Chairman Stewart called the meeting of the Variance and Permit Calnission to
order at 6:35 P.M. in the Council Chamber of Town Hall.
ROLL CALL:
Present: Camdssioners Stewart and Hahn. Absent: Commissioner Carioo
Also Present: Town Engineer Alexander Russell, Tam Planner/Engineer John Markl,
Secretary Ethel Hopkins
APPROVAL OF MWUPE6:
MOTION SECONDED AND UNANINDUSLY PASSED: It was moved by Commissioner Hahn, seconded
by Chairman Stewart, and unanimously passed that the Minutes of May 25 for the
Variance and Permit Camussion be approved.
PUBLIC HEARINGS:
1. LANDS OF PLOUGH, File ¥BSA 6099-77, Olive Tree Court, Paul Naaack & Associates,
Engineers, Bequest for Peax:mendation of Approval of Building Site Approval
Application.
Mr. Mark, stated �tha,,t�there were no additions to his staff report of June 7, 1977.

Discussion began 'bomi.ssioners with Cartnissioner Hahn asking about the • 61
stability of the lot relative to ability to accommodate a swiminq pool. Mr. Markl
referred to Itrn 1 of the staff report which answered this question. Mr. Russell
stated that he recommended compaction tests on the pool area. Canmissioner Strwart
inquired about the steepness of the proposed driveways and whether the undergrandinq
of utilities should be made a requirement for the ASA. Thereafter the hearing was
opened to the public.
Paul Newack, Engineer for Lands of PlVstated that if there is to be a pool
an the site, it Wil—Urely on cut - not on fill.
The public hearing was closed, and the folladmg motions were passed:
MOiTON SECONDED AND UNANINCUSLY PASSED: It was moved by oonmissioner Stewart
and seconded by Commissioner Hahn that the following condition be added to the
Lands of Plough: All public utilities will be placed underground -

seconded by Commissioner Stewart that a condition be added' o the effect that
'If a pool is to be constructed now or in the future, the shall he camact?dK
to the required caupactness at the tire of the construction of the home; and a (.
soils engineer shall be retained to ascertain the adeauacy of the commotion.'

Mr. Russell noted that Condition 8 should be amended so that brush is tom building

seconded by Camussimer Hahn that Condition 8 be a endedto read: The applicant
shall remove brush and vegetative growth, as specified at the time of site develop-
ment review, from the structural and roadway areas prior to the commenommnt of
construction of the hare.
bDTICN SECOMED AND PASSED UNANIIKIUSLY: It was moved by Coanissioner Stewart
and seconded by Ckxmmissioner Hahn that the Lands of Plough, File OBRA 6094-77
be recommended for approval with conditions as amended.

seconded by Cammissiomr Stewart that a categorical emotion be filed for the
Lands of Plough, File #BSA 6094-77.
commissioner Stewart asked about the possibility of restricting the subject lot
v against the possibility of a tennis court being constructed m it. It was the
consensus that the following statement should be included in the Minutes on
this BSA: The Commission is aware of the steepness of this lot and have cor
sidered thoughts as to the location of a future tennis court. It is the Commission's
suggestion that if a variance is requested for a tennis court, that it be considered

of Front Yard Setback to Accammociate Existumg Barn, R. Whaley, Engineer,
rmraest for Recomendation of. Approval of Variance Request'
Mr. Markl referred to his Jame 3rd staff report and noted that the barn variance
was being sought as a part of an application for subdivision. The barn became
nonconforming to setback requirements when the proposed lot lines for the sub-
division were deternined. Mr. markl added that Lot 1 of the subdivision
could not accamvcdate a tennis court without a variance.
Discussion among candssioners began with Commissioner Stewart asking about the

another variance should be sought to clarify the records on the pool, but that
the variance should be granted without charge to the applicant. 'thereafter the
hearing was opened to the public. _...__—...
Joe Seiger, Applicant addressed the Cam, ssion and stated that the swimni.ng pool
was a pre -e stung condition when they purchased the property. He said that it
was not logical to ask for a variance under these circumstances. He noted that
both Mr. Simon the co -applicant with Ms. Seiger and the neighbors like the barn
as it exists. He asked that the trees requested in Condition 5 be Placed ata
higher elevation, and that he and his co -applicant be grantedrelief
-
fran planting the trees at this Lire because of the water shortage due to the
drought.

until the rainy season before planting the trees.
When Mr. Russell suggested that the lot line between Lots 1 and 3 be eliminated,
Mr. Sei.ger agreed that he and his partner would accept Condition 5 as i rLier

hlr. Seicer stated that he wanted it recorded in the Minutes of the meeting that

matter of watering of the trees. He also stated that he hoped that the current
water problem would not prevent him fran carplying with the required conditions.
The public hearing was closed, and the following ration passed:
