Chairman Hahn called the meetinq of the Planning Ccomi.ssion to order at 7:35 P.M.
in the Council Chambers of Tuan Hall.

Absent: None

Camdssioner Hahn acknwiedgei receipt of a letter of resignation from Cemnissioner
Rydell. The Chairman expressed regret at Mr. Rydell's leavinq the Commission, but
he wished him well in his new position in another area of the country.
` Chairman Hahn acknowledged receipt of a March 9th memorandum from the City Manager,
subject "Reports and Minutes Re Tentative Maps"; and of a request from ommcil-
man Proft that the Planning Casmission discuss the six residential areas of the
General Plan; and finally asked that under the item "New Business" on the agenda
the Camussioners consider the question of a special meeting of the Commission in
March.

Discussion follaoed on whether a Commissioner was obliged to be present at Sub-
division greetings, and if not, would the present schedule of assigning a Commissioner
to attend these meetings for a month at a time hold? City Manager Crows concluded
the discussion by saying that it was a Code requirement for a Commissioner to attend
these meetings, but that it had been the consensus of opinion at the January 4th
meeting that attendance at the Subdivision meeting depended on whether the individual
Commissioner thought it was an important function of his office to do so.
Commissioner Carico requested that possibly Item 20.3, of the January 4th Minutes
be agendaed for discussion at some future date so that formal recommendations could
be sent to the City Council.
WTICN SEMMED AND CARRIED: It was moved by Commissioner Rahn and seconded by
Commissioner Schick to approve the Minutes of the Joint Meetinq of January 4, 1977
except for Item 1 which is questionable as to whether it is mandatory or. not.
The motion was approved by all Commissioners except Commissioner Rahn who abstained
because he had been absent from the meeting.
Cn the Minutes of February 23, Chairman Hahn requested the following corrections:
Page 6 - 8th line from the bottom 'excessive' should replace the word "exclusive".
Page GA - 5th line from the bottom "road would better" should be corrected to
read 'mad would be better.'
Page 7 - Chairman Hahn asked that the last paragraph on the page be checked
for the accuracy of transcription of what what was actually stated.
The sentence should read 'anything done to Three Forks Lane' rather
than 'anything dam to Three Forks Lane". 'The improvements were
being requested for the benefit of Three Forks Lane residents.'
should also be inserted after the first sentence.
SIM SEOMM AMID MMUM; It was moved by Commissioner Carico and seconded
by Commissioner Hahn to approve the Minutes of February 23 as amended. The motion
was approved by all Commissioners present with the exception of Commissioners Rydell
and Perkins who abstained because they had been absent from the meeting.
Commissioner Perkins wanted to know more precisely about where the Lands of Land
I�sources Corporation on Arastradem Poad, File #TM 2054-77, was located and also
if this map was in complete compliance with the subdivision ordinances. Mr. Maricl
discussed his efforts at assuring that naps were in compliance and stated that it
would not have been placed on the agenda for acceptance if it were not.

Chairman Hahn began further discussion on the subject subdivision by reviewing the
issues that heli to be decided by the oamdssiooem. Specifically, they were the

