PLANNING COMMISSION v Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF AN ADJOURNED MEETING Monday, October 24, 1977 Reel 64, Side 1, Tr. 1, 111 to End; Side 2, Tr. 2, 001 to 263 The adjourned meeting of the Planning Commission was called to order by Chair- man Stewart at 7:47 P.M.. ROLL CALL: Present: Commissioners Stewart, Perkins, VanTamelen, and Dochnahl (Commissioner Lachenbruch arrived at 7:50 P.M..) Absent: Commissioners Carico and Kuranoff Also Present: Town Engineer Alexander Russell, Town Planner/Engineer John Markl, Secretary Ethel Hopkins OLD BUSINESS Discussion continued on the matter of recommendations on Subdivision Ordinance L No. 232 with the result that the following motions were passed: MOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Perkins and seconded by Commissioner Dochnahl that Section 9-4.603(d), be further amended to read: Gross and net acreage of each individual lot to the nearest hundredth (0.01) of an acre which may be based on the calculation of the gross and net acreage of the entire parcel. It was decided to defer action on the recommended change noted in the Ad Hoc Subcommittee memo of October 4.for Section 9-4.603(f). APPROVED BY CONSENSUS: It was the consensus that Section 9-4.604 of the October 4 memo be amended in the following ways: Paragraph 1, third line, "Town" should be changed to'City'(page two). Page four, first paragraph, change the last word of the sentence from "Town" to 'City.' APPROVED BY CONSENSUS: It was the consensus that the October 4 memo (page three), third paragraph from the bottom of the page, sixth line of the paragraph, after the word "option" that the additional words 'of the apnlicant' should be inserted into the sentence. APPROVED BY CONSENSUS: It was the consensus that the portion of Section 9-4,604, Ordinance No. 232,be deleted through (c) (1) and (2) on Page 26 of the Ordinance and in its place Section 9-4.604 on the October 4 memo from the Ad Hoc Committee be inserted. APPROVED BY CONSENSUS: It was the consensus that Section 9-4.604(c)(3) shall become Section 9-4.604(c) as quoted on page four of the October 4 memo, and that the remaining portions of this section remain unchanged (portions (d) through (i) ). PLANNING COMMISSION MINUTES - October 24, 1977 Page two OLD BUSINESS: (continued) Revisions to Ordinance No. 232: (continued) APPROVED BY CONSENSUS: It was the consensus that the October 4 suggested amend- ment to Section 9-4.701 be adopted. MOTION SECONDED AND UNANIMOUSLY CARRIED: It was moved by Commissioner Lachenbruch and seconded by Commissioner Dochnahl that Ordinance No. 232, Section 9-4.703(d) be amended as follows: Local Road Sixty Feet (60') Local Road, Hillside Fifty Feet (50') APPROVED BY CONSENSUS: It was the consensus of the Commission that the change in Section 9-4.710 proposed in the October 4 memo be accepted. APPROVED BY CONSENSUS: It was the consensus of the Commission that Section 9-4.712 be amended as proposed in the Ad Hoc Committee memorandum with the additional change that the word 'road' be inserted before "maintenance agreement." APPROVED BY CONSENSUS: It was the consensus that a new section entitled 'ARTICLE XV. CONDITIONAL EXCEPTIONS' as proposed by Commissioner Perkins' proposal of October 12, 1977 be added to Ordinance No. 232. All of the content of the October 12 proposal shall be included with the exception of the last paragraph of the (now numbered) Section 9-4.1501. The second section on the `yr page shall also be renumbered Section 9-4.1502. Commissioner Perkins elaborated, in the discussion on the "Conditional Exceptions" chapter to be added, that the kind of exceptions he was referring to were exceptions on road cuts, the number of lots in a subdivision, etc.. Commissioner Van Tamelen had submitted "Notes" on further changes that might be made in Ordinance No. 232, but no further action was taken on changes to Ordinance No. 232. Bud Chor, Paul Nowack and Associates, Inc. contributed to the discussion on pro- pose ordinance changes y comnenti ng t roughout the meeting on issues such as costs incurred in calculating boundaries on sudivisions to the hundredth of an acre, road widths, slope density, etc.. When the business of approving recommended changes had been completed, the discussion turned to how the Planning Commission wished to deal with their recommendations. Mr. Russell stated that Mrs. Carico, who was absent, had asked him to convey to the Commission her feeling that the Planning Commission should hold duly noticed public hearings on the proposed changes in Ordinance No. 232. Mr. Russell, however, further stated that the City Attorney had ruled that neither the City Council nor the Planning Commission are required to hold public hearings on these changes. MOTION SECONDED AND DEFEATED: It was moved by Commissioner Perkins and seconded by Commissioner Lachenbruch that the amended recommendations from the Ad Hoc Committee memorandum dated October 4, 1977 plus the Droposed Article 15 on Conditional Exceptions be recommended to the City Council as revisions to PLANNING COMMISSION MINUTES - October 24, 1977 Page three W4W OLD BUSINESS: (continued) Revisions to Ordinance No. 232: (continued) be enacted on an emergency basis. After the motion was made, there was considerable discussion on whether the Planning Commission was satisfied with the recommendations on road widths for hillside areas and cul-de-sacs. AYES: Commissioners Perkins and Van Tamelen NOES: Commissioners Stewart, Lachenbruch and Dochnahl ABSTAIN: None After the vote the following Commissioners made comments explaininq their no vote on the motion: Commissioner Stewart - felt that the Town could keep the forty foot cul-de-sac and take slope easements and accomplish the same thing as the wider road area would accomplish. Commissioner Dochnahl - voted no because he objected to the cul-de-sac portion of Section 9-4.703(d) being included in the recommended changes. E Commissioner Lachenbruch - explained his no vote by stating that he didn't 4r think the forty foot was adequate for cul-de-sac roads, but this was not the time to change it. MOTION SECONDED AND UNANIMOUSLY CARRIED: It was moved by Commissioner Lachenbruch and seconded by Commissioner Dochnahl that Section 9-4.703(d) should include: Local Road -Sixty Feet (60') Local Road, Hillside - Fifty Feet (50') *This change has been reflected in the motion on Page 2. APPROVED BY CONSENSUS: It was the consensus that the changes recommended in Ordinance No. 232 as amended be sent to the City Council as revisions to be enacted on an emergency basis. These include the October 4 memorandum as revised and the newly proposed Article 15. AWOURNMENT: There being no further business, the meeting of the Planning Commission was adjourned by motion of Commissioner Perkins at 11:25 P.M.. Respectfully submitted, Ethel Hopkins Secretary 4.r
