Vice -Chairman Caxico called the meeting of the Planning CCMMssion to order at
7:45 P.M. in the Council Chambers of Town Hall.
ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Commissioners Carico, Perkins, Ryden, Stewart, Yang and Schick.
Chairman Hahn was absent.
After the Pledge of Allegiance, Vice -Chairman Carico read a letter from Commissioner
Hahn asking the City Council to extend his leave of absence until February first.
She noted that this request was granted at the City Council meeting of January 5, 1977.

CCNSENT CALENDAR:
It was moved by Commissioner Schick and seconded by Commissioner Stewart to approve
the items on the Consent Calender for January 12, namely the following:

1. RANCHO DE LOS CAAALLOS, File #CU 8018-76, Arastradero Roil, Randlett, Clegg a
Foulk, Engineer, Reguest for Becammendation of Approval of Conditional Use
Permit Application.
City Planner/ Engineer John Markl noted that the subject application was for a
property faimerly known as Cook's Quarterhorse Ranch. He referred the Commissioners
to his Staff report of January 7 which contains extensive background information on
the subject property.

It was noted by City Manager Crowe that the use permit before the Cmydssion covered
fourteen acres out of a total of sixty-six or so acres, and that Messrs. English and
Galeotti were no longer applicants. He also noted that the previous use permit had
been for the total of the 66 acres, but that a subdivision is pending on the rest
of the properly, and that both the nmrber of horses and the acreage had been reduced
fran the previous use permit.
Discussion continued among Planning Comdasioners with Vice -Chairman [arico noting
that she could not reconcile the number of structures shown on the map with what
she saw when she visited the property. She also noted the poor condition of sone
of the horse stalls, stating that these inferior structures should be removed.
Town Engineer Russell stated that there nay be some discrepancy between what was
sham on the m ep and what actually existed an the property. He called the attention
of the Commission to the great need for cleaning up the premises of the subject use
permit, stating that they should add a condition to the List of Conditions that
the premises should, within a period of two montlEafter the application appeared
before the Planning Commission, be cleaned up to the satisfaction of someone designa-
ted to be responsible for inspection.
Comtissio ar Stewart expressed concern over unsound structures and the danger of
horses breaking through them and wandering out on Page Mill Road. Commissioner
Schick, also speaking to the safety issue, asked what parking facilities would be
made available. She expressed concern over the possibility of fire and having only
one way to get in and out of the property.
The hearing was opened to the public.
Edward Armes, Owner and Applicant, stated his eurbarrassment at awning the subject
property in its present condition. He noted his intentions to clean it up and qp
grade it, but also pleaded for time in which to do it in, noting the press of
finances that would be needed to to the jcb. He noted he was trying his best to
get rid of the present tenant. He noted that Messrs. English and Galleotti world
be the future owners and operators of the horse facility.
Cammissioners continued the discussion with Commissioner Carico telling Mr. Armes
that a new use permit would have to be applied for when Messrs. Galleotti and English
became the new owners, and Commissioner Stewart questioning Mr. Aures' request for
not too demanding conditions an his use permit. He (Cormissic er Stewart) stated
that as the property exists, he could not consent to a use permit. He asked Mr. Ames
to spell out what he would do as the present owner until the prospective purchaser
could take over.
Mr. Crme stated that Mr. Armes was asking for a use permit naw in order to continue
an existing horse facility. He stated that if the operation would have to close
dawn, it would make starting up again prohibitive. Noting that a subdivision was
pending on surrounding property, he stated that the owner would have no choice if
the horse facility closed but to subdivide the property. He noted that the biggest
advantage to obtaining a use permit new was to continue the horse operation and start
clearing the place up.

