Chairman Hahn called the meeting of the Planning CU!MIssion to order at 8:11 P.M.
in the Council Chambers of the Town Hall.
RML CALL AND PIEDGE OF ALLEGIANCE:
Present: Camdssioners Carioo, Perkins, Stewart, Young, Schick, and Hahn.

It was requested that the Minutes of May 2 and May 11 be removed from the Consent
Calendar.
M)TICN SECCNDED AND CARR"IM: It was moved by Chairman Hahn and seconded by Crrmissioner
Perkins that the Minutes of April 27 be approved.
All Commissioners voted for approval of the motion with the exception ofCa!missioner
Carloo who abstained because she had been absent on April 27.
The Minutes of May 2 were corrected as follows: On page one, third paragraph from
the bottom, the last of the listed items was deleted. Feplacing this deleted item
should be 'adding a new section to Section 9-5.703 of the Los Altos Hills Mu ncipal Code.'
On page tbree, the phrase 'with the present resources' should be added to the sentence
ending at the top of the Page. The following sentence beginning with "He noted the
need to find out..." should be deleted.
MU'ICN SE0Uj D AND CARRIED: It was moved by Chairman Hahn and seconded by
Commissioner Stewart that the Minutes of Mav 2 be approved as amended by the Planning
Oxmdssion.
All Cammissicners voted for approval of the motion with the exception of Commissioner
Carico who abstained from voting because she had been absent on May 2.
The Minutes of May 11 were corrected as follows:
1. on page six the motions electing Chairman and Vice Chai.anan should read:
'Ckmnissioner Stewart nominated William C. Hahn as Chairman of the Planning
cm nission for 1977-78. There being no other nominations, Camiissioner Schick
moved, seconded by Commissioner Stewart that the secretary cast a white ballot
for the election of Chairman Hahn as Chairman of the Planning Co mission.
�,- 'Commissioner Schick nominated Judith Carico as Vice -Chairman of the Planning
Commission. There being no other nominations, it was moved by Commissioner
Stewart and seconded by Commissioner Schick that the secretary cast a white
ballot nominating Judith Carioo as Vice Chairman of the emission for
1977-78.'

Corrections to the May 11 Minutes (continued) :
2. Amend the second sentence, fifth Paragraph, Page two to read: 'He noted that
the Caomission had already taken action on the May 2 meeting, voting by split
vote to add another section to Section 9-5.703 of the Los Altos Hills Municipal
Code titled "City of the Tam of Los Altos Hills Facilities."
3. Strike "Dr." from Mr. L. E. Jack Valladeo's nae on page three.
4. Insert 'Tamwide' at the end of the first sentence in paragraph four, page five.
MYrICN SEOCNDED AND UNANIMJUSLY APPFCVED: It was moved by Cmrussioner Hahn, seconded
by Commissioner Carico and approved unanimously to hold over approval of the May 11
Minutes to the Meeting of June 8 when amended copies would be available.
PUBLIC HEARUX;S:
1. LANDS OF CALI P IIA WATER SERVICE COPPANY File OCU 8023-77 and VARA7038-77,
Water Storage Tank at Magdalena, Request for Fecammndation of Approval on
Conditional Use Permit.
Chairman Hahn began discussion of the subject request by informing a CoFwdssion
that the Variance and Permit Commission had granted the variance to setback require-
ments at its meetinq earlier in the evening. Discussion occurred among Camdssioners
on the need for a use permit with Mr. Russell stating that a conditional use permit
is needed because California Water Service Company is a public utility operated
by a private company. The application for a Conditional Use Permit was in response
to Torun ordinance rantiiremsnts. There was some discussion on Item 2 on
page two of the Staff report dated May 18, and thereafter the hP.aring was opesned
to the public.
Mr. corduan, 10531 Magdalena Road stated that he was not opposed to the request
o-i'TCali r Water Service L=pany and that he felt the cmpary's presence
in the area very beneficial. However, he called attention to severe drainage problems
he has experienced on his property due to drainage from Albertsworth Lane and Blandor
Way. He requested that the Tam take some action to help him with his drainage
problems. He also mentioned that the swale became clogged with debris from storm
runoff.
Catmissioners discussed Mr. Corduan's problems with drainage with Mr. Crave suggesting
that Mr. Corduan call the Town Manager or Town Engineer's office so that Staff could
go and check whether the drainage problems were a mattes for Town action or were
a problem for tate landowner to handle. Mr. Stewart requested that a copy of
City Attorney Gillio's letter on storm -water runoff be sent to Mr. Corduan.

