Chairman Hahn called the meeting of the Planning Commission to order at 8:16 P.M. in the Council Chambers of Town Hall. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Commissioners Perkins, Rydell, Stewart, Young,Schick, Chairman Hahn. Absent: Vice -Chairman Carico because of a death in the family. Also Present: Town Engineer Alexander Russell, Town Planner/Engineer John Markl, Secretary Ethel Hopkins CONSENT CALENDAR: Commissioner Young asked that the Minutes of January 12 be removed from the `, Consent Calendar. He asked that the following corrections be made: 1. Add to the items approved on the Consent Calender of the January 12 Minutes: 5. Acceptance of Tentative Map Application, LANDS OF BAARDSNES, File #TM 2045-76, Fremont and Manuella Road, McKay and Somps, Engineers. 2. Also insert Commissioner Carico's name in place of "Commissioner Young" in the sentence under "Adjournment" on page nine. Commissioner Perkins asked that his name be inserted in place of "Commissioner Schick" as the Commission member abstaining because of absence on the approval of the Decem- ber 8th Minutes. MOTION SECONDED AND CARRIED: It was moved by Commissioner Young and seconded by Commissioner Perkins to approve the Minutes of January 12, 1977 as amended. AYES: Commissioners Perkins, Rydell, Stewart, Young, Schick. NOES: None ABSTAIN: Chairman Hahn. MOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Schick, seconded by Commissioner Stewart, and passed unanimously to approve the remaining items on the Consent Calendar, namely the following: `r 2. Acceptance of Tentative Map Application, LANDS OF SISSON, File #TM 2051-76, West Fremont Road, Dexter Ahlgren, Engineer. 3. MINUTES OF THE PLANNING COMMISSION - January 26, 1977 Page Two ELECTION OF CHAIRMAN OF THE PLANNING COMMISSION: Chairman Hahn addressed the Commission concerning his absence from the Chairmanship from the end of September until the present meeting. He noted that it was the right of the Planning Commissioners to elect a new Chairman if they wished to do so. MOTION SECONDED AND CARRIED: It was moved by Commissioner Stewart and seconded by Commissioner Rydell to dispense with the election of a new Chairman of the Planning Commission. AYES: Commissioners Perkins, Rydell, Stewart, Schick, Hahn NOES None ABSTAIN: Commissioner Young PUBLIC HEARINGS: 1. Public Hearing on Outdoor Li htin to "Amend Subsection (f) of Section 9-5.702 o Chapter o Title o t e os os sMunicipal Co e. Discussion began with various Commissioners noting the need to eliminate light pollution while maintaining proper lighting for reasons of safety. The Town Engineer, Mr. Russell, reviewed the history of the request in response to Chairman Hahn's question on how the present ordinance proposal came about. Mr. Russell t noted that a request for the glareless lighting of a tennis court was turned down first by the building inspector and then by the City Council. The Council then asked the Planning Commission to determine an adequate policy on exterior lighting. The proposed ordinance was the result of this request. After conclusion of discussion among Commissioners, Chairman Hahn opened the hearing to the public. Diana Miller Vista del Valle Court called the attention of the Commission to the neer t e own to a e e energy crisis seriously by turning off lights on tennis courts and basketball courts. Jitze Couerous 13680 Pa a Mill Road noted that the two issues at stake with the propose g t ng or finance were safety and recreation. He noted that he experienced the problem of light pollution, living near lighted tennis courts. Chairman Hahn closed the public hearing, and discussion continuedreulminating in a motion to defer taking action on the ordinance until further clarification was completed. The following were areas discussed as needing clarification: 1. Commissioner Perkins requested that the intent of the ordinance be clarified and suggested adding a statement to the ordinance to include all exterior lights. 2. Commissioner Schick noted the need to exclude lights for safety purposes. 3. Safety lighting should be defined and clarified. 4. Background information was requested by Chairman Hahn, and further definition of exterior or outdoor lighting. 5. Control of recreational lighting, also the situation of lighting of the Foothill College campus and parking lots. 6. Commissioner Young also suggested examining the policy toward occasional street lighting on streets such as DeBell Drive which are not public, but which are lighted for residents for the purposes of safety by PG&E. Public Hearing on Outdoor Lighting: (continued) MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins and seconded by Commissioner Young that the Planning Commission defer action on the proposed ordinance until the issues enumerated for clarification were defined by Staff. Motion passed by the unanimous consent of the Commissioners. 