MINUTES OF A REGULAR MEETING
Wednesday, July 27, 1977

Chairman Stewart called the meeting of the Planning Commission to order in the Council
Chambers of Town Hall at 7:40 p.m.
ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Commissioners Carico, Dochnahl, Kuranoff, Lachenbruch, Perkins, Stewart and
vanTamelen.
Staff: City Manager Robert Crowe, City Engineer Alexander Russell, Engineer/Planner
John Markl, Secretary Susan Buttler.
The Oath of Office was administered by City Manager Robert Crowe to Planning Commis-
sion Members Stewart and van Tamelen.
B. CONSENT CALENDAR:
It was requested by Commissioner Kuranoff to remove Item B-1, Approval of Minutes
of July 13, 1977, from the Consent Calendar for separate consideration.
` MOTION SECONDED AND CARRIED: It was moved by Commissioner Dochnahl, seconded by
�r Commissioner Carico and carried unanimously to approve the Consent Calendar,
specifically:
2. Acceptance for Filing of Tentative Map Application:
(a) Lands of Newman, File TM #2068-77, Natoma Road, Sandis and Associates,
Engineer.
3. Extensions of Time for Tentative Subdivision Maps:
(a) Lands of Gigli, File TM #2057-77, Elena Road, Paul Nowack, Engineer.
(b) Lands of Feistel, File TM #2063-77, Elena and Robleda Road, Paul
Nowack, Engineer.
(c) Lands of Hawley, File TM #2064-77, Wildcrest Drive, Paul Nowack,
Engineer.
(d) Lands of Hutchins, File TM #2053-77, Altamont Road, Edward W. Baca,
Engineer.

Commissioner Kuranoff requested a change to Page Four of the Minutes of July 13,
1977, second motion for Lands of Land Resources: Delete motion passed unanimously,
record his vote as No.
Commissioner Lachenbruch requested a change to Page One, first and second motion:
(1) Moved by Commissioner Perkins - (2) Moved by Commissioner Carico. On Page Two,
the last sentence listed under Mr. Traficanti, applicant, should read: It was
{�. generally hoped the following motion was proposed as an equitable way to resolve
the problem of the costs of water service. On Page Four, third paragraph under
Lands of Land Resources: This path shall be narrowed as required to avoid existing
trees and shall be separated from Arastradero Road a minimum of five feet (51) and
at least ten feet (101), where possible.

Commissioner Lachenbruch also asked for a change on Page Five, under Mrs. E.
Fiksdal, Pathway Committee: Objected to the path recommendation along Moody
Road and expressed Committee approval to meander the pathway keeping a maximum
possible separation from the road's edge.
MOTION SECONDED AND CARRIED: It was then moved by Commissioner Dochnahl, secon-
ded y Commissloner Perkins and carried unanimously to approve the Minutes of
July 13, 1977, as amended.
At 7:51 p.m. the City Manager requested that the Planning Commission adjourn to
an Executive Session.
The Meeting reconvened at 8:23 p.m.
C . PUBLIC HEARING:
1. Lands of Gerard Homes, Inc., File TM #2061-77, Moody Road Road, Paul Nowack,
Engineer, Request for Recommendation of Approval of Tentative Map.
As this was a continued Item from the last Planning Commission meeting, the City
Manager updated the Commissioners regarding the legal liabilities and ramifica-
tions of the previous discussion on the Open Space Preserve and advised that the
area in question, Lot 5, would be deleted from the subdivision. He also intro-
duced the letter from the appplicant, Alan G. Lambert, and discussed the two items
for resolution, namely: (1) Pathways along Moody Road and, (3) Definition of
"minor structures" within the 20 foot flood control setback. Commissioner Perkins
questioned the encroachment of "minor structures" into the 20 foot setback and
not the 100 year Flood Hazard Zone and was assured that this was right. There-
after, the hearing was opened to the public.
Mrs. E. Fiksdal Pathwa Committee, questioned the effect, if any, deleting Lot
wou ave on t e a Jacent pathway and Commi-ssioner Stewart responded that this
matter would be taken care of.
Mr. A. Lambert, Applicant, expressed concern regarding access and use of Lot 5,
as a designated park area, should be limited only to owners of property in that
subdivision and his objection to any form of development that generate noise and
traffic (pedestrian) problems.
Discussion ensued between Mr. Lambert and the Commissioners on the public use of
this area and the policing that would be involved with his proposal. It was thus
determined that limitations would be few, if any, and Mr. Lambert reiterating his
concerns on access through Lot 6.
Mr. G. Smith, Moody Court, questioned access to the existing pathway as the point
of entrance is on private property.
The City Manager stated that an easement exists for that access and Commissioner
Stewart referenced the Adobe Creek C.U.P., which provided for the continuation of
this pathway. Commissioner Lachenbruch was concerned over the recent work done
on the path on Moody Road in that the paved surface of the pathway was continuous
with the vehicular travelled way and very dangerous. Mr. Crave responded describing
the surface as rolled rock and oiled, making it less likely to wash out as had the
previous pathway. Commissioner Dochnahl suggested a berm to break the continuity
of the road and pathway and the City Manager felt that was a good idea.

