MINUTES OF A REGULAR MEETING

Chairman Perkins called the meeting of the Variance and Permit Commission to
order at 7:07 P.M. in the Council Chambers of Town Hall.
ROLL CALL:
Present: Commissioners Perkins, VanTamelen, Lachenbruch kins
Also Present: Town Planner/Engineer John Markl, Secretary Ethel Hop
APPROVALOF MINUTES* -
Commissioner Perkins requested that the first sentence of paragraph two. Page
one under Lands of Papoulias,be deleted and the following added in its place:
In the discussion between Commissioners and applicant, it was em-
phasized by the Commission that the bases for granting a variance
4,V are speci fi ed by the State. Si x State requi revents must be demon-
strated. One of these ' hardship I had not been demonstrated. The
final sentence beginning "Also cited was Resolution No. 694...
remains as written.)
MOTION SECONDED AND CARRIED: It was moved by Commissioner VanTamelen and seconded
by Commissioner Perkins that the Minutes of February 22 be approved as amended.
Voting for the motion were Commissioners VanTamelen and Perkins. Commissioner Lach-
enbru�h abstained.

Mr. Markl discussed the variance request as detailed in his Staff report dated