2.RANCHO DE LOS CABALLOS File HCU 8018-76, Arastradero Road, Randlett, Clegg, Fou , ng veers, Request or Recommendation of Approval of Conditional Use Permit Application - Continued from January 12. Town Engineer Russell addressed the Commission with the suggestion that the Planning Commission grant a temporary permit for the subject property so that it may continue as a commercial stable when the court decides that Mr. Armes may take up ownership and occupancy of his property. He noted that at present the stable is operating without a use permit. There was some discussion among Commissioners over whether a use permit could be granted when all the information requested was not completed. Commissioner E Young reminded the Commissioners that the subject property was before the Commission �r for the purposes of a public hearing. His questioning elicited the information from Mr. Russell that the use permit goes with the ownership of the land, and as an owner Mr. Armes is requesting this permit. The present null permit had been issued to Mrs. Cook, but she never had been the owner of the land where the horse stabling operation exists. Discussion concluded with Chairman Hahn opening the hearing to the public. Ed Armes A plicant and Owner reiterated his desire to improve the subject property. He emphasized his desire to cooperate with the Town to improve the property. He chastised the Townfor be- ing highly technical at present but for allowing an "outrage" to exist for sixteen years. He reminded the Commission that the present request was only for a temporary permit. Mrs. Diana Miller 73076 Vista Del Valle spoke for the granting of the use permit, not ng t e nee or eeprng a horse operation going when the alternative is sub- division of the property. Kathy Rose, Horse -Boarder at Cook's Ranch wanted to know what would be done with the horses at the facility if the use permit were not granted. Chairman Hahn closed the public hearing, and Commissioner Perkins summed up the discussion with the statement that traditional procedures were being applied to a situation that was not traditional. He noted that from a legal standpoint, the owner knows what he wants to do but needs a use permit.to go ahead. MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins and seconded by Commissioner Young to recommend granting of a Temporary Conditional Use Permit for RANCHO DE LOS CABALLOS, File #CUB018-76, for a period of ninety days from the date of approval by the City Council and to include Conditions 1 through 17 as recommended by Staff; to omit Condition 18 (passed by motion at the meeting of January 12); to include Condition 19 (passed by motion at the meeting of January 12), but to amend it to say "Within 60 days of legal access by the owner, there shall be a general cleanup of the property."; and to omit Condition 20 (passed by motion at the meeting of January 12). The Use Permit is also to include Phase One of the Master Plan submitted by Mr. Armes to be used as a basis r for development of the final Use Permit. LANDS OF McFADDEN File TM 2047-76, Vinedo Lane, Paul Nowack, Engineer, Request for ecommen an on o pprova ot lentative Map. Town Planner/Engineer John Markl reviewed pertinent information on the subject pro- perty, referring to his staff report dated January 21. He recommended that the Commissioners take action to change "California Water Service Company" to Purissima Hills Water Company on Page 3, Condition 3. He recommended deleting Condition 6 be- cause it was an unnecessary condition that would confuse the issue rather than promote action. Discussion began with Commissioners Schick and Perkins noting that a conditional exception should be requested to Ordinance #232, Section 9-4.712 because of the number of homes on Vinedo Lane being in excess of what the Ordinance required. Commissioner Perkins also called attention to the power line cutting across Parcel of the property. Chairman Hahn raisedtheissue of the panhandle on the lot, and Town Engineer Russell noted it was the result of two larger subdivisions some years ago. He noted that it would be offered to the Town, and he was recommendinoit be rejected. It would then stay in a limbo until the Town decided at some future date to pick it up. Chairman Hahn opened the hearing to the public. �, Larr Giller, Vinedo Lane spoke against dedicating the portion of the McFadden pan - an a ors ree <e ica ion. LANDS OF McFADDEN, File NTM 2047-76: (continued) Oliver Whitb 2"" Vinedo Lane spoke against requesting the dedication for the wr ening o me o ane. a noted that the widening would cause problems with driveways that are blind driveways, with speeders and with sightseers who had no place to turn around. He recommended wholesale dedication of the road rather than piecemeal dedication. Commissioner Perkins at this point noted that the dedication was not changing the road in any way; it was only pointing to the time when the community needs to make some kind of change in the future. Mr. Ber Vinedo Lane spoke against widening of Vinedo Lane; and noted that it sou e wl�� i en�e f at all, in a wholesale way rather than in a piecemeal way. Chairman Hahn closed the public hearing and continued the discussion by noting that concern had been expressed on a proposed street dedication and on the requirements for easements for sewer service (Conditions 5(c) and 6). Jan McFadden Ap lic�ant addressed the Commission with the information that they were working w th�Tie Snyggs to purchase sewer easements across their property to serve the McFadden property. 4W MOTION SECONDED AND DIES: It was moved by Commissioner Schick and seconded by Commissioner Perkins to delete Condition 5(c), the proposed street dedication, from the List of Conditions for the Lands of McFadden. AYES: Commissioners Perkins, Schick, Hahn NOES: Commissioners Rydell, Stewart, Young ABSTAIN: None MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins and seconded by Commissioner Schick to add as a condition to Lands of McFadden the following: The Planning Commission recommends a conditional exception to the limitation imposed by Section 9-4.712 of Ordinance #232 for the Lands of McFadden. Motion passed with all Commissioners present voting for the motion. MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins and seconded by Commissioner Schick to add as a condition to Lands of McFadden: The power line traversing Parcel A shall be re-routed in accordance with the Town Engineer's