Betsy Fiksdal, 11271 Magdalena asked about the height of the new tank.
The public hearing was closed and discussion followed among Catmissionere. Mr. Russell
stated to the Cmmissioners that Mr. Corduan's drainage problem were a separate is -
Sue from the conditional use permit. Commissioner Carieo recomended that the Town
staff work with Mr. Corduan to mitigate his problems with drainage. Commissioner Perkins
asked about noise control, and the following motions were passed:

MTIIN SEC(RIDID AND UNANIMU.SLY PASSED: It was moved by Commissioner Perkins, seoonded
by Commissioner Young and unanimously passed that the following condition be added
to the list of conditions for the Lands of California Water Service Company Conditional
Use Permit: 'There will be no increase in the noise level associated with the revised
installation, including pumping or any other aspect of the operation. Noise levels
shall not exceed the noise levels prescribed in the Los Altos Hills Municipal Code.
MOTICN SECONDED AND UNANIMOUSLY CARRIED: It was moved by Crnmissioner Perkins,
seconded by Cartnissimer Hahn and unanimously passed that a recommendation of
approval be given the Lands of California Water Service Conoany, File #CuB023-77,
with cmnditiars as amended by the Planning Cattnission.
MOTION SEOCNDID AND UNANIMOUSLY PASSED: It was moved by Camdssioner Schick, seconded
by Chairman Hahn and unanimously passed that a categorical exemrption be filed for
Lands of California Water Service Company, File #CU8023-77.
2. LANDS OF TRAFICANTI-VOORHESS, File KM 2055-77, Voorhees Drive, Edwin H. Smith,
Engineer, Request For Becammenciaticn of Approval of Tentative Map.
Mr. Traficanti's letter rusting that his tentative map be continued was noted

MOTIIN SEIX.t= AND CARRIED UNANIMOUSLY: It was moved by Oommissimer Hahn, seconded
by Commissioner Schick and passed unanimously to continue the matter of the Tentative
Map request for the Lands of Traficanti-Voorhees, File "1 2055-77 to the meeting
of Jive 8 per the applicant's request.
At 9:30 P.M. a reoess was called; the meeting resured at 9:92 P.M..
3. IN -MS CE BERGQ2 File #T1 2058-77, Fremont Fuad, IM Engineering, Engineer,
Request or Fe tion Or Approval of Tentative Map.
Mr. Hahn acknowledged receipt of a letter fon Thomas A. Puorro dated May 23, 1977
with a list of questions attached concerning the development of the Lands of Berger.
Also submitted was a condition to be added to the Lands of Berger which Cancerned
the conveyance of drainage fon the subdivision.
Commissioner Perkins pointed out that Barron Creek traverses the Lands of Berner
and noted that as a result a comber of the properties bordering the creek were subject
to inundation. Mr. Russell, however, pointed out that drainage on the subdivision
would be channeled underground, and as a result Barron Creek would entirely disappear
and would be channeled into a pipe with capacity for a one hundred year storm runoff.
Thereafter, the hearinq was opened to the public.
Betsy Fiksdal, Chairwvnan of the Pathway Camu.ttee, discussed Pathway Committee
requests.
Jim Harper, HMI Engineering, Civil Engineer for the Applicant requested that

'The existing driveway shall be maintained to provide energeney vehicular access until