Comdssioner Perkins questioned the status of the present use permit and whether
it had been issued to the owner of the land or the occupant Mrs. Code. It was
determined that the use permit had been issued to the occupant Mrs. Cook, but that
the permit was invalidated when Page Mill, Inc. sold the land to Mr. Armes, the
present owner.
Jahn Clegq, Engineer for the Applicant, noted that he had made the original nap
UT 19 , and that re was asuce y no significant change in the map with the
exception of an additional barn and some new stalls near the ring. This was why
the title block on the map had not been changed, he noted.
Ernest Galleotti, potential purchaser of the property, stated that he was willing
to amp y wim all conditions made, but noted that since it was the rainy season,
they would need some time to amply with conditions. He noted that he was eager
to upgrade the property.
Mr. Ames, Owner, stated in reply to Engineer Russell's question of when he would
have access to?he property, that he was restrained by a court order from visiting
his property. He was expecting to go to court on trial next week, and that he hoped
to gain access at that titre. He expressed the need for a a master plan that would
t have to be made after he gained access to his property.
Mien Commissioner Carico expressed concern over the animals on the facility, it
was stated by Mr. Crae that the use permit could be granted to Mr. Armes with
the requirement that the facility be cleaned up within a reasonable amount of time,
say thirty days or so. There were, in addition, serosal measures discussed on
ways to terminate the occupancy of Mrs. Cook whose use permit had already been
terminated with the sale of the property.
Mr. Ames, Owner, when Commissioner Carico asked him what his plans were to remove
ss Stan TIMI dings, stated that he had difficulty getting information right now
when he could not even get on his property but expressed again his intentions to
improve the appearance of the property. when Ca:missioner Young asked what qual-
ifications he bad for operating a horse facility, stated that he himself had none]
but that his associates had had extensive experience with various ranching operations
and stables in Colorado and southern California.
Discussion among Coamissioners continued, and the following motions were passed
on various issues on the use permit:
HVICN SECQdDED AND CARRIED: It was moved by Canmissicner StEwart and seconded by
Commissioner Yang that Condition 18 should read: Manure shall be removed frau the
premises at least twice a week.
Motion passed with the unanimous vote of the Camuissionere.
MYITCN SECCUEED PND CARF=: It was moved by Commissiaher Perkins arrlseccnded by
o muissiener Young that Condition 19 be as follows: Within 30 calendar days of
legal access by the owner, there shall be a general cleanup of the subject property.

to the Planning Camdssicners.

Commissioner Schick asked hos the conditions just passed would be enforced, and
Ccmnissianer Carico noted that the Town will be able to review the compliance with
conditions at the annual review. The City manager also stated that he would be
the enforcer of conditions imposed, and that he would require an up-to-date map
cataloguing all of the buildings on the property.
Commissioner Carico voiced several concerns, among them the limitation of five
horse shows per year that was imposed as a condition and the ensuing need for limit-
ing the number of people on the premises, particularly if the surrounding area was
subdivided.

Commissioner Schick to continue this use permit until they obtained an up-to-
date, current nap and a better business plan - not a detailed schedule of iMrove-
menta, but better information than they had before them.

Coumissianer Rydell that this item, Rancho de Los Caballos be continued until the
meeting of January 26 in order to get further information from the applicant.

Atter the vote for oohtinuance, Engineer Russell asked the Cantdssicmrs to enumerate
the additional information they wanted. It was requested that all the structures
an the premises be shown on the map, and if the structures are different than the
present scale of the map, this should be noted. Commissioner Carico requested the
number of structures to be enumerated, and the number of people estimated that
should be allowed an the property for horse shows. Caemissicner Schick inquired
about what parking facilities would be provided, and what structures would be dis-
mantled and what would stay, the number of people that would be allowed on the facility,
and how the public address system would be used.
O mmissicner Young reiterated that the applicant could not get on his property, and
that requests being made were unreasonable.

Mr. Acres, Applicant voiced his cbjectim to continuing the matter to January 26,

Cmmdssicner Carico closed the public hearing and stated that she felt there was
not enough informatiau to make a good decision on the use permit. She recessed the
meeting at 9:17, and re -convened it again at 9:33 P.M..
After the recess, Commissioner Carico stated that the City Manager had suggested
granting a temporary use permit. CwTissioner Stewart stated he felt the Cmmissicn
had a valid basis for issuing a temlwrary permit and moved to have the permit granted
on that basis.

