ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Commissioners Carico, Stewart, Perkins and Young Absent: Commissioner Schick Staff: City Manager Robert Crowe, City Engineer Alexander Russell, Engineer/Planner John Markl, Secretary Susan Buttler B. CONSENT CALENDAR: MOTION SECONDED AND CARRIED: It was moved by Commissioner Carico, seconded by Com- m ssioner oung an passe unanimously to remove Items 2, 3 and 4 from the Consent Calendar. Specifically, the Minutes of June 13, 21 and 22, 1977. MOTION SECONDED AND CARRIED: Commissioner Young moved, seconded by Commissioner Perkins and passe unanimously to approve Item 1, the Minutes of June 8, 1977, thus approving the Consent Calendar, as amended. ` C. PUBLIC HEARINGS: 1. Amendment to Section 9-5.1105 of Ordinance No. 232, titled "Underground Utility Improvements". Discussion began with the City Manager referring the Commissioners'questions to the City Engineer. Commissioner Perkins questioned the fact that this item was not referenced in the Municipal Code and the City Engineer clarified that this is an amendment to Ordinance No. 232. Discussion ensued on the wording of this amendment, specifically, the phrase 'insofar as practical' and the necessity of voltage capability of 34.5 KV or more. The phrase 'insofar as practical' was explained as putting the burden of responsibility onto the subdivider and the 34.5 KV voltage figure was assigned by Pacific Gas & Electric. It was then agreed that Paragraph (d) needed rewording and to return to this item on the agenda when the City Manager had made some changes. Commissioner Stewart raised a question on the approval of the Consent Calendar, namely, the minutes of June 8, 1977. The issue of Lands of Traficanti, File TM #2055-77, was subsequently resolved and the Consent Calendar stood as approved. Mr. Crowe supplied a revised Paragraph (d) and, after much discussion, it was felt that a public hearing was not the place to revise this item. +(QTION SECONDED AND CARRIED: Moved by Commissioner Perkins and seconded by Com- m ssioner oung to return the Amendment to Section 9-5.1105 of Ordinance No. 232, titled "Underground Utility Improvements" to Staff for review and rewording and then bring back for another public hearing. Motion passed by the following roll 4r call vote. Amendment to the General Plan of the Town of Los Altos Hills to include a Scenic Highways Element. The City Manager reviewed the history of this Element, outlining haw a draft had been previously considered, but was never formally adopted. State law requires that the General Plan and its' elements be reviewed annually by the City Council, therefore, this new draft was now before the Planning Commission for their study and recommendations. Clarification on the term 'scenic corridor' was requested by Commissioner Carico and Mr. Mark] defined it as the visible land area as seen from the road. Concern among the Commissioners centered on the effects of this Element on local property owners, on the El Monte and Inter- state 280 areas, and the General Plan itself. MOTION SECONDED AND CARRIED: It was moved by Commissioner Stewart, seconded by Commissioner Car co and passed unanimously to reschedule the 'Scenic Highway Ele- ment' before the new, full Planning Commission, with more information included. 3. Amendment to Chapter 5 of Title 9 entitled "Zoning" of the Los Altos Hills Municipal Code. Mr. Crowe introduced this item, stating that it was a text change to the Condi- tional Use Permit section of the R -A zoning, that it did not designate any certain property; and that the appropriate Conditional Use Permit could then be applied for through the Planning Commission. Commissioner Carico questioned as to public and newspaper notice of this meeting and the City Manager acknowledged that proper notice for a public hearing had been accomplished. Thereafter, the hearing was opened to the public. Mrs. Lou Cox, Conejo Ct., expressed concern, as a representative of 1,000 interested res ents, overt a act that these residents had not been notified by mail of this meeting. She felt that it was a matter of record that these people be notified of any Planning Commission or City Council meeting regarding zoning. Discussion ensued on notification procedures for public hearings and the zoning change issue. It was reiterated that this was not a zoning change and that all pertinent data for a Conditional Use Permit would be submitted with that applica- tion and residents within 300 feet notified as per the Los Altos Hills Municipal Code. Mrs. Lou Cox Conejo Ct., then asked that a copy of a letter introduced June 8, perta m ng to this issue, be entered into the record and that letter is now on file at Town Hall. Mrs. E. Piksdal, Ma dalena, wanted it noted that her feelings were that these peop a shou d lave een notified as promised. Mr. Grover Cox, Cone'o Ct., asked for clarification on text change versus zoning c ange an stated t at a did not think the zoning should be tampered with in any way. Thereafter, discussion continued on the present legality of Town Hall facilities, the necessity of a text change to precede a Conditional Use Permit application, and all solutions to this present legal problem. PLANNING COMMISSION MINUTES - June 29, 1977 Page Three PUBLIC HEARINGS: (Continued) Mrs. Diana Miller, Vista del Valle, hoped that this issue would not lose its perspect ve as tt cou mean urtnging in problems from outside the town and unwarranted court interference. She also felt that budget restraints should be kept in mind when asking for extensive mailings and notices. The zoning issue was once again discussed and the City Manager stated that an excellent defense of our R -A zoning was the allowances made in the Conditional Use section. Mr. L. Giller, Vinedo Lane, questioned this issue being brought before the Planning Comm ssion without the presence of the City Attorney. Commissioner Perkins ascertained from Mr. Crowe that the City Attorney had drawn up the resolution for the text change. It was then discussed as to re- wording the amendment before the Planning Commission to best reflect the wishes of all involved. MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins, seconded by ommtsstoner oun� and passed unanimously to recommend approval, as amended, re - lettering Subsection (k) and (1) and adopting a new Subsection (k), respectively, of Section 9-5.703, Chapter 5, Title 9 of the Los Altos Hills Municipal Code. Commissioner Stewart asked that a note be forwarded to the City Council that perhaps they would wish to remove "Municipal" from Section 9-5.310, "Applica- bility to Public Agencies", thus exempting our Municipal Government from the `yr provisions of this section.
