Vice -Chairman Carica called the meeting of the Planning Commission to order at 7:09 P.M.
in the Council Chambers of Tawn Hall.
FaT. CALL AND PLEME OF PILEMMCE:
Present: Commissioners Carico, Perkins, Stewart and Yang
Absent: CaTmissicners Schick and Hahn
Also Present: City Engineer Alexander Russell, Town Planner/hgineer John Markl,
Secretary Ethel Hopkins
Vice-Chainnan Carico, after the Pledge of Allegiance,aclmawledged receipt of a letter
of resignation from the Chairman of the Planning CcmT&seicn, Cminissioner Hahn. She
stated she would be the acting chairman for the meeting.
Chainmen Carioo trek a poll of the Commissioners to see if the adjourned meeting of
E June 29 would be held. It was the consensus that the meeting would be held.
PUBLIC HEARINGS:

from the Adjourned meeting of June 13)
Cam;issiotexs expressed the desire to have the following information presented on the
subject application:
1. an outline of the mad system and of the trees in the swale area;
2. a discussion on the road and how the subdivider would cone with the
excessive cuts in certain areas;
3. haw the emergency access and bulbs at the end of the cul-de-sace would
be dealt with; and haw the cul-de-sacs could be shortened;
9, how tate recreation area could be developed in view of the Cianeral Plan;
5, caarents an the storage lane and access to the area; and
6 a map for future subdividing of the surrounding area.
A desire was expressed on the part of the C m mission for a professional planner to
study the surrounding areas to this sdxUvisicn with a view to a thorough plan for
subdividing being worked out. Mr. Russell, however, said that this would cost $10,000 to
$15,000 dollars because the Town staff did not have the time to do this overall
planning. He asked if the Commissioners were willing to recce nand to the Council
that an outside firm be retained to make the study.

John Clegg, rngineer, noted that he and his client had done their utrost to provide
tile coeur as they could go to solve the problem with their 154 acre subdivision.
He cautioned the Camiission that in requesting a study for the area, they were asking
Mr. Antes to delay his develcpmnt another year, and that it was not fair to do this.
He assured the Commission that this subdivision would fit with whatever developoent
occurred with surrounding lands.
Mr. Young stated that he concurred with Mr. Clegg's request, and noted that the
study really should have been o mprleted years ago.
Chairnan Carico opened the hearing to the public.
Louise Handley, Moon Lane resident, praised Mr. Clegg's plan. She requested moving
tFe�proposed�Ciay-= property because of the almost impossible terrain.
She inquired again about a road connection with Lupine Road, and she stated that
no one would stop a fire engine from going up Moon Lane. She and surrounding neighbors
were fearful that the present subdivision was a foot -in -the -door to making MOOn Lane
a public road.
Mr. Clegg, Engineer, stated that making Mom Lane a public road was not the aim of
t-lre app—Iicant, Mr. Armes.
The public hearing was closed, and Mr. Markl discussed with the Commission cross-
sections of the subdivision lots with various measures to mitigate noise and visual
inpact from Freeway 280.
John Clegg, Plrgineer joined in the discussion on types of foundations and the kinds
of es at wo d be constructed on the steep terrain in the subdivision.
Cn the matter of roads, a thoroughgoing exarmi.nation ensued on the proposed and alternate
ways of amstructing the cul-de-sac streets of the subdivision so as to diminish the
need for excessive paving, overly steep driveways and to retain the feeling of a
rural environment that is desired in the Irian.
There was discussion on the proposed entry way gates on the tbon-Lane end of the
subdivision as well as the entry way from Arastradero Road. Mr. Clegg stated that
the subdivider would deposit money for the subdivider's share—if Lane were ever
widened to became a public road, and asked that this money be placed in an interest-
bearing account. Mr. Russell advised that an encroachment would have to be
granted by the Town for the gate posts to exist in the public right-of-way area.
CamAssioner Perkins referred to a letter on the traffic investigatim by Russell C.
Pearson & Associates dated June 20, 1977. The Commission debated the advisability
of whether a left hand turn lane on Arastradero was needed for the subdivision despite
the fact that the Pearson & Associates letter had not felt it necessary at the present
time.
At 9:10 P.M. a short recess was called, and the meeting was resured at 9:23 P.M..
Discussion was concluded with an exploration of whether limited access was needed
for the first several lots of the subdivision at the intersection on Arastradero lmad, and

