RESOLUTION NO. 103-96
A RESOLUTION OF THE TOWN OF LOS ALTOS HILLS
ACCEPTING SUBDIVISION IMPROVEMENTS RELATED TO
THE DEER CREEK SUBDIVISION OF LANDS OF LINDY PROPERTIES
WHEREAS, the City Council of the Town of Los Altos Hills approved a parcel
map for lands of Lindy Properties on May 15, 1996, which parcel map was recorded at
Book 679 of Maps,pages 46 and 47, in the Official Records of Santa Clara County; and
WHEREAS, pursuant to approval of the Map, the Town and Lindy Properties,
("Owner") entered into a Subdivision Improvement Agreement whereby the Owner
agreed to construct certain improvements; and
WHEREAS, .the City Engineer has inspected and found substantially complete
the improvements constructed pursuant to the Subdivision Improvement Agreement;
NOW THEREFORE, the City Council of the Town of Los Altos Hills does
RESOLVE as follows:
SECTION 1. The improvements described in the Subdivision Improvement
Agreement entered into between the Town and the Owner are hereby accepted as
substantially complete.
SECTION 2. The City Manager is hereby authorized to release 90% of Owner's
surety upon completion of the improvements to the satisfaction of the City Engineer. The
remaining 10% of Owner's surety may be released after the 2 year warranty period upon
the approval of the City Engineer.
Passed and adopted this 4th day of December, 1996.
