MINUTES OF A REGULAR MEETING
Wednesday, September 28, 1977

The meeting of the Variance and Permit Commission was called to order by Chairman
Dochnahl at 6:32 P.M..
ROLL CALL:
Present: Commissioners Stewart and Dochnahl. Commissioner Lachenbruch arrived
at 6:37.
Also Present: Town Planner/Engineer John Markl, Town Engineer Alexander Russell,
Secretary Ethel Hopkins
APPROVAL OF MINUTES:
The Minutes of September 14 were corrected by Commissioner Stewart who requested
that the word "There" in the beginning of the next to the last sentence of the
first paragraph under Lands of Dai be changed to 'These'.
MOTION SECONDED AND UNANIMOUSLY CARRIED: It was moved by Commissioner Stewart
and seconded by Commissioner Dochnahl that the Minutes of September 14 be approved
as amended.
PUBLIC HEARINGS:
1. LANDS OF MARDIROSIAN-THOMAS File qB$A6089-76, Elena Road, John Riley, Engineer,
Requestor ecommen ation o pprova o ui ding Site Application.
Mr. Markt referred Commissioners to his staff report of September 22 for background
information on the subject request, and with a transparency of the map of the parcel
discussed the proposed development of the lot.
Discussion occurred among Staff and Commissioners on the matter of a conservation
easement to be provided on the property, on the provision of a culvert and drainage
ditch for the area that would be adequate, on the nearness of the septic tank drain -
field to the drainage ditch, whether flooding from Vinedo Lane would be taken care
of by the drainage ditch, on whether a path should be requested on the property,
and whether in fact there was a well on the property. There was one further
question by Chairman Dochnahl on dirt piled on the northeast bank of the property.
Thereafter the hearing was opened to the public.
Roger Thomas, Developer, noted that the well was a casing that needed to be blocked.

stating further that the whole lot would be graded.
John Riley, Engineer for the Applicant, questioned requiring a conservation easement

on a building site approval application, and asked for a definition of what was
intended for the conservation easement area.
There was further discussion on what would be permitted in the conservation easement
area and how wide the easement should be.
The public hearing was closed, and the following motions passed:
MOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Stewart and
seconded by Commissioner Dochnahl that Condition 5 should be amended with an
additional subsection (a) to the effect that: The expansion area shall be relocated
so that it is fifty feet behind the graded ditch that is proposed.
MOTION SECONDED AND UNANIMOUSLY CARRIED: It was moved by Commissioner Lachenbruch
and seconded by Commissioner Stewart that Condition 9 be amended with the addition
of section (b): There shall be no grading within the thirty foot (30') dedication
that will interfere with the pathway on the Elena Road frontage.
MOTION SECONDED AND UNANIMOUSLY CARRIED: It was moved by Commissioner Dochnahl and
` seconded by Commissioner Stewart that Condition 10 be amended with the addition
of section (a): The old road along the northeastern line of the property shall be
removed and the ground restored to its original condition.
MOTION SECONDED AND UNANIMOUSLY CARRIED: A conservation easement twenty (20) feet
from the top of the south bank of the creek shall be dedicated to the Town. Activi-
ties in the easement area shall not increase erosion or the flow of sedimentation
and shall preserve the aesthetic qualities of the area. Specific details and
limitations of activities within the easement area shall be worked out at the time
of site development to the satisfaction of the Town and the applicant's engineer.
MOTION SECONDED AND UNANIMOUSLY CARRIED: It was moved by Commissioner Stewart and
seconded by Commissioner Dochnahl that the Lands of Mardirosian-Thomas, File #BSA 6089-77,
be recommended for approval with conditions as amended by the Commission.

Existing Carport.
Mr. Markl discussed the subject request for a variance to accompany the Lands of
Feistel Tentative Map #TM 2063-77. He referred Commissioners to his staff report
of September 21, noting that if this variance were to be granted it should be with
the knowledge that the Planning Commission would favorably consider a conditional
exception that would allow the thirty foot access strip at the edge of the property
to remain at 30 feet.
Commissioner Lachenbruch asked whether the subdivision would yield three units.

Ter Feistel, A plp icant, stated that the request for a variance came as a result
07 eth subdivision proposal, and that this variance was to be processed at no cost
to the applicant in order to bring non -conforming areas into the records of the
Town. He noted that this variance request was processed under a policy formulated
by the Planning Commission.
Commissioner Lachenbruch asked if it were Town policy to grant variances after the
fact, and in reply Mr. Mark] noted the the present policy resulted from a ruling
requested by the previous Planning Commission from the City Attorney.
Commissioner Stewart noted, however, that if the present variance were granted, the
applicant must still come back to the Commission for another variance. It was
the consensus of the Commission that the variance request should be referred to
the Planning Commission.
MOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Lachenbruch
and seconded by Commissioner Stewart that the action on the Lands of Feistel,
File #VAR. 7044-77, be deferred and referred to the full Planning Commission.
ADJOURNMENT:
There being no further new or old business, the meeting of the Variance and Permit
Commission was adjourned at 7:43 P.M..