on how the park and recreation area would be developed. Thereafter, the Commissioners
went through the list of suggested conditions and Passed the following motions:
MTICN SEC(NDED AND PASSED L MZrVUSI3: It was moved by Comnmissioner Perkins and
seconded by Commissioner Carico to add as Item 1.(e) the following:
A final as -built geologic map shall be submitted to the Town for geologic
review after the roadways have been completed. Unless equivalent information
beoares available from the Town Geologist, this map shall be prepared by the
project geologist and shall be based upon his continuous geologic inspection
during mad construction.
M71'ICN SEMMM AND UNANIADUSLY PASSED: It was moved by Commissioner Stewart and
seconded by Commissioner Young to amend Condition 6 by adding after "The applicant
shall install...'six or more'—standard fire hydrants..." (the rest of the condition
remains the same.
WTICN SDCaMM AND UNANIMJUSLY PASSED: It was moved by Commissioner Perkins and
seonnded by Commissioner Carioo to delete "California Department of Transportation"
in Condition 8 and add 'Department of Public Works, County of Santa Clara'; also
delete "state highway" and "conditions", add after "drainage" 'on Arastradem Road.'
Condition 8 should read: The applicant shall submit, prior. to Final Disc
approval, grading and drainage plans to the Department of Public Works,
County of Santa Clara, for the purposes of evaluating effects on drainage
on Arastradam Road.
MLPICN SEWNMD AND UNANIMNSLY PASSED: It was moved by Cmmuissioner Perkins and
seconded by Commissioner Stewart to add as Condition 9(b) the following:
There shall be a tett foot (10') wide reserve strip, to be held in the name
of the Town, across the southerly end of the Saddle Mbuntain right-of-way
abutting Moan Lane for emergency access Only.
M)PICN SECCMED AND UNANIMDUSLY PASSED: It was moved by Commissioner Young and seconded
by Commissioner Stewart to amend Condition 10 to read as follows:
The Final Map shall prohibit access from the private property bordering
Stirrup Way,between the intersection of Saddle Mountain Drive and Stirrup Way
to Arastradem Road, and along Arastradero RY)ad from the intersection of
Stirrup Way and Arastradem &cad to the westerly lire of the subdivisim.
M=CN SECa= AND FAILED: It was moved by Commissioner Carion and seconded by
Caamissioner Stewart to add as a condition that the subdivider shall extend
Saddle Court to Parcel A to Page Mill Road as per Condition 3 on the Approved List
of Conditions for the Lands of Armes, File #TM 2050-76, dated February 25, 1977.

Cmnnissioner Carico, after the notion was defeated, stated that she wanted it reflected
in the Minutes that she referred to recamendatims made by the Planning OntmissiOn
and on the Approved list of conditions dated February 25, 1977. rAher C Tmissianer5
had mentioned the enormous difficulty of getting a mad through steep terrain, the
fact that it would be an ecological disaster, and that traffic from Page Mill Road
and Highway 280 would be greatly increased.

seconded by Camnissicner Carico to amend Condition 11 by adding the word 'road'
before "barricade" and to add the following sentence: The architectural pillars,

