MINUTES OF A REGULAR MEETING
Wednesday, February 9, 1977

Chairman Hahn called the nesting of the Planning Cmutission to order at 7:38 P.M.
in the Council Chanbers of Town Hall.
ROLL CALL AND PIEDGE OF ALLEGIANCE:
Present: Comtissiaters Carico, Perkins, Rydell, Stewart, Young, Schick, Chair-
man Hahn
Also Present: Tom Engineer Alexander Russell, Town Planner/Engineer John Markl,
Secretary Ethel Hopkins. City Manager Imbert Crowe was available
for cements, but worked in his office.
OCKSENT CALENDAR-
Both itsms were removed from the Consent Calendar for separate consideration.
Comtissianer Schick stated that she wished added to the minutes of January 26,
on page three, fourth paragraph, the statement: Mrs. Schick, however, stated
that the main reason she was against granting a conditional use permit was because
she felt it was a selective enforcement of the Town ordinances.
MJIICN SECCIIOED AND CARRIED: It was moved by Cmnissioner Perkins and seconded
by CmTdssianer Schick to approve the minutes of January 26, 1977 as mmnded by
the Planning Ccmr&ssion.
All camissioners present voted for approval of the Minutes with the exception of
Comhissioner Carico who abstained because she had been absent fen the meeting of
January 26.
WTICN SEWNIED AND CARRIED: It was moved by Courd.ssioner Young and seconded by
Co missianer Perkins to m the Acceptance of the Tentative Map for LANDS OF
H[R'CH1NS, File #TM 2053-77, to the end of New Business so that Staff might have
time to check the map's ccnpliance to subdivision map requirements.
The motion passed by unanimus consent.
PUBLIC HEARINGS:
1. InES OF WILD BARLEY HILL File #1M 2046-76, Hilltop Drive, Sandis & Associates,
Nigineers, Request for Iecamendatron or Approval of Tentative Map. (Continued
from January 26th Planning Commission Meeting)
L Town Planner stated that the Planning Caimissiat had five new iters to consider
on the current subdivision application. They were: 1) slope density calculations,

2) a revised Tentative Map showing easenents and other information, 3) an area plan,
4) geological i.nfonmticn for the site for the area of the Minta Vista fault, and
5) a newrandun £ranthe Town Geologist, Mr. Cotton,which had just been received
and which he read to the Commissioners.
Discussion followed atmong Crnmissicnexs and Staff regarding pathway requests and
pathway conditions, the setbacks from the fault zone requested in Mr. Cotton's
mevorandmm, slope density requirement coupliance for lots with setbacks frau the
fault zones, and discussion on how the fault zone was actually located. Connassikn-
er Perkins wanted to know why Mr. Cotton's requests were not incorporated into the
list of conditions recomended by the staff, and Mr. Markl answered that they had
not been received in tine to incorporate them into the staff report.
Commissioner Stewart raised the issue of the various revisions on the Wild Barley
Hill map and the lack of proper notation of this so that Planning Commissioners
could distinguish one version of a map frau another.
Mr. Tim Sandis Sandis and Associates, Eng++n for the Applicant stated that
only constru man mks were ro�intr;Fa ERM revision date, no
responsibility was taken by his firm for day -today revisions on other maps.
kmv Comassioner Perkins stated that he wanted sone statement made that there would
be no encroactment on the setback area when the road right-of-way is constructed
on the Yeager property. Town Engineer Russell suggested that this was a valid
point and could be made me of the conditions on the tentative map approval.
Camassioner Steuart, however, wanted to know what would happen to the subdivisim
if the right-of-way for the road caused the setbacks to be less than required, and
Mr. Russell stated that in that case they would have a forty -foot right-of-way
that is Mr. Yeager's entrance at present. There was no additional way
to gain an entrance to the property.
ccwtissioner Young stated that the three hundred foot requirermt had not been ret
m the northerly end of the photographic rap, observing that the I.S. 280 off -
ramp was very close to the last property shown on the Barley Hill Subdivision
Map and this information was irporhant for the decision on the Barley Hill off -ram.
Mr. Russell replied that the State Highway Departnent could not be dictated to,
and there was nothing that could be done to redesign the freeway off -ramp.
ginmissimer Young, however, stated that the information was still needed on
the north end of the map in order to be able to visualize where Wild Barley Hill
Boad would end up.
Chainmen Hahn opened the n ting to the public.
Mrs. Saviano, 12620 Corte Madera Lane asked haw wide the faultbne was and was

Mrs. Gottlieb, 24290 Summerhill Avenue stated that when they bought their hone,
were told that H111tcp Drnve wo d probably never be widened. She also
crnplained that the road had been gerrymandered to have eighteen homes rather
than nine hones that had been requested from another subdivider sone time previously.

