Imld. CALL: Present: Commmissioners Schick, Stewart and Hahn Also Present: Ttwn Engineer Alexander Russell, Town Planner/)ngineer John Markl, Secretary Ethel Hopkins APPROVAL OF MINUTES: Camdssioner Schick requested that the Minutes of April 21, page four, be corrected as follows: Delete the second sentence of paragraph two under "New Business". Correct the remaining sentence in the paragraph to read: 'Mr. Hahn, in locking ahead to the nwbership of the Variance and Permit Crnmission for the month of May when Lands of Mourad could be reheard, appointed Commissioner Schick to remain on the Cc=dssicn through the month of. May., Chairman Hahn requested that the last line of page three on the Minutes of. April 21 be corrected to read 'BSA 6091-77' rather than "BSA 6090-77." Chairman Hahn also asked that 'Minutes of a Regular Meeting' be inserted into the heading of the Minutes of April 27. NOTION SIXMDED AND UNANIMOUSLY APPIX7VED: It was moved by Chairman Hahn, seconded by Cammi.ssioner Stewart and unanimously approved in a roll call vote that the Minutes listed an the agenda, specifically the Minutes of. April 13, April 21 and April 27 be approved as amended. PUELIC HEARINGS: 1. LANDS OF AN(�I.L, File #VAR. 7037-77, 27385 Deersprings Way, Variance for Pool Setback, Sandis s Associates, Engineers, Request for Recommendation of Approval for Variance for Pool Setback. Mr. Markl began discussion on Lands of Angell by referring Commissioners to his staff report dated May 6, 1977. c mmissioners had various questions concerning the scale of the man (Appendix 2) and whether a pool site had been selected when the house was originally planned. Mr. Markl noted, for instance, that there was a nice view of the canyon, Mr. Hahn questioned if a swirmi.nq pool could be placed on such a steep lot. Mr. Russell, however, drew attention to the fact that the Angells had just bought the property in November 1976, and that when the house was constructed several years ago, there had been no provisions for a swimming pool. Mrs. Judy An 11 27385 Deersprings Waw stated that the property had been purchased an Nn —]J , anat Property was purchased they had been to t Neu(10 there `� be a pool, but they had not seen the plans for the site, She noted that she and her husband were not specifically aware of the problem of setback when they purchased the property. 6 Commissioner Stfwart inquired about the height of the deck in the variance set- back area and discussion continued on the problem of a too high deck and the need for sone decking with the topography of the lot. Thereafter, discussion was concluded and Commissioner Stewart proposed the following motion. 617PICN SBCa= AND UNANIII)NSLY PASSED: It was moved by Commissioner Stewart, seconded by Comadssicner Schick, and unanimously approved that the Lands of .Angell, File VAR.#7037-77 be denied without prejudice. The reasons for denial of this variance rest were in answer to Mmi.cipal Code Section 9-5.1107(b), specifically Item 1 -there were no exceptional and extraordinany circumstances; Item 2 - this would not result in practical difficulties; Item 3 - this would not dery privileges enjoyed by other property owners; and Item 6 - the qrantinq of the variance would not be in hammy with this chapter or the General Plan. Mc. Robert McNamee, attorney for the applicant, voiced his objection to the denial of the variance. He stated he felt that his client was entitled to rmm considera- tion than a review of applicable ordiances. He stated that there were factors such as topography that contributed to the need for a variance. Cormissioner Schick reminded Mr. McNamee that he could make his appeal to the City Council.