1,MCN SECCNDED AND CARRIED UNANMYMY: It was proved by C<rmi-ssicner Perkins and
seconded by Commissioner Carico that Condition 13 be amended to read as follows:
The applicant shall inQmve the proposed intersection of Stirrup way and
Arastradero Road, including a left hand tum into Stirrup Way for traffic
heading in a westerly direction, and shall remove a portion of the hillside
westerly of the Stirrup Way intersection to the satisfaction of the City
Engineer. The design shall be brought to the Crneni.ssion for their review
prior to the filing of the final map.
MTICN SECONDED AND CARRIED UNFNIMUSLY: It was moved by Csrnissicner Carico and
seconded by CMTnissicner Stewart that an additional condition be added to the list
of conditions. Condition 16 should read:
condition 16: The conservation ease ent shall be located as shown and
delineated m the Tentative Map dated May 23, 1977 so as
to encmpass, in accordance with the General Plan, all the
trees shown thereon.
(a) There shall be no grading and power eguiPmMt, no cutting
of trees over three indhes in diameter, and no hoofed
animals or structures in the conservation ease rent area.
WrICN SEOxIDED AND UNPNIMDUSLY PASSED: It was moved by Comnissioner Perkins and
` seconded by Comd.ssiomr Carico that an additional condition be added to the list
%r of conditions. Condition 17 should read:
Condition 17-
T retention basin shall be constructed and maintained by the Town at the
southerly end of Lots 26 and 27 to acmmiodate the anticipated increase

in run-off from the subdivision.
(a) Access to the retention basin shall be by an easement for ingress and
egress of men and equvpnent from Saddle Mountain Drive, said easement
to be circular to the southerly line of the subdivision.
At 11:30 P.M. it was moved by Commissioner Stewart and seconded by Commissioner Carim
to continue past adjournment until the subdivision is ompleted. The motion passed
by consensus.
MYrICN SECaCM AND UNANIMMELY PASSED: It was moved by Commissioner Stewart and
seconded by Commissioner Perkins to add as Condition 18 the following:
Condition 18: The storm drainage easements on Lots 5, 7, 16 and 27 shall
be fifteen feet (15').
M.YPI(N SEOMDED AND LM=USLY PASSED: It was moved by Commissioner Stewart and
seconded by Commissioner Perkins that condition 15 be amended with an additional
provision (15e) to read as follows:
Condition 15 (e) : The Town shall be paid an in -lieu fee for that part of the
road that is not constructed from the intersection of
f Saddle Muntain Drive and Saddle M Mt= Court to the
southerly boundary line of the subdivision.
MYrICN SEMMED AND FA=: It was moved by Canmissioner Perkins and seconded by
Commissioner Young to add as a condition that: The designated park and recreational
area, until deonstrated otherwise, is considered to be included as part of the open
space and conservation area and shall not be used except as specified by the Oral
Plan until such time as the General Plan is amended.
Camiissioner Carico stated that she wanted the record to show that she was of the
opinion that Lot 8 and 9 as dedicated for recreation is included as open space for
conservation. Mr. Russell cautioned Commissioner carico that if the area is so
dedicated, the Town could be obligated to buy it very soon. He stated, however,
that this particular parcel has never been documented and allocated specifically as
open space in the General Plan.

seconded by Commissioner Stewart to accept Condition 15 (d) as dedicated.

cmud.ssioner Young to recommend approval of Lands of. Saddle Mountain Estates, File
#1M 2060-77 with conditions as mended by the Planning Cmmission.

ABSTAIN: None
C Mr. Russell advised that the representative to the Council meeting re -enforce them-
selves as to why the comber of lots on the arm of the subdivision that goes out
to Saddle Mountain Court. He felt that the Commissioner would be asked this by the
City Council.

Commissioner Stewart told the Cartni.ssioners that the Lands of Berger subdivision
had been denied for the following reasons:
1. it did not conform to the General Plan residential unit No. 2.
2. The development was too intense.
3. Drainage was not in conformance with the General Plan.
4. The Pathway and circulation was not in oonfoxmmm with the General Plan.
He noted that the Planning Commission would be charged to hold a study session and
a public hearing to review the General Plan and the Berger properly to i;ee if
a change is required from what is mcmwended now.

There being no further new or old business, it was moved by Camissioner Stewart
that the meting be adjourned. The meeting was adjourned at 12:15 P.M..