Commissioner Carico asked about a study of traffic patterns for the whole area,
including the I.S. 280 interchange. Mr. Creme said that a traffic study had been
done with George Nolte and Associates in anjmctian with the developrent
of the Cassara property, and that the scone study had been presented with the
current subdivision. He stated, however, that nothing had been proposed as far
as the State was conoamed, and it was unlikely that anthing would be done with
the off-ranp from I.S. 280. Mr. Russell stated that the proposed traffic flaw
onto Hilltop is still of a very law volare; Hilltop Drive will be able to carry it.
Alan IanUert,Developer noted that traffic impact had been discussed by Staff,
also mm sr i ty of noise, and that a noise study had been made. He camended
the staff for thoroughly covering all the issues at hand on this subdivision.
He discussed the issue of the right of way widening and its effect on meeting set-
back requizenents on the Yeager property. He urged the Cmmission to make some
decision a: whether the mad widening should be forty or fifty feet and what
setback limitations should be inposed. He also stated that the actual road right-
of-way is much wider that the mad going inside it.
Chairman Hahn closed the public hearing.
4W Discussion occurred again among Crnmissimers on the mad right-of-way, on whether
Wild Barley Hill should be a through mad or a cube -sac mad, and on the overall
develcp(ent of the area with Wild Barley Hill being one of the links in development.
At 9:23 a recess was called with the meeting resuming at 9:45 P.M..
filen the meeting resumed, there was further discussion on the pathway requirements.
Matters discussed were the possibility of eliminating horses if a path remained
open, path connections with other paths in the Town - particularly the Dawn Ridge
connections to paths, the width of easements for storm drainage on the northeasterly
om m line between Lots 10 and 11, and on whether it was good to have a native path
running over a private driveway.
Mrs. Fiksdal,Pathw Camdtbee Chairworen noted that no easerent existed on the
J property Bar ey I S vision, but that she hoped so neday to get
an easement. There was a traditional path being used, but that it was at the
sufference of the property owners who could cut it off at any tine.
Discission was concluded, and the following motions were passed on the application:
MYrICN SECQNLED AND CARE=: It was roved by Commissioner Stewart, seconded by
Canmissioner Carico, and passed unanimously to incorporate items 1C and ID frau
Mr. Cotton's letter dated February 9, 1977 and read to the Planning Camnission
by Mr. Markl. Mr. Cotton's rem was to be referenced at the bottm of Condition 1
as the source of the material.
MYlm sEOJNfED AND CARRIED: It was moved by Commissioner Perkins, seconded by
Commissioner Young, and passed unanimously to add as a condition the following:

?here shall be adequate richt-of-way provided an the entrance of Hilltop Drive
and, at the sane time, the setbacks on the Yeager property shall conform to
ordinance requirements.
C.anmissimers stated at this point that their recamendation to Council was that
this condition be net. It is up to the Council to determine if it was or was
not :ret and what to do about it.
MIPICN SECUMW AND CARRIED: It was moved by Camdssioner Young and seconded by
cmidssiorer Perkins that as Condition 9B and C, Items #5 and 2 from Pathway
Nemo of February 1 be added: Item #5: A ten foot easement for pedestrian use
only on southerly side of Lots 10 and 11 frau Wild Bazley iniad to boundary of
property on north side. Item#2: A ten foot easement for a native path on south-
easterly side of Lot #1, to provide access to equestrian path along freeway.
This easement will be abandoned when the correcting link is acquired on the
Lands of Lcw. Also, provide the reference at the bottom of the condition.
Notion passed with all Commissioners voting for the motion except for Commissioner
Schick who voted against it.
w MITICN SECONDED AND LWANIMDUSLY PASSED: It was moved by Commissioner Rydell,
seconded by Caumissiomer Schick and unanimously approved to reo=nend approval
of the Lands of Wild Barley Hill, File #TM1 2046-76 with conditions as amended
by the Planning Commission.
Mfr2(N SECONDED AND UNANIMOUSLY CARRIED: It was noved by O.mmissioner Schick,
seconded by Commissioner Hahn and passed unanimously to file a negative declaration
for the Lands of Wild Barley Hill, File #'1M 2046-76.
Cmid.ssioner Perkins stated that the subject property was the largest subdivision
the Camiission had dealt with and that the slope was barely in excess of the
7bwn's 128 require ent. He urged Commissioners to check as the subdivision develops
to see if it turns out to meet Town ^equiremnts.