Mrs. E. Rsdal, Pathway Committee, Pbsponded to Commissioner Lachenbruch's
questions about their recommendation stated July 13, 1977, that he was correct
and the pathway should meander through the boundary between the creek and the
road right-of-way.
The City Engineer raised the issue of delineating a "meandering" path on the
Final Map with the City Manager responding thatthis problem could be solved by
re -wording Condition 17.
Discussion then followed on excessive grading, access onto Moody Road (Mr. Markt
referenced Appendix #10, Traffic Study) Commissioner Kuranoff's questions on
City Council action regarding the General Plan and Open Space Preserve areas and
the contour boundary line. The Commissioners then went through all Conditions,
with the following additions and amendments.
MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins, seconded by
Commissioner Lac en ruc and passed unanimously to amend Condition 17 to read:
Construct a type 1-A native path five feet (5') in width between Moody Road and
creek bank, following a meandering course, taking best advantage of the natural
terrain and maintaining maximum practical separation from Moody Road. Any addi-
tional easement outside of road right-of-way shall be dedicated by the applicant.
Condition 19 was amended by consensus to: The twenty foot (20') residential
structural setback line southerly of the proposed storm drainage easement shall
be shown by the Final Map.
Condition 20 was deleted by consensus.

cated on the Tentative Map, twenty feet (20') southerly of the 100 year Flood
Plane line shall be retained for minor structures, but not structures for human
habitation.
MOTION SECONDED AND CARRIED: Moved by Commissioner Perkins, seconded by Com-
missioner ac en ruc an passed unanimously to add as Condition 24: Appropriate
steps be taken to identify Lots 1, 8, 9 and 12 and that they cannot use Adobe
Creek or the 100 year Flood Plane line as grounds for Variances in the future.
MOTION SECONDED AND CARRIED: Motion by Commissioner Stewart, seconded by Com-
missioner Perkins and passed unanimously to insert as Condition 25: In addition
to access to Lots 4 and 6, there shall be granted an emergency access easement
to the Town between the cul-de-sac and the northerly boundary of Lot 5.
MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins, seconded by
Commiss oner Doc nah and passed unanimously to amend the now numbered Condition
22 to read: Any measures required to improve sight distance visibility along
Moody Road shall be as directed by the City Engineer.
MOTIONSECONDED AND CARRIED: Moved by Commissioner Carico, seconded by Com-
missioner er ins an passed unanimously to remove "Hidden Valley Lane" from
Conditions 14-a, 15 and 16, and the applicant submit a new name approved by
the Fire Marshall before the City Council meeting.