the matter of the intersection of. Country Way and Page Mill Road, and the matter
of paths and fire mad access. He noted that he had met with the City Fmxrineer
and Mr. Farwell of the Fire Department to discuss these problems. He referred
to sections in the General Plan that were genane to the area under discussion,the
page 77 discussion of the Matadero Creek area, the pane 133(b) map shaving fire
hazards and protection in the Matadem Hills, and the page 41 discussion on emergency
roads. He noted also that Mr. Farwell proposed fightinq fires by caning in from
the 'Three Forks area rather than going dam the east side of the property, and noted
that Mr. Farwell proposed coning dam Country Way betz,+een Lots 7 and 8 and dam
the southerly side of Lot 8 and along the Lands of Koo.
Mr. Halm also noted the question of area for Lots 1, 2, and 16 of the subdivision
and the kind of development these lots could sustain, as well as the need to pro-
vide a path through the subdivision to the Koo property without traversing the
steeply sloping hillside area. Thereafter, the hearing was opened to the public.
Mrs. Fiksdal, Pathwa She 22tttee spoke for the pathway proposals presented in her
memorandum oD noted that without the path as she proposed, there would
be no direct path from the Koo Subdivision to the Bahl Subdivision without tres-
passing on private land. She urged the subdivider and area residents to try to
get together and work out a path without a lot of grading to the canyon area and
4W that would follow natural land contours in the area.
In discussion that follared on the various alternatives to the problem of the
steep Path through the canyon area, Commissioner Young cautioned against relinquishing
a certain path no matter how bad it was, against a future path that might or might
not become available if other property amers in the area decided to subdivide. Car
missioner Perkins, referring to the General Plan, noted that it required that canyon
and Swale areas be preserved for open space; he =eluted that a path acres, the
Bahl canyon area would be a mistake, that it would open up problems of preservation
of stream and wilderness area. Commissioner Schick noted that a five .foot path in
an area with heavy poison oak growth world become an equestrian rather than a
pedestrian trail.
Wallace Stegner, South Fork Lane, spoke against the canyon area trail and for a
paT-dam Country Way. He said it was possible to get a path along the Sterling
land which would be a satisfactory way to get to the higher ground of Natuna.
Public hearing was closed and discussion continued among Cammissioners. Cmmissioner
Carieo again voiced a omplaint about the lack of proper maps. She noted also the need
to be aware of the potential development of the Palo Alto School District property,
and the need to have a connection from the Kco property to Via Ventana.
MM(V SEOa= AND CARRIED: It was moved by C mnissioner Stewart, seconded by
03mussiamer Carico and unanimously passed that the ten foot (101) joint easement
for a Type lA path shall be continued from the cul-de-sac on Country Way along the
Private portion of Country Way to the intersection of Lots 7 and 8, then in a
southerly direction with a ten foot easement in that area (five foot (5') from each
lot) to the southerly boundary of Lots 7 and 8 and then continuing a ten foot (101)
easement along the southerly boundary of Lot 8 to the easterly boundary to its
terminus.

Discussionrsumed on the fire road access with Camdssicner rari.m asking that
it be noted for the record that the Los Altos Country Fire Protection District
repesentative Mr. Stu Farwell had said that the emergency fire road easement would
be adequate, and that he had agreed to use the easement to get into the area.
Mr. Russell, the Two Engineer, noted that the easamnt could be used by a piece
of amrgencY vehicular equipment. To Cacmissioner Young's query on has a right-
angle turn -around could be negotiated, Mr. Russell said that a radius curve would
be put in on Lots 7 and 8.
KVICN SEO(NDED AND CARRIED: It was [roved by Commissioner Hahn and secauded by
Caumissiouer Schick that an emergency fire road easment shall be dedicated from
the bulb of Country Way, down the private section of the Way to the intersection
of Lots 7 and 8 and then southerly between Lots 7 and 8 to the Palo Alto School
property, and then in an easterly direction along Iat 8 to the end of the property.
The motion was approved by all the (kmnissioners except Commissioner Perkins who
voted against it.
William Cotton, Town Geoloqist discussed Lots 1, 2 and 16 and a hit of Lot 10 as
re to a fault trace r=uxg through the area. He noted that a setback
of 25, 50 or 100 feet fran the fault zone depended on how the Town felt about
40 the setback areas £ran such zones. He said the proposed plan and setback area
frau the fault zone locked good and was a reasonable approach. Vfien Comissioner
Schick asked whether Mr. Bahl was taking the maximum setback, Mr. Cotton agreed
that he was.
Mr. Russell again noted that there had been no Prnm ent in the area under discussion
for a period of 7,500 years, and that trenches had been dug and the fault zone de-
fined as located in the region of Lots 1, 2 and 16. He also said that the zone
was defined and that the fifty foot setback did cmply with Town requirements.
Don Bahl Subdivider, noted the F�duibit supplied was in eapliance with City Council
xequests,an tat trenching was for the purpose of fitting houses appropriately
onto these lots in question.
MHTCN SECONDED AND UNANIMNSLY PASSED: It was !roved by Commissioner Hahn,
seconded by Ca`missioner Schick, and unani musly passed, that attached to the Sub-
division Tentative Diap shall be the drawing designated Exhibit A (to be affixed to
and beccm a part of the approved Country Way Subdivision file) de ronstratmg that
Lots 1, 2 and 16 can aeoamrodate at least a 3,200 square foot first floor hole,
plus a pool, without requiring a variance.
Mr. Russell confirmed that it will be noted on the final map that there has been
a soils and geological report and the date of the report.
Cmudssioner Young was concerned about emphasizing three lots without calling
attention to other lots on which the fault trace runs. Lamdssioner Hahn noted,
however, that these had been designated for special attention by Councilman McRey-
nolds and therefore were being addressed by the Planning Camuission with special
concern. Mr. Russell, hauever, suggested writing across the tentative map: "All
lotsinwhich the fault trace appears in the original diagram are subject to the