Engineers, request for m tion of Approval of Tentative Map.
Mx. Markl reviewed pertinent information on the subject property, referring to
his staff report dated February 1, 1977. He called attention to the substantial
problem of drainage, noting that it affected the Lands of Stoddard, Hayward, Biolsi
Baardsness, and property across Fremont Iniad and substantial lands downstream.
Mr. Russell reviewed the proposal made in the 1975 Budget for alleviating the
drainage problem, noting that while it did not came to pass, the same condition
should be set forth on the development of the Baarlsnes subdivision, and stated
kw that he hoped a letter would come before the City Council asking then to re-enact
the project. Mr. Russell also noted that Mr. Stoddard, who was an adjoining sub-
divider,had been in on the discussion, and that all the properties named before
were linked together in development. At this point,Comnissioner Carico stated
that at the Subdivision Cmudttee meeting she had suggested the whole area as a
planning unit.

Commissioner Young expressed a desire that the street names on the proposed sub-
division be changed frau French names to something more suitable to the Spanish
names for streets on adjoining roads, and thereafter Chairman Hahn opened the
hearing to the public.
Bill Sb22dard 26405 Weston Road asked for discussion m the street layout,
ig- ss an egress to me subdivision, and the closing of the subdivision to
Fremont Road. When Commissioners Schick and Perkins inquired if he would be
willing to revise his tentative map, and noted that the Baardsnes Subdivision
did not make sense unless the mad developed into a joint road, Mr. Stoddard
stated that his only oonoem was that the cul-de-sac not go out on Fxanont Road.
He also stated he did not want to be involved with Mr. Biolsi.
CmFdssiomer Perkins called attention to the drainage problem again, noting that
Mr. C.C. Yin was willing to give up rights to the back of his property and was
positive about solving the problem, and that everyone involved with the problem,
including the Snells, was eager to see the problem solved.
Mr. Stoddard said that flooding had occurred on Manuella because of the way water
came�the bubble system, that re-design was needed to adequately remove
water, and that the creek had been filled in and was overgrown with weeds, leaving
no place for the water to go. He complained that he was being penali2ed and could
do nothing with his property until a decision had been readied on the water.
Hammon Brown, comer Altadena and Manuella urged going ahead with the 1969 plan
saz that me bubble Dox was a mess and was cleaned out by a nunber of the
area residents.

Paul Noaack,En 'neer noted the main reason the storm drain plan failed was that
e Ttwn was nota to get easements downstream where the storm drain would go.
He remarked that he had worked out another plan - not so good, but it would work;
but stated that the solution to the problem lies with the people downstream and
should not be a condition on the Baardmes and Stoddard properties. He stated
further that the very people who haw the problem have the means to solve it.
Henry Duke, corner of Manaella urged that the developer resolve his portion of
foe arM—r pro6i,an��at the Town go along with its part.
M=CN SECONDED AND CARRIED: It was moved by Courdssioner Schick and seconded
by 03mdssioner Perkins to extend the meeting to not later than 12:00 P.M..
MDtion passed with the approval of all Comdssioners, but Mrs. Carim who voted
against it.
Charles Reed, Developer introduced his Engineer, Mr. Dido Cecchi, to address the
issue.