CcmTd-ssioner Young that the use permit for Rancho De Los Caballos be re -considered.
Motion died by the follcwing vote:

ABSTAIN: None
Ccmm.ssiener Stewart stated his concern over the use permit held by the Cooks, the
fact of existing violations, and the fact that the Town is maintaining a laisse faire
attitude. He objected to postponing the granting of a use permit to a valid property
carer, he stated.
2. LANDS OF BAHL, File #TSS 2041-76, Page Mill Road and Three Forks Lane, George Nolte
& Assoaates, Engineer, Request for Rec=mndaticn of Approval of Tentative Map.
Than Planner/Engineer John Markl reviewed pertinent information on the subject
request, noting the name change on the property from lands of Bahl to Country way
Subdivision. He stated that the property had been before the Comnission in 1974
and had been denied by the City Council in early 1975. He noted that the Council
cbjection to the subdivision had been that they did not wish to repeat a cut and
fill operation like that that had taken place on a bordering property. He briefed
the C=issien on neighboring properties and delineated the various road accessess
proposed for the property. For mare concrete information on background and conditions
he referred the Cammissim to his Staff report of January 7, 1977.
Discussion began with Oamdssicner Perkins asking how the present proposal differed
frau previous ones. Mr. Russell stated that he did not wish to make a mparisons with
past actions, but did state that grading proposals were different and that the new
subdivision was in corplianee with Ordinance 232.
Commissioner Carico asked Mr. Russell to point out the forty foot easement mentioned
in Cmdition 15. Commissioner Young painted out that the property contained two
water courses, and Mr. Russell pointed out that one ran along the Jenkins property
`, and the other along Page Mill Road. Cmr ssioner Carico asked about the pathway
easements, and Engineer Russell delineated the various connecting pathways frau
the Koo Subdivision to Black Mountain and Altamont Roads. Commissioner Perkins
questioned the numbering in Cmditicns 19 and 23.

Don Bah]., Oaner and Applicant, stated he was not asking for exceptions or variances,

questioned the requirement of a conservation easerrent but concurred with all other
conditions inpcsed.
Mr. Cottrell, Korth Fork Lane asked that it be re -affirmed that the camti

Town Engineer Russell stated that the easement will be put in the nacre of the Town
to be released when sareme there is ready to develop. He emphasized that the
easetent would be contained in an offerofdedication to the Town. It was not
a gift.
Michael Riranoff, South Fork Lane, rusted the difficulty of the position of the entry
:E s vrsron, s tingthat it would be difficult no matter where it was placed.
He stated that he must go in to Three Forks Lane 3 or 4 times a day, and that the
entry as it is now is a problem with visibility. He asked if there would
be two intersections placed close together.
Camiissimer young, in discussion on this asked about the possibility of the
Three Forks intersection being abandoned, noting that it would be to the advantage
of Twee Forks residents to have another intersection inproved.
Ca[missioner Carioo closed the public hearing.
various issues were discussed, with Camdssicner Perkins noting the need to cau-
sider the total traffic pattern of the area under consideration, keeping in
nand future development. Did the Toon wish to provide "throughness", or was it
their desire to keep the area in restricted access. He stated his preference
for isolation, and noted it was unfair to burden the applicant with the problem
of potential connection to the property caned by the Palo Alto School District.
Engineer Russell pointed out that it was up to the Camu.ssion where a potential
connection would be made, pointing out that if the connection were ma& between
lots 5 and 6, then the lower one between Lots 2 and 3 would be unnecessary.
He noted only one access was necessary to the potential thirty-three lot subdivision,
but that the Cmmii.ssion may desire Wore. Camiissicner Carico pointed up the need
for a second access for safety reasons.
Camuissiauer Schick stated that she agreed with Cmuissioner Perkins' desire for
isolation, and stated it was difficult to know what future subdivision would be like.
Camiissioner Perkins also noted his concern with the problem of controlling vehicular
{, access in a hitherto inaccessible area where the proposed paths would be.
` Mrs. Fiksdal, Pathway �ndttee Chairwoman, noted that she preferred a natural
path nor the pa�uhway anu agzecv with cra ssimer Perkins in his concern for vehicles
on the path. She also noted the need for concern for erosion when constructing the
path.

