Chairman Stewart called the meeting of the Variance and Permit Commission to order at 7:00 P.M. in the Council Chambers of Town Hall. ROLL CALL: Present: Commissioners Stewart, Lachenbruch and Carico Also Present: Town Engineer Alexander Russell, Town Planner/Engineer John Markl, Secretary Ethel Hopkins APPROVAL OF MINUTES: The Minutes of September 28 were corrected as follows: On page 2, the fourth motion should begin 'It was moved by Commissioner Lachenbruch and seconded by Commissioner Stewart that a conservation easement ..... (the rest of the sentence remains the same). The second sentence of the motion should be corrected to read 'Activities in the easement shall not adversely affect erosion, flow, or sedimentation characteristics and shall preserve the aesthetic qualities of the area.' (The remainder of the motion remains the same.) MOTION SECONDED AND CARRIED: It was moved by Commissioner Stewart and seconded by Commissioner Lachenbruch that the Minutes of September 28 be approved as amended. LANDS OF h1AREKFile NVAR. 7045-77, 25121 Tepa Way, Reduction in Sideyard Te ac or ew ons ruction, Request for Recommendation of Approval of Variance Request Town Planner/Engineer John Markl discussed the Lands of Marek variance request, reviewing information presented in his staff report of October 6. A brief dis- cussion between Commissioners Lachenbruch and Mr. Markl established that the residence, constructed in 1959 shortly after setback requirements had been estab- lished by the Town, did not adhere to Town requirements. The public hearing was opened. Donald Marek 25121 Te a Wa A licant, discussed with Commissioners his reasons or requesting t e variance, stat ng that he did plan to landscape near the founda- tion area of his residence to adequately screen the area. He requested clarification of Item 1 of the list of conditions, and that the Commission recommend approval of his variance request. The public hearing was closed, and the Commissioners reviewed the six findings for granting a variance. LANDS OF MAREK, File #VAR. 7045-77: (continued) variance could be met, Commissioner Lachenbruch stated that evidently the Town had "goofed" in permitting the residence to be constructed in violation of set- back requirements, that the topography of the site was such that the lot had to be developed from above, and that it appeared that since no neighbors were present at the meeting or had voiced objections to the proposed variance, that no one in fact did object to the proposed variance. Discussion was terminated, and the following motions were passed: MOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Lachenbruch and seconded by Commissioner Stewart that Condition 1 be amended by changing the second sentence of the condition to read: 'Any new decking shall be limited to the location and size as shown on the September 17th exhibit.' MOTION SECONDED AND UNANIMOUSLY CARRIED: It was moved by Commissioner Lachenbruch and seconded by Commissioner Carico that Condition 2 on the list of conditions be deleted. NOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Lachenbruch and seconded by Commissioner Stewart that an additional Condition be added to the list of conditions: The east side of the structure shall be landscaped to [ screen the visual impact of the structure from Tepa Way. The applicant shall v come to the Site Development Committee with a landscape plan. MOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Lachenbruch and seconded by Commissioner Carico that the variance request for the Lands of Marek, File #VAR. 7045-77, be recommended for approval with conditions as amended. ADJOURNMENT: There being no new business or old business to discuss, the meeting of the Variance and Permit Commission was adjourned by Commissioner Stewart at 7:47 P.M..
