MINUTES OF A REGULAR MEETING
Wednesday, September 14, 1977

Chairman Dochnahl called the meeting of the Variance and Permit Commission to order
at 7:00 P.M. in the Council Chambers of Town Hall.
ROLL CALL:
Present: Commissioners Kuranoff, Stewart, and Dochnahl. (Commissioner Kuranoff
substituted for absent Commissioner Lachenbruch.)
Also Present: Town Planner/Engineer John Markl, Secretary Ethel Hopkins
APPROVAL OF MINUTES:
The Minutes of August 24 were corrected as follows: Page 1, on the fourth line
of paragraph one under Lands of Jenkins, "septic tank" should be changed to 'holding
tank'; and on page 2, the second and third lines should similarly be changed - where
141, a "septic tank" is referred to, it should be 'holding tank'.
MOTION SECONDED AND CARRIED UNANIMOUSLY: It was moved by Commissioner Stewart and
seconded by Commissioner Dochnahl that the Minutes of August 24 be approved as
amended.
PUBLIC HEARINGS:
1. LANDS OF DAI File #iVAR. 7043-77, Lot 8, Tract 2093, Arastradero and Horseshoe
Lane, Reguest or ecomnen an on of Approval of Variance Request for Variance
with Setback and Height Limitations.
Town Engineer/Planner Markl discussed pertinent information on the Lands of Dai
variance request, noting that the problems connected with the development of the
lot were its steepness, the location of the dwelling so that a steep driveway
could be avoided off Arastradero Road, and so that the leach field for the septic
tank could be below the house, and so that as many trees as possible could be
retained on the property. There problems were also addressed by the Staff report
dated September 1. Mr. Markl noted further that several -variances were being
sought with the proposed application.
Discussion began among Commissioners on the issues of how fill would be maintained
on the steep slope, the problem of the nearness of the septic tank leach line to
the bank in the event Arastradero Road were widened, the status of the ten foot
wide path easement along Arastradero Road, where access to the lot should be
obtained, and the problem of developing the lot in an architecturally pleasing
way without conflicting with Town ordinances.
Chairman Dochnahl opened the hearing to the public.

Geor a Dai, A icant, spoke for the granting of the variance requests, discussed
I e ea c e%ce at the back of the proposed garage when asked about it by Commission-
ers, and asked for an explanation of the pathway request on the original building
site approval.
Chairman Dochnahl noted that the path easement requested was a part of a main ar-
terial path within the Town's Master Plan.
The public hearing was closed, and the Commission reviewed the conditions. The
following motions were passed:
MOTION SECONDED AND UNANIMOUSLY APPROVED: It was moved by Commissioner Stewart and
seconded by Commissioner Kuranoff that Condition 2 on the list of conditions should
be amended with the following addition: Condition 2(a) Fixed railings will be
required at the outer edges of the north, south, and west sides of the deck. If
the applicant can get a deeded right from the adjacent property owners who have a
right to the private road, he then may have the garage approach above grade on
concrete piers. The design shall meet with the approval of the City Engineer.
V MOTION SECONDED AND UNANIMOUSLY APPROVED: It was moved by Commissioner Stewart and
seconded by Commissioner Dochnahl that a Condition 6 should be added to the list
of conditions: Condition 6. The setback for the leach line extension shall be
fifty (50) feet from the western plan line of the lot.
MOTION SECONDED AND UNANIMOUSLY APPROVED: It was moved by Commissioner Stewart
and seconded by Commissioner Dochnahl that the Lands of Dai, File #VAR. 7043-77,
be recommended for approval with conditions as amended.
ADJOURNMENT:
There being no new or old business to discuss, it was moved by Commissioner Stewart
and seconded by Commissioner Kuranoff that the meeting be adjourned. Chairman Dochnahl
adjourned the meeting at 7:50 P.M..