requirements. All present voted for the approval of this motion. MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins and seconded by Commissioner Schick that Lands of McFadden File NTM2047-76, be recommended to Council for approval with conditions as recommended and changed by Staff (Purissima Hills Water Company, page 3. MOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Schick, seconded by Commissioner Young, and passed unanimously to continue the meeting until 12:00 P.M.. Town Planner/Engineer Markl discussed pertinent information on Wild Barley Hill, referring to his staff report dated January 21, 1977. He noted several corrections to his report, stating that Barley Road would be a local road rather than a "collector road" referred to on page two of his report because it would be fifty feet wide with the pathway dedication and could therefore be designated as a local road. He also noted that in his staff report list of conditions, he had mentioned "tentative rap" when he had meant the final map. He stated that the discovery of a fault line running through the property had necessitated the redesigned map that the Commissioners had before them. Town Engineer Russell added the information that on the matter of widening Barley Road to the necessary fifty feet, the matter of gaining the extra fifty feet where the road runs through the Yaeger and Powell properties to connect to Hilltop could be accomplished by a simple lot line change made possibly by new legislation on lot [L line changes. There was discussion among Commissioners on the overall network of roads that would serve the present subdivision and lands yet to be developed such as Lands of Claussen. Mr. Russell noted that the Fire Department had thought Barley Hill Road too long, noting that in their letter of November 3, they had stated the following: "l. The total length of the cul-de-sac 4000 feet + or - (starting at the intersection of Hilltop and Hillview and extending to the end of the proposed street) far exceeds Town and Fire Department standards." He noted he could not subscribe to that consideration, and when Mr. Farwell had called the office to complain that he was upset because this was going to be permitted, he stated that a Fire Department member would not appear before the Planning Commission but would appear before the City Council when this was agendaed. Mr. Russell wanted it emphasized that the Fire Department had been asked to send a representative to the Planning Commission meeting. There was considerable discussion on the rationale for the pathway requests and clarification on which document supported the pathway requests, the original pathway request on the Staff report or the second list of pathway conditions submitted by the Pathway Committee. Mr. Markl noted that new maps had been sub- mitted that rerouted the road through the subdivision because of the fault discovery on the property. The second list of pathway conditions were submitted for the new map. Mrs. Bets Fiksdal and Mrs. Gottlieb Pathwa Committee Members discussed at some engt a ra lona a or a pa way reques s, no ing a t e changes in their request came about because of the new map, the re-routing of the road, and the change in lot numbering. Commissioner Perkins questioned the accuracy of slope density calculations, and shortly thereafter Chairman Hahn opened the hearing to the public. LANDS OF WILD BARLEY HILL, File #TM 2046-76:(continued) Ing by Mrs. Schick because Mr. Lambert had not seen the new pathway requirements from the Pathway Committee. He addressed the question of Mr. Farwell's request for a fire road over Mrs. Voorhees' land. She would be against it. He noted that the problem of fire access to the area was an historic problem and Hilltop Road as it exists would probably not be approved under present standards. He noted that his entire subdivision could be designed without a through road. Mrs. Schick noted that Staff has not requested an easement for fire access and went on to catalog Mr. Lambert's views on the path requests. There were as follows: Item 1. Mr. Lambert noted that horses should be restricted from the paw, andif they cannot be restricted, wanted that the pathway should be deleted. He also requested that he not be requested to construct the path. He would grant the easement, however. Item 2. Mr. Lambert stated he would agree to granting the easement, but not to constructing the path, Type IA. He did not see how one could L construct driveways over a 1A path. 4r Item 3. No objection to this request, but no horses to be allowed. Item 4. He objected to this entirely, noting that he did not think the Town would ever get a path to connect to the Voorhees property. He re- quested that the path be abandonable once Barley Hill Road goes through. Mrs. Fiksdal Pathway Committee noted there was a need for providing a pedestrian an equestrian path along The Treeway, that she agreed on the path connection on Lots 7 and 8 (Item 4), and that lA paths needed some kind of delineation or they would simply become a weed path. Commissioner Perkins noted that the time allotted for discussion had ended and asked if Wild Barley Hill Subdivision could be continued. Mr. Lambert agreed to having Wild Barley Hill continued with the promise that it would belie T1rst thing on the agenda for February 9th. OLD BUSINESS: Chairman Hahn noted that inputs from Ordinance 232 - Recommended Changes - had been received and would be turned over to Staff for consideration and their recommendations. ADJOURNMENT: MOTION SECONDED. AND UNANIMOUSLY PASSED: It was moved by Commissioner Perkins, seconded by Chairman Hahn, and passed unanimously that the meeting adjourn.