same setbacks as imposed on a three 1 which is the twenty-five foot setback.
Discussion began problem of thdiAtersection of Country Way and Page Mill
Road. When City Manager Crone warned against trying to determine, before actual
engineering Plans for the intersection are completed, the exact location of the
mad, C=dssioner Schick stated she wanted it clearly stated in the record that
the Planning Ctnmission did think about the intersectionsof the mads. Commmissioner
Carico noted the need for Three Forks Lane residents to work with Mr. Bahl toward
a solution to the problem of the hazards of the intersecting roads and noted that
the proposed solution was the best one until Mr. Bahr agreed to cooperate on the
matter.
Mr. Russell agreed that the Three Forks Lane area is bad, and stated that it was
to hff. Bahl's credit that be was willing to give an easement across his property
at no expense to Mr. Bahr so that the connection to Country Way could be made.
He also stated that the improvement plans would be brought to the Commission for
review before they are presented to Council when Commissioner Perkins expressed
concern over the adequacy of what had been proposed.
MOTION SECONDED APED CARRIED: It was moved by Commissioner Hahn and seconded by
L Cmmissicner Schick that the intersection of Country Way and Page Mill Nknad may
�Y be moved in an easterly direction to obtain optimum line of sight. This inter-
section shall be designed to the satisfaction of the Tam Engineer. All Ccvmnissim-
ers voted for the motion except Commissioner Perkins who voted against it.
MOTION SECONDED AND CARRIED: It was proved by Co missioner Hahn, seconded by
C=dssioner Schick and unanimously approved that the remaining triangle bordered
by Three Forks Lane, Page Mill Road and the forty foot (40') easement across
Lot 15 shall be dedicated to the Town of Los Altos Bills th expedite possible
future development of the adjacent Three Forks Lane property.
MOTION SECONDED AND CARRIED: It was moved by Commissioner Carico and seconded
by Commissioner Schick to recammend approval of Country Flay Subdivision, File
#TM 2041-76, with conditions as mended by the Planning Commission. All 03�mmission -
ers voted for the motion with the exception of Commissioner Perkins who voted against
it.
MOTION SECONDED ADD CARRTFD: It was moved by Commissioner Carico, seconded by
Commissioner Schick and unanimously approved to file a negative declaration for
the Country Way Subdivision, File irTM 2041-76.
A recess was called by Chairman Hahn at 9:59 P.M., and the meeting was resumed
at 10:12 P.M..

discission began with Commissioner Schick asking about Condition 8 on page two of
the list of conditions. She wanted to know if a request for variance would comply

with the six criteria for a variance approval. There was a lot of discussion on
whether the carport on Tat 3 should remain if it is not in compliance with set-
back requirements. Ccmnissioner Stewart noted that the subject property and
existing garage or carport abuts onto the property of Beth Am Synagogue. He was
of the opinion that it is a noise barrier which screens out traffic and noise from
the adjacent property. Rb a proposal that a garage could be constructed, in keep-
ing with setback requirements, on another area of the lot, he noted that as it is
the carport is hidden by the trees. I£ it were reconstructed in the meadow area,
it would stand out and be an eyesore. Camiissioner Young pointed out also that
the driveway would also have to be realigned if a garage were constructed else-
where and possibly more trees would have to be removed.
There was considerable discussion on the request for an easement by the Santa Clara
County water District for the purposes of flood control maintenance. Owmissioner
Stewart objected to the requirement of forty feet, noting that if flooding in the
area did occur, property owners would surely let the District in to work on the
Chairman Hahn opened the hearing to the public.