such time as the proposed streets can provide suitable vehicular access He re-
ferred to the Fire Department letter as his reason for asking for the change.
fir. Russell added that the streets within the area should be rough -graded.
cammissiomer Carico asked Mr. Harper if he had any objection to a path between
Lots 8 and 9 of the subdivision, pointing out that this would he a large subdivision
with a lot of children. Mr. Hamer stated that he had no objection, but pointed
out that the problem of a physical barrier that could accmuodate both pedestrians
and equestrians would have to be resolved. Cuvnissioner Schick pointed out that
she was opposed to having an easement or a path between Lots 8 and 9. She said
that this would encourage an invasion of privacy by 'rotor vehiclesand dime buggies.
She said the rights of the potential owners of Lots 8 and 9 were Fein taken away
if this easement were required.
Dr. Fink, Kingsley Avenue noted that it was a disputed mattes whether Kingsley,
,age,, ma were in fact public thoroughfares. (Traffic from the proposed
pathway between Lots 8 and 9 would exit onto Lowell Avenue.)
Mary Stutz Pathway Committee spoke in favor of retaining the pathway requests.
4W The public hearing was closed, and the questions in Mr. Puorro's letter of May 23
were addressed point by point. 'these answers may be heard on the tape of the
May 25th meeting.
'ihe Commissioners reviewed the List of Conditions on the Lands of Berger, and
the following changes were made:
Condition 3 was amended by adding 'within 30 days of acceptance of final
in' prove ts' after the first ward in the oomdition.
Condition 4 was amended to read 'Locate, pump and fill all the existing
septic tan or cesspool on proposed lots' (the rest of the condition remains
the sane) .
Condition 5, delete the specific lot numbers.
Condition 8 should be deleted and the following substituted: 'The existing
iveways s all be maintained and proposed streets rough -graded to provide
emergency vehicular access.'
Condition 9 was emended by adding the following phrase to the end of the
sentenm prior to the issuance of building permits.'
Condition 10 was amended by deleting "to the recordation of the Final Map"
anrap=tead 'prior to January 1, 7978.'
Condition 11: Motion Seconded and Unanimously Passed: It was moved by chair
man Hahn and seconded by Camnissioner Yong that Iters (c) and
(d) of Condition 11 and Condition 12 should he deleted.

Condition 12 was deleted, and the following substituted: 'All surface waters
onto and across this subdivision shall be conveyed in an underground
pipe with appropriate structures at a location satisfactory to the Santa Clara
Valley Water District and the City Engineer and constructed to their satisfaction
and approval.'
Condition 13, insert 'beginning 40 feet' after "Canavera Court".
Condition 14: Motion Seconded and Failed: It was moved by Commissioner carioo
and seconded by Cammissioner Stewart to add the following as
Condition 14(b): A 10 foot easement between Lots 8 and 9 for a
Type IA path that will feed into Kingsley and Altadena and will
be limited to pedestrians and equestrians.
Vote: Cormissicner Carico and Stewart voted for approval.
Comnissioners Perkins, Young, Schick and Hahn voted against
the motion. The motion failed, but Commissioner Caries stated
she desired that this proposal should be forwarded to the
City Council.
Discussion continued among Commissioners on ingress and egress to the subdivision,
4W and on a lighted tennis court in existence on one of the Berger lots.
At 11:25 P.M., it was moved by Commissioner Schick and seconded by Chai.nman Hahn
to continue the meeting through the end of the agenda. The motion was approved
unanimously.
Charles Read, Osterlund Enterprises stated that light shades could be obtained for
$me th on the fermis courts, and he pram4 that when the lot was built noon
the lights would be abandoned.
Mr. Crowe said he would ask the City Attorney for his opinion on the issue of the
lights on the tennis court before the final map is approved. Conmissioner Schick
stated that the lights had been placed on the tennis court without Town knowledge.
There were several proposals made for dealing with the tennis court lights.

File TM 2058-77 by reommended for approval with conditions as amended by the (tammission.
WrICN SEC LADED AND UNANIMOUSLY PASSED: It was moved by Coumissioner Schick, seconded
by Chairman Hahn and passed unanimously that a negative declaration be filed for the
Lands of Berger, File #TM 2058-77.
4. ROLLING HILLS SUBDIVISI(N, File #TM 2057-77, Fremont and Old Trace Road,
R. , Engineer, Request or pecourendation of Approval on Tentative MW -

D. OLD BUSINESS:
Mr. RLnssell discussed his proposal for amending Ordinance 232 regarding undergrouanding
of utilities.

Mr. Markt provided the CamAssioners with a new, sipplified version of the slope
density calculations form.
F. ADJOURZnIT:
The Planning cwndssim was adjourned by the motim made by Cc ssioner Carim
and seconded by CWMSSiomr Halve. The wte was unanimous to be adjourned;
and the business of the evening being concluded, the meeting was adjourned at
12:07 P.M..
