lots, one of which is labled "not a building site". - 2 - ' 'PLANNING COjIMISSION - November 25, 1974 On Septamber 11, 1974, the Planning Commisison recommended to the City Coun- cil this revised tentative subdivison map be exempted from the moratorium on subdivisions (Res. 790), and the Council approved the exemption on SePtem- ber 18, 1974. The revised tentative map ,,,as accepted for filing by the Com- mission on October 25, 1974. The staff, in their memo of November 21, 1974, recommended this 2 -lot tentative subdivision be approved, subject to the conditions listed in the "Check List", and the Commission reaffirm the nega- tive declaration filed with the original 4 -lot tentative subdivision map. There were no comments from the audience either in favor or against the tentative 2 -lot subdivision for the Lands of Chesarek. Following discussion, motion was made Ly Commissioner PERKINS, se,:onded by Commissioner YOUNG, the Commission approve the tentative 2 -lot subdivision for the Lands of Chesarek, subject to the conditions listed in the "Check List", dated November 21, 1974, and reaffirm the negative declaration on this subdivision, as filed with the original 4 -lot subdivision. Planning Consultant Mader reviewed the background on the request for a 'on- ditional ':se 'ermit for the Adobe Creek Lodge, filed on November 11, 1974, including t!ia Use Permit Application, the Statement of Applicant, the Con- ditions of Approval of Application Which Are Acceptable to [pnlicant, and the Draft EIR. Report. All of these items have been forwarded to various agencies, including the Tovm Environmental Design Committee, the Traffic and Public Safety Committee and the Pathway Committee, with the request that comments be submitted to the Town no later than December 4, 1974. The Gen- eral Plan states this land is suitable for recreational uses. Mr. Jack Robertson, attorney for Mr. Bellucci, spoke on the application for the Conditional Use Permit, stating the recreational club would be incor- porated into a non-profit recreational club, so as to conform to the Town's requirement prohibiting commercial businesses within the Totun after January 25, 1976. Points oar raised included clarification on tennis courts, parking, membership, traffic, paths, and the non-profit status of the recreational club. Speaking from the audience were Mr. David Profit, concerning the traffic and noise generated by the facilities, and Mr. Steven McReynolds, concerning the traffic and the possibility of the residences in the area near the Club fil- ing a suit against the Town if the Conditional Use Perrit is granted as re- quested. Since then, there have been several meetings with '1r. ()wen and his repre- sentatives, concerning the fact that not all pertinent info:rnatien had been submitted to the Commission and the Council, and it was agreed a second hearirg would be held. The staff, in their memo of November 20, 1974, cgain recommended this proposed subdivision not be exempted from the subdivision moratorium. Mr. Roy Marshall, of Powell and Associates, representing fir. fAven, snake on the history of the subdivision, including the geologic report, the grading necessary for development of the land, and the money and time that had al- ready been spent on developing this tentative subdivision. City Enqineer Russell reviewed the report by the Town Geologist concerning theland and the conditions for granting tentative approval for the subdi- vision. Assistant Planning Consultant Vlasic reviewed the history on the subdivision and the steps the Town requires prior to the staff recommending approval of the tentative subdivision to the Planninq Commission. During the lengthly discussion which followed, Assistant Planning Consultant Vlasic related his phone conversation with the City Attorney on what the requirements were for exempting a tentative subdivision from the subdivi- sion moratorium. Bi c ann, Flanager of the Durissima Hills County Water District Of- fice, reviewed briefly the history of the proposed 3 -million rallmeiat:-rtan'< including possible sites and interaction between his office and the Toon staff. A short discussion followed, in which Commissioner Perkins suggested members of the Planning Commission and the Yater District Board should attend each other's meetings for better communication. MR Chairman Spencer stated the City Council has not acted on the Commission s request for response to the Open Space Program yet, and recommended the Com- mission wait for council action be' m ;•roceeding.
