RXL CALL: Present: Camdssioners Stewart, Schick and Hahn Also Present: Than Engineer Alexander Russell, Tbwn Plannner/Engineer Markl, Secretary Ethel Hopkins APPROVAL CF MINUTES: It was requested that paragraph three of the Minutes of May 11 be corrected as follows: 'Mrs. Judy Angell, 27385 Deersprings Way, stated that the property had been purchased in November, and that when the property was purchased they had been told by the realtor that there could he a pool, but they had not seen the plans for the site.' (The rest of the paragraph remains the same.) MITICN SECCNEED AND CARRIED UNANIMDUSLY: It was moved by Canrti.ssioner Hahn and seconded by Ccnmissioner Stewart to approve the Minutes of May 11 as corrected. The motion was unanimously approved. Jack Chown, 13822 Page Mill ikmad, Mom Lane Iosident, asked what overall plans had been naae in the area of Moon Lane. He asked about how traffic would be muted on Moon Lane, and called attention to esisting problem; with drainage and fire protection in the area. He stated that he was not trying to make an issue of whether Mr. hourad world build a house, but was concerned with keeping Nom Lane a private roars. He noted that five hoes already existed on Poo Lane, and Mr. Mourad's develorment would change this. `r Ccmnissicner Schick noted that Mr. Mourad had submitted a letter dated May 16 stating that because of the cost of dealing with water and fire protection prcbl.ens in the area, the Mourads had decided to wait until a more economically feasible MM7TM OF THE VARIANCE PND PERMIT CMAISSICN - May 25, 1977 i Page two ( PUBLIC BEARINGS: (continued) 1. The Yrmrads, however, were asking that the Building Site Approval be granted contingent upon a solution that would be economicallyfeasible and approved by the fire department. Commissioner Stewart stated that Mr. Mourad's property was in existence before the ordinance limting the number of hares on a private road, and Mr. hburad could not be prevented from developing his ]and. Be also called attention to the Mom Lane residents' objections, at the time the Lands of Amies parcel map was heard,to any connection for Mnon Lane with a public road on the Saddle Mountain Estates Subdivision. Bill Wilson, Moan Lane resident noted that the Lands of Mourad, Clayton and 30=cK should be developedwith access to the Lands of Amies or Saddle mountain Subdivision. Camrissioner Schick reminded Mr. Wilson that the Mom Lane area residents had requested a blockad=_be placed at the end of the Ayres -Saddle Mountain Subdivision preventing any access to Moan Lane fxnn the upper area to be subdivided. mff. mou rad's property would be separated from the Ames subdivision by the C blockade. She asked about a plan early in the Town's history to use Lupine Road and Elena Road for access. Mr. Fussell stated that there was no actual access for Mean Lane to Lupine planned. He noted that his deed is not so clear an water rights for the well, and that the Handleys are paying taxes on it. mfr. Russell noted that Mr. Armes intended to leave the barricade in place for the time being. Any cooperation in solving water and fire problems would be entirely up to his discretion. WrICN SECQIDED AND CARRIED: It was moved by Commissioner Stewart and seconded by Commissioner Schick to postpone the Lands of Mourad without prejudice until there is a resolution of the water, fire and road problems. All the Commissioners voted for the motion. Mr. Madkl demonstrated the need for the variance request by showing a trans- parency of the site under discussion. He noted the variance is needed for all four sides of the property. Mr. Russell stated that the request under discussion is an appropriate one, since the California Water Service Company is a public utility maned by a private cmcpany. Mr. Hahn opened the hearing to the public. Mr. Al Corduan, 10531 Marlena stated that he had no objection to the tank pro- posed by tne California Water Service, but he urged that the Town do somethina to stop the downstream drainage hart Blandor Way that was creating big problems on his property on Magdalena. He specifically wanted the T1 to put in a culvert to divert this drainage from his property. Jack Pranderaast California Water Service C�any stated that the cmmany did not anticrpage t e�.r structure wou=Inncrsase the flaw of drainage from their property. He stated he would be glad to work with the Town to help solve the drainage problem as a part of the water tank project. He noted the need for more water storage capacity to serve area residents. MITICN SECCNrED AND CARRIED: It was moved by Co mnissioner Stewart and seconded by Coamissioner Schick that the variance for the Lands of California Water Service Conpany, File VAR.7038-77, be approved with conditions. Mr. Stewart recommended that Mr. Corduan discuss his drainage problems with the City Staff. 3. LAND6 OF IVERS(E4 AND DEL SECCA File #BSA 6093-77 Elena ad, H.P. He urged the ompletion of papers for the annexation referred to in Condition 6 (revised) be accxmplished as soon as possible because the annexation would have to be approved by the LAFCC) agency. The public hearing was opened and closed with no one speaking for or against the request. MH'ION SECONDED PND M IMASLY APPAYVED: It was nnved by Chairman Hahn and seconded by Ommissioner Stewart to amend the list of conditions by substituting the following for Condition 6 on the staff report: Condition 6. `r 'this parcel or lot shall be annexed to the Purissima Hills County Water District prior to the occupancy of any structure erected on this parcel or lot. Water for darestic purposes shall be obtained from the District.' MMCN SEOU\IDID AND UNPNIMXISLY APPP[7=: It was moved by Ccumissioner Schick and seconded by Cm missioner Hahn that the Lands of Iverson and Del Secco, File #BSA 6093^77, be approved with conditions as amended, and that the list of conditions incorporate Mr. Markl's new gross and net area information. MYEICN SENfIDED AND UNPNLPiJUSLY APPR WED: It was moved by Commissioner Schick and seconded by Ornmissioier Stewart that a categorical exemption be filed for the Lands of Iverson and Del Secco, File #RSA 6093-77. Robert Sheble, identified himself as the person who was constructing the home on property. He asked if any consideration would be given to the large anoint of road -in -lieu fee changed on the property. He asked what con- sideration would be given if a request were made that the frontage be reviewed. Mr. Hahn recamended that Mr. Sheble take hisxequest to the City Council.
