HomeMy WebLinkAbout58-95 • • • • RESOLUTION NO. 58-95 A RESOLUTION ADOPTING THE SANTA CLARA COUNTY HAZARDOUS WASTE MANAGEMENT PLAN BY REFERENCE AS THE TOWN'S HAZARDOUS WASTE MANAGEMENT PLAN WHEREAS, in August of 1991, Santa Clara County adopted a Hazardous Waste Management Plan to guide the siting of hazardous waste residual repositories, incinerators, treatment, recycling, and other disposal sites, along with an Interjurisdictional Agreement (IJA) specifying the siting responsibilities of all counties in the Bay Area; and WHEREAS, the Town of Los Altos Hills and 15 other cities within Santa Clara County were and are participants in the preparation and implementation of the County's Hazardous Waste Management Plan; and WHEREAS, on December 13, 1994, the State Department of Toxics Substances Control (DTSC) approved the County Hazardous Waste Management Plan (CHWMP) and the associated IJA; and WHEREAS, pursuant to State legislation, each city within the County must, within 180 days of receiving notification of the approval of the CHWMP, either adopt a Hazardous Waste Management Plan for that city, or incorporate applicable portions of the County Plan into the city's General Plan, or enact an ordinance requiring that all applicable development decisions regarding siting for hazardous waste facilities be consistent with the approved County plan; and WHEREAS, Santa Clara County has provided notification of the approval of the CHWMP in a letter dated January 27, 1995, and requested that cities in the County take action accordingly. NOW, THEREFORE, the City Council of the Town of Los Altos Hills does hereby RESOLVE that the Town adopts, by reference, the Santa Clara County Hazardous Waste Management Plan, dated August, 1991, as the Town's guide for siting hazardous waste facilities, and further consents to the Interjurisdictional Agreement between Santa Clara County and other Bay Area counties.
