MLL CALL: Present: Camussioners Perkins, Stewart and Dochnahl Also Present: Town Engineer Alexander Russell, Town Planner/Engineer John Markl, Secretary Ethel Hopkins APPRDVAL CF ZMR PES: The Minutes of June 22, 1977 were approved with the consensus of those present after Cannissiomer Stewart stated that he had Conmissioner Carico's permission to f�r rove that the Minutes of June 22 be accepted as submitted. PUBISC HEARINGS: 1. UXOS OF JENRINS, File @BSA 6095-77, Three Ebrks and South Fork .Lane, Paul Ncwack and Associates, Engineer, Eeriest for Recomendation of. Avproval of Building Site Approval Request. Town Planner Markl began the discussion by informing the Oommissicn that the lands of Jenkins would have to be delayed because the Health Deparbrsmt, which had given a tentative approval for the Lands of Jenkins, had then had reservations on the matter of the septic tank for the property. Thereafter, Gmmissioner SbwAat opened the hearing to the public. _ A., k, w_y Boland Von Huene, Applicant, stated that he would agree to have the BSA agendaed for the next meeting. He asxee' the Comdssiomers to articulate their concerns on the property. Camissiener Perkins asked that staff provide justification for violating the Town ordinances on septic tank disposal units; Conmissicmer Doehnahl noted that a resolu- tion would be needed to di the roning4��on the property; and Cormissioner Stewart requested clarification am the conservation reserve area on the Prwerty. M)MC:N SECCNrE:D AND iNANIPIJUSLY APPROVED: It was moved by Commissioner Stewart and seconded by Commissioner Ibchnahl that lands of Jenkins be continued to the next meeting or until the Health Department letter on this matter is received by the Planning Ccimnission. Ccm ssioner Perkins observed that the "Grading and Drainage Plan" accaTwying the HSA map should be labeled a "Conceptual Grading and Drainage Plan" and thereafter opened the hearing to the public. Paul Gerboth,Applicant, noted that Mr. Richardson was the former vanes of the Property. Mr. Ge stated that he was the present owner. Bud Cher, Paul Nowack and Associates noted that the Grading and Drainage Plan was really T8F an rt, an sta t the size of the drainage basin and pipe must still be determined before what is needed can actually be specified. Discussion occurred anmq Cmmissioners and staff on the matter of taking care of drainage from the property in prwdmity to the septic tank leach field. Mr. Garboth stated that the for nr owner Mr. Richardson, who had owned the lot for u�ty years, had taken a series of tests on the amount of drainage occurring in the area. He stated the Ms. Richardson's tests had indicated that the drainage ( would not create a cork in the bottle effect. Mr. Gerboth felt he could meet the fir' requirmrents in the list of conditions. Ccm sioner Stewart asked about undergroumding to be required on Item 2 of the list of conditions. Thereafter discussion was concluded and the following motions passed: MA'ICN SECCiNIED AND ONANIMEMY PASSED: It was proved by Cannissioner Stewart, seconded by Camiissiorer Perkins and unaninously passed to trend Condition 2 to read: All services frau the existing pole shall be undergrounded. The pole, however, shall remain. MMCN SEMCED AND iNANIMMY PASSED: It was moved by Cmmissioner Perkins, seconded by Commissioner Stewart and unaninously passed that Condition 7 should he anended to mad as follows: A store drainage line and appurtenances as proposed by the Conceptual Grading and Drainage Plan dated June 1977 shall be installed subject to the review and approval of the City Engineer prior to the issuance of building permits. Construction of both the pipe structure and fill area shall be completed to the satisfaction of the City Engineer prior to occupancy. MJFICN SECCMED AND MANIMBLY PASSED: It was moved by Caanissioner Stewart, seconded by Cmmissioner Dochnahl, and unan;nv",cly approved to moamend approval of the Lands of Richardson, File #BSA 6097-77with conditions as mended. MMCNS SECCNDED AND PISSED BY CONSENSUS: It was moved by Cmmissioner Stewart, seconded by Commissioner Dochnahl, and passed by consensus that a categorical emmption be filed for the Lands of Richardson, File #BSA 6096-77. It was generally concluded that a swale is without a well defined bank and does not have tributaries, while a creek has a bank and a well defined stream flow.