Engineer for the Applicant, said that while he did not object to
�/ the forty foot eseament �i -Flood Control District, he would like to
see it made as small as possible.
In discussing the easement requested by the Flood Control District, Mr. Russell
said that he went along with the philosophy of obtaining easements, but he could
not go along with taking easements along one piece of property when there are none
on either side. He noted that there was access for the District from the private
road if it were needed. Discussion was concluded, the public hearing closed,
and measures proposed on the property as follows:

Information on the subject property was contained in the staff report of March 2.
Mr. Markl noted that the Commissioners had received several corrections for their
infoamtion on Lands of Duval, a letter fron neighbors citing their feeling on the
status of the road, and a melmoranhan dated March 6 from Mrs, Fiksdal, Pathway Committee.
Discussion began on the property with Mr. Russell giving a brief history on the
status of Duval Way and haw the present dilermo on the road had case about. He
noted that the property had started out with Vince Kennedy in the 1960's. He had
bought the property frau Mrs. Duval, and that no roads had been „sired to serve
these lots. The five lots in questions all have easerants frau Mrs. Duval in order
to have access. He had no knowledge of a maintenance agreermt, and noted when
fully developed, the road (Duval Way- now a private road) will have more than five
homes on it.
Ounnssioner Schick asked who awned the road, and Mr. Russell said it belonged to
Mrs. Duval and the present subdivider. Later in the discussion, however, Maryann
Malcolm, one of the licants, stated that the present subdividers awned aI�
prxperty, in the road area under discussion, having hought it from
Mrs. Duval by paying cash for the property.
Connissianer Perkins raised the issue of the gross acreage on the property, and
stated he had difficulty seeing if the slope density calculations were insistent.
'hereafter, Chairman Hahn opened the hearing to the public.
Paul Nowack, �ineer for the Applicant, stated he objected to two of the conditions:

Ognlition 7, noting that the Town had picked up an $1100 cash bond for roadside
inprovements and certain ditches. He stated it was unfair to ask the present owners
of the Lands of Duval to bring the roadupto Town standards or to fix the road all
by themselves. He noted that the owners still wanted to keep the private road, and
that those traversing the Lands of Duval were being asked to contribute to the repair
of the road,
Mr. Russell noted, however, that the Tuan has a perfect aright to require that the
road be brought up to Town standards, and noted that the drainage money was fueled
in 1975. Discussion on whether the road should be private or public continued
with camnents frac surrounding property owners.
Mr. Arthur Sobel, 26066 Duval Way noted that it made no sense that he should have
to contributeute to ringing road uP to Down standards, and that he paid taxes for
this to the Town, that he should not have tD maintain a road because he received
a fee sinple right of ingress when he purchased his property.
Albert Jackson, 26088 Duval Wa stated that five lots exist on Duval Way and that
more on n gnrnproved road would make it iupassahle. He stated that
there was no reason that he should pay to inprove Duval pray when it is at present
serviceable tothe hates on the road now.

to Wild Barley Hills. Commissioners voting for the motion were Commissioners
Schick and Hahn; against, Caanissimers Carieo, Perkins, Rydell, Stewart and Young.
Alan Lanbert, 141 First Street Los Altos promised that Wild Barley Hill subdivision
was essentially the same, that Mr. Cotton's report could not be long, and that he
had care ham from Paris to the subdivision hearing. lie requested that the Cammission
continue.
It was mover] by Cmmissianer Perkins and seconded by Camdssioner Carim to
adjourn at 12:30 A.M.. Voting for the motion were Commissiaiers Carim, Perkins,
Rydell, Stewart and Schick; against were Ca!missiaters Young and Hahn.
Mr. William Hauswald, 26100 Duval Way felt cost of improving Duval Way should be
p551 tneTann, and t the residents should not have to pay for irproving the
road. He noted, in response to Commissioner Carim's query on a maintenance
agreement, that the road to where he lives is maintained. He noted, in light of
the poor way that the road has came about that this is the last time to straighten
it out.
Mrs. Fiksdal, Pathw Cmnittee Chairwarnan objected to a different path reeomendation
`. on -par-E-37 S ran the one a reamnended.
Mr. Markl noted that at the time of the Subdivision meeting it had been noted that
there was a definite need for paths through the areas to Foothill College, and that
the path recamc+ndation was a corpranise reoamendatim. Mr. Russell stated that
conditions were suggestions only and could be changed by the Planning Cmmission.