MOTION SECONDED AND CARRIED: It was moved by Commissioner Perkins, seconded by
Commissioner Carico an passed by the following roll call vote to recommend
approval of the Lands of Gerard Homes, Inc., File TM #2061-77, with the deletion
of Lot 5 and Conditions as amended by the Planning Commission.
AYE: Commissioners Carico, Dochnahl, Lachenbruch, Perkins, Stewart and vanTamelen,
NO: Commissioner Kuranoff
MOTIONSECONDED AND CARRIED: Then moved by Commissioner Perkins, seconded by
omni ssioner van ame en an passed unanimously to file a negative declaration
for the Lands of Gerard Homes, Inc., File TM #2061-77.
2. Consideration of Proposed Amendment to General Pian and General Plan Diagram -
Changing Open Space Preserve to Residential One Acre (APN #175-34-7 & 8).
There being no commentary from the general public, the City Manager then proceeded
to summarize by describing the subject property as designated Open Space Preserve,
but not zoned as such. At this time, this oversight could be taken care of by:
(1) Approving the proposed amendment, thus zoning the area Residential One Acre
minimum or, (2) the Town purchasing the 29 acre parcel.
MOTION SECONDED AND CARRIED: It was moved by Commissioner Dochnahl, seconded by
Commissioner Car co ancT passed unanimously to recommend approval by the City
Council of the proposed Amendment to General Plan and General Plan Diagram -
Changing Open Space Preserve to Residential One Acre (APN #175-34-7 & 8).
�r 3. Lands of English Meadows, File C.U.P. #8024-77, Horse Boarding and Riding
Stable, Request for Recommendation of Approval of Conditional Use Permit.
Commissioner Stewart opened the discussion by stating he had visited the facility
and a very diligent effort was being made to comply with the provisions of the
C.U.P. and Commissioner Dochnahl also felt great improvements had been made.
Commissioner Perkins agreed, however, reminding that extensions had been granted
to get the owner on the property and full compliance with specific plans for the
future have to be met. Commissioner Stewart discussed the ownership question and
time schedules, thereafter, the hearing was opened to the public.
J. Cou erus, Page Mill Road, stated that a fantastic job had been done and spoke

J. McGary, Pap Mill Road, hoped the Commissioners would not lose sight that this
was a commercial operation in a rural -residential environment. In living next
door, he was also concerned with dust and fly problems although he realized the
managers/soon to be owners had made many improvements in a short amount of time.
Discussion followed with the Commissioners expressing the desire to meet the needs
of all concerned, however, all that could be done at this meeting was to recommend
that the City Council grant a further time extension.
E. Galeotti a llgant, stated that he would do whatever was necessary, but that
a oto time an money had been spent and he hoped for assurances before he could
go any further.
MOTION SECONDED AND CARRIED: Moved by Commissioner Stewart, seconded by Commissioner
er 5s an passed unanimously to recommend that the City Council grant a time ex-
tension for Lands of English Meadows, L.U.P. #8024-77, until the August 24, 1977
Planning Commission meeting.

QLD BUSINESS:
The City Engineer requested that the amendment to Section 9-4.1105, Underground
Utility Improvement, be agendized for the next Planning Commission meeting,
August 10, 1977.
E. NEW BUSINESS:
1. Proposed attendance at the following meetings: Site Development, Subdivision
Committee, Variance and Permit Commission and City Council.
Discussion centered on the schedules for Commissioners attendance at these meetings
with a consensus vote on a wording change as follows: If you are unable to attend,
please advise the Planning Commission Secretary 24 hours in advance so that she can
find an alternate.
Commentary then followed on the pathway reconstruction on Moody Road with Commissioner
Lachenbruch reiterating his objections on the contiguous pavement effect and its
inherent dangers. It was felt that all Commission Members should inspect this area
and others in the Town and determine if any action could be taken.
There being no further New Business, the meeting adjourned at 11:40 p.m.
