FROM: Debbie Pedro, Associate Planner-3>j?. 9 APPROVED BY: Carl Cahill,Planning Director C-C� RECOMMENDATION: That the Planning Commission: Forward a recommendation of approval of the lot line adjustment to the City Council, subject to the applicant's submittal of a legal description and plat map (prepared by a registered civil engineer or licensed land surveyor)for each of the-parcels and recordation of the certificates of compliance. BACKGROUND The subject properties are two existing contiguous parcels located on the south side of Old Trace Lane. Each of the properties is developed with single-family homes and accessory structures. Access to both properties is provided by separate driveways off of Old Trace Lane. The applicants are proposing to adjust the boundaries between two parcels of 3.309 acres and 2.427 acres to result in two parcels of 3.283 acres and 2.453 acres respectively. The lot line adjustment is intended to facilitate future construction of a tennis court on Parcel 1 and will result in the conveyance of approximately 1,133 sq. ft. of property from Parcel 2 (27040 Old Trace Lane) to Parcel 1 (27060 Old Trace Lane). In conjunction with the Lot Line Adjustment, the applicant is requesting to vacate an existing ingress/egress easement located within Parcel 2. CODE REQUIREMENTS Review authority for lot line adjustments is outlined in Section 66412(d) of the State's Subdivision Map Act, which states that: "A local agency or advisory agency shall limit its review and approval to a determination of whether or not the parcels resulting from the lot line adjustment will conform to the local general plan, any applicable coastal plan, and zoning and building ordinances. An advisory agency or local agency shall not impose conditions or exactions on its approval of a lot Staff Report to the Planning Commission Lands of Sindhu&Bertrand and Large House LLC 27060 and 27040 Old Trace Lane April 8,2004 Page 2 of 4 line adjustment except to conform to the local general plan, any applicable coastal plan, and zoning and building ordinances, to require the prepayment of real property taxes prior to the approval of the lot line adjustment, or to facilitate the relocation of existing utilities, infrastructure, or easements." Pursuant to Section 9-1.311 of the Los Altos Hills Municipal Code, the City Council shall approve, conditionally approve or deny each application for issuance of a certificate of compliance with the provisions of the Subdivision Map Act of the State of California. The lot line adjustment will be effectuated when a certificate of compliance is recorded for each parcel with the Santa Clara County Recorder's Office legitimizing the newly created lot lines. Zoning and General Plan Consistency Staff has reviewed the proposal and finds it to be in conformance with the development standards in Title 10, Chapter 1, Article 5 of the Los Altos Hills Zoning Code with regard to area, coverage, height, and setback limitations. Existing development on both properties will not exceed the MDA and MFA allowed after the lot line adjustment. In addition, no existing structures are located within the vicinity of the common property _ Staff Report to the Planning Commission Lands of Sindhu&Bertrand and Large House LLC 27060 and 27040 Old Trace Lane April 8,2004 Page 3 of 4 line and no structures will encroach within the setbacks as a result of'the lot line adjustment. Furthermore, the General Plan land use designation of both properties will remain as R-A (Residential—Agricultural) and the net acreage of both properties will not fall below 1.0 acre. Ingress/Egress Easement on Parcel 2 In conjunction with the lot line adjustment, the applicant is requesting to vacate a 35'W x 380'L ingress/egress easement located within parcel 2. The subject area is also the location of several other easements including: P.U.E., S.D.E., S.S.E., and P.H.W.D.E.. The proposal would only affect the ingress/egress easement and all other easements within the area will remain in effect. The ingress/egress easement was originally intended to serve five lots (Tract No. 7482, Featherhill Farms, 2/15/84). The subject ingress/egress easement is now obsolete as the five original lots have been merged into two lots, each with its own driveway access from Old Trace Lane (Lands of Sindhu & Bertrand and Large House LLC). The means of access to both properties will not be altered as a result of the lot line adjustment or vacation of the ingress/egress easement. CONCLUSION The proposed lot line adjustment will result in lots which remain consistent with the Town's Zoning Code and the purpose and intent of the General Plan. No existing structures on the properties will be rendered non-conforming as a result of the lot line adjustment. Upon approval, the applicant must submit to the Town a copy of the signed and notarized grant deeds, with legal description and plat exhibits prepared by a licensed surveyor or civil engineer, and the Town will prepare certificates of compliance for recordation. CEOA STATUS The project is categorically exempt under Section 15305(a) "Minor Alterations in Land Use Limitations" of the State CEQA Guidelines. ATTACHMENTS 1.