Thereafter, the public hearing was closed. Various ways of alleviating the cost of
improving the mad to public standards were discussed, such as having a public road
to the Smith property and a private mad £ran there.

seconded by Cmmissioner Young and unanimously carried to delete condition 5A and
replace it with a ten foot pedestrian and equestrian easement along the westerly
boundary of Lot 3 fen Duval Way to Josefa Lane.

seconded by Commissioner Stewart, and unanimously approved that as a condition
the applicant shall construct a five foot (5') pathway, Type 1A within Duval Way
from Pobleda Road to the cul-de-sac and within the easement as set forth above
in Condition 5a.

Mr. Markl called attention to his March 9th memo with the added condition 2-a
concerning required fire hydrants to be added to the subdivision, arri thereafter
reviewed events as they related to the subdivision. He noted that the re-routing
of the road on this subdivision was in conformance with the Seismic Safety element
of the General Plan. Thereafter, Chai man Hahn opened the hearing to the public.
William Cotton, Tom Geologist reviewed his experience With the Wild Barley
Eirii n�ii drvrsron. He noted that at the time of the original review of the property
that he thought the property had significant geological problems, and noted that
the geological investigation didn't find the fault where he thought it was, and
noted that the fault was found to be a one hundred foot wide zone. He noted
that the zone on the Wild Bazley Hill Subdivision was not a single line as on
the Bahl property. He noted that in the cage of Wild Barley Hill, a wide zone is
taken as the fault line on the property and that a twenty-five foot setback is
allowed from that. The fact that all houses will be outside this zone does not
eliminate the chance of ground rupture interfering with foundations, but it
significantly reduces the chances to levels of acceptable risk. - Mr. Cotton
said he could live with what had been proposed and to recommend the subdivision.
Mr. Cotton noted further that since then the City Council has requested a fifty
foot setback, but that this requirement would not reduce risks anymore than the
twenty-five foot setback world. He reiterated that a twenty-five foot setback
is a reasonable approach for a setback from a fault zone, and most of his colleagues
would agree with hin.
Mr. Cotton ountinusi by stating that the re -alignment of Wild Barley Hill Pbad
is better because it minimizes the partial destruction of roadway. He added that
fault zones were good locations for roadway since this minimized the danger to
people, and that people should remain in houses rather than on roads.
Commissioner Schick noted for the record that two reasons for which the subdivision
had been denied had been taken care of by Mr. Cotton's discussion. Mr. Perkins
asked if the problem of the fifty foot right of way for the roadway had been taken
care of in relation to the Yeager property by the path easement. Mr. Russell said
that it had.
Mr. Russell noted that another issue raised was the downstream drainage from the
Wild Barley Hill Subdivision. He traced the route of water run-off and stated
` that it was not the responsibility of this subdivider to correct all those
structures that cavy drainage downstream from the subdivision that are under-
sized. Water runoff from the property has the right to follow the natural drainage
path. 'Thereafter, Mr. Hahn opened the hearing to the public.

Alan Lambert Subdivider, said that Wild Barley Hill is a better su)divisim by
happenstance. He sp ce for approval.
Mrs. Gottlieb Uj�Pathw Camnittee, discussed pathway requests. She stated that

but at this time they would not grant a path across their property. She noted
the needtokeep children off E1 Monte Avenue.
Mr. Hahn stated that the Camdssioners had previously been told that the Town had
no easement beyond the Lands of Wild Barley Hill. He questioned if a path should
be required along Lot 14 as a conditional path foramen Wild Barley Hill Road goes
all the way dam to Claussens.
Mrs. Gottlieb said that when Mr. Stewart built a seared house, he filled in Part

the creek area there. Thereafter, Mr. Hahn closed the public hearing.

seconded by Canmissioner Hahn that a negative declaration be filed for the Lands of
Wild Barley Hill, File #TM 2046-76.
CID BUSINESS:
In discussion of items of business on zoning that were before the Commission,
the matter of a special meeting was discussed in order to have time to deal with them.
It was moved by Cc ssiaier Perkins and seconded by Ccardssicner Rydell that a
special meeting of the Planning Caemissicn take place on the fifth Wednesday of
March. All Crnmissimers voted for the motion except Camdssicner Carico.
Crnmissianer Perkins asked Mr. Markl for a re -calculation for lot oampliance with
slope density requirements for the Lands of Duval.
NEW BUSINESS:
Mr. Russell called attention to the March 9th letter fran the City Manager regarding
the transmission of the Minutes of the Planning Crnmi.ssion to the City Council in
connection with Tentative Map Recamiendations. In a short discussion of the memo,