Camdssianer Schick to anend Condition 4 to read as follows:
Within the twenty (20') foot easafent along the easterly side of the subject
parcel, fron Page Mill Road to the northerly Line of the Koo Subdivision
(Tract $5762), construct a ten foot (10') wide Type lA oonbination graded
pathway and energency access roadway, together with turn-arounds as recamen-
ded by the Fire Marshall, at distances not less than every five hundred (500')
on the path.
Motion passed by unanimous consent.
M7TLON SES AND CARRIED: It was moved by Comnissioner Perkins and seconded by
Ctmnissicner Carico to amend Condition 6 by deleting "according to Santa Clara
Valley Water District".
Motion passed with unanimous oansent.
NDTIIN SECONDED AND CARRIED AND UNANIM)USLF PASSED: It was moved by Camiissicmr
Schick and seconded by Camuissianer Carico to extend the meeting until finished
with all the conditions on Lands of Bahl.
PADm Bahl, Applicant stated that he ebjected to the requirement on Condition 13
provide 1-.i�foot right-of-way. He stated he did not like giving lad
away he could use for the lots of his subdivision.

by Camdssicner Schick to mwO Cmditim 13 to read: A fifty foot (50') dedication
shall be required on Country Way up to the center line of the cross canection between
lots 2 and 3 on Country Way, and from there on, forty feet (40') .

MMCN SEOINDED AND CARRIED: It was moved by Cuumissioner Carico and seconded by
Cannissioner Stewart to add the following to Condition 16: The curb and gutter
return shall extend into the easement through the radius.
Motion passed with aye votes fran all Commissioners with the exception of Connission-
tal Schick who voted against the notion.
Before the vote on the above motion, various ways of indicating the future connection
of Country Way and the western boundary were discussed, aanq them the rough grading
of the roadway and seeding it.

Commissioner Schick be amend Condition 18 by adding the following: 'if the pathway
cannot be accamodated within the existing right-of-way on Page Mill Road.'

Don Bahl, Applicant, stated his objection to the taking of a conservation easement.

Michael Kiranoff, Three Forks lane spoke in reference to Condition 20 that he

improvements on Page Mill Road and pay a road -in -lieu fee too.

O mndssiaher Carico, in reference to the Tonin Planner/Engineer's mann recommended
that Commissioners turn in their recommendations of changes on Ordinance 232. She
also stated that review of outstanding conditional use permit would occur as som
as the agenda would allow it.

Commissioner Carieo noted that concern had been express on the leadership of the
Planning Cammissim in light of the long absence of the Chairman, Comnissioner Hahn.
Commissioner Schick stated that she commended Commissioner Carim for her leadership
during this time.

Commissioner Young to elect a Chairman at the next meeting of the Planning Cammissim
to fill the unexpired term of Chairman Hahn.

NCES: Commissioner Schick
ABSTAIN: Commissioner Carico stated that she would abstain because she wanted to
talk with Commissioner Hahn, but that she was for the election of a new
Chairman.
Cmvf&ssicner Stewart noted that he wanted Mr. Russell to get Portola Valley and
Woodside ordinances on outbuildings in order to compose an effective ordinance
for the Town. Commissioner Young noted the increase in staff that would be needed
to make such an ordinance workable.
Commissioner Young raised the issue of making the Chairmanship of the Variance and
Permit Commission automatic, depending on seniority, noting that the Planning CmrAssion
should take action on this. It was determined that the October minutes were to be
checked to see if any action on this was actually taken.
