Chainren Hahn called the meeting of the Variance and Permit Ccmdssion to order
in the Council Chambers of Town Hall at 7:00 P.M.
PDLL CALL:
Present: Co missioners Schick, Stewart and Hahn
Also Present: Town Engineer Alexander Pussell, T'avn Planner/fRngineer John Mazkl,
Secretary Ethel Hopkins
APPROVAL CP MIIdOT'ES:
Because the Minutes of April 13 were not transcribed, their approval was continued
to the meeting of May 11, 1977.
PUEUC HEARINGS:
1. LANDS OF KiODSENI File #HSA 6092-77, Dezahara and Taaffe, Paul Nowack 5 Associates,
Inc., Engineers,Request or Recamendation of Approval on Building Site Approval
Request.
Mr. Markl addressed the Camdssioners by referring than to his staff report of
April 22, and emphasized that the proposed drivevW area should be on Dezahara Wav
rather than on Taaffe.
Discussion began with C=dssioner Schick askim about the statsmnt on pace two
of the staff report that there were no further cotments relative to the proposed
"subdivision". Mr. Markl said that the proper term should be 'devel pmnt' of
the lot.
Chairman Hahn asked about the pathway requirement that the path be restored after
construction is cacpleted. (Pathway Minutes of April 11 attached to staff report -
Appendix #7) He noted that the path is narrow along the bank, and asked if a path
could be built between the fence and the trees on the property. Mr. Markl noted
that a pathway fee is taken on BSA's, and that the City Manager would decide what
path work would be done. Commissioner Schick questioned if paths were taken when
the original Nose Hill Estates tract was developed, and Camiissioner Stewart wondered
why a path was taken at all when there was so much roan near the curb. Thereafter,
the hearing was opened to the public.

erne o De a,and that he was with the equestrian easement. He noted
that he thought he could do all he wanted to do on the property within the setback
area.
Mr. Pussell noted that a ten foot easenmt existed on Taaffe and on the portion
of Dezahara covered by the subject lot, but thatfurther on it was abandoned, and
thereafter the public hearing was closed.

and seconded by Ca:missiolPS Schick that Condition 6 be the following: The
driveway entrance shall be on Dezahara Way, and there shall be no entry to Taaffe Road.
WrI0N SECCNDED AND UNANIMOMY PASSED: It was moved by Cormissioner Stewart and
seconded by Canmissicner Hahn that the Lands of Knudsen, File #MA 6092-77, be
recta ended for approval with conditions as amended by the Variance and Permit
Coamission.
MMI(N SECaIDED AND UNANIMX]SLY PASSED: It was awed by C=Lissicner Schick and
seconded by Commissioner Stewart that a categorical emmmmtion he filed for the
Lands of Knudsen, File #BSA 6092-77.
Mr. Russell called attention to Town regulations which penni.tted no more than
forty percent of the area of the lot can be covered, and that looking at his proposed
plans he noticed that Mr. Knudsen was approaching the forty percent limit. Mr. Knudsen
replied to this that he hoped to stay Lander the forty percent limit.

at 7:24 P.M..