Mr. Dick Cacahi En for McRay & Samps agreed with Mr. Nowack that the drainage
prU%n is i�b'iTity o e c7otmstream residents and the Tmm. He pro-
posed, on behalf of Osterlund Enterprises, to construct the twenty-seven inch pipe
from Eucaluptus north to Altadena and frau there to the bubbler. They would create
a new bubbler and the Town could clean up the water, but he noted that this solution
would solve the Eucalytus and Manuella situation. He stated that the cost would
be $25,000, and that he would ask the Commission to add a condition that 1)any
adjacent property owner (Stoddard, etc.) would pay a pro -rated share of the cost
and 2) that the City funds be made available to re-imburse Osterlund Enterprises
"if and when" completed.
Mr. Cecchi remarked further that they did not own the property yet, but wand
to proceed with the recordation of the map and with construction. He agreed to
change the street names to more appropriate ones.
Chairman Hahn commented on Mr. Cecchi's generous offer and noted past problems
with flooded homes and poor subdivision development in the area under discussion.
He then closed the public hearing.
Further discussion took place with Chairman Hahn stating that action should begin
as soon as passible on the matter of drainage. Several other commissioners questioned
if the extra line and new bubble box would solve the drainage problem. Mr.Russell
again said that he hoped the people involved would address the City Council to get
action started on the drainage situation.
The hour being near to 12:00 P.M., it was moved by Commissioner Carico, seconded
by Commissioner Young, and passed by unanimous consent to continue the meeting
until the problem of drainage on the lands of aaardsnes was settled.
Mr. Cecchi assured the Commissioners that what he and Osterlund Enterprises were
prtpocuug was a part of the original Nowack plan for the area.
Mr. Stoddard, in further commentary on the proposed drainage plan, noted that
some way ad have to be found to take care of water taming out of a bubbler
even if one bubbler were removed and that water dispensed over the present acreage
at the downstream level. 'thereafter discussion continued again on whether to
disperse water runoff or whether to lower the level of the bubble box. Mr. Russell
said that a second bubbler box would take care of some of the run-off, but that
in the expenditure of finds for the project, a twenty-year flood should be taken
into consideration. Mr. Nowaek's plan, for instance, was a ton Year plan which
was about maximum for storms.
Coffrssicner Schick asked for a letter to accompany the tentative nap approval
to the City Council to request the release of the funds for the project.
Mr. Nowack stated that everything Mr. Yin proposed was downstream from the naardsnac
iv property. He reminded the Ckmmissionere that they were considering two different
things: 1) Mat the subdividers of the IIaardsnes property were offering, and 2) what
the Town would do to take care of the drainage problem into Palo Alto.

Mr. Dick Cecchi asked the Candssioners to approve the Lands of Baardsnes be-
cause rti help their situation with respect to negotiating the sale of the
property; and Mr. Charles Reed assured the Commission they would make every
effort to reso ve rr —mcT-o-r the agreement and would also work things out
with surrounding property owners. Mr. Stoddard urged the Commission to act
because the satire problem would exist m t h�iue if no action was taken now.
Oammissiaher Perkins asked about internal drainage, and Mr. Russell stated that
this problem could be addressed at the time of site development.
O miissioner Carico noted that there was no recamendation on paths, and Mr. Markl
told her that the Tum had elected to take an in -lieu path fee instead.
Discussion was concluded, and the following motions passed on the subject proposal:
MOTICZ SES AND UQANIMDU4LY PASSED: It was moved by CcnTdssioner Perkins
and seconded by Camiissioner Young that there be no access for this subdivision
on Fremont or Manuella Roads except by the public roads. (Add as a condition.)
MRIIN SECONDED AND UNANDMISLY PASSED: It was moved -.by Ca!m' sinner Young and
4W seconded by Cmudssioner Rydell to add as a condition that the developer shall
change the name of the proposed streets to something more appropriate to
Los Altos Hills.
MYrIC4 SECYNDED AND CARRIED: It was moved by Cmmissioner Stewart and seoonded
by Camudssianer Carioo to add as a condition the following: That Mr. Dick Cecchi,
Mr. Paul Nowack, and Town staff shall work out for Council approval an economically
feasible solution to the drainage problem at Altadena and Manuella Avenue. Further,
the adjoining property owners shall be notified of meeting times for their input
and co ncurrenoe.
Motion passed with all Ca dssianers voting for it except Commissioner Schick who
voted against the motion.
M7TIC3 SECCNMD AND CARRIED: It was moved by Commissioner Carioo and seconded by
Ca:missia r Stewart to approve the Lands of Baardsnes, File #TM 2045-76 with
conditions as amended by the Planning Commission.
The motion passed with the concurrence of all the Planning Commissioners with
the exception of Condssioner Schick who voted against the motion. She stated
after the vote that she wanted the minutes to reflect that she voted against
approval because she was not convinced that the drainage problem had been solved.

and seconded by Caemissicner Carico that a negative declaration be filed for the

It was decided, after the loan Planner/Engineer checked the records, that the
tenetative map for the Lands of Hutchins, File 'IDM 2053-77, was not in cmpliance
with Ordinance 232 requirements. Therefore, it was dropped frau the Corsmt
Calendar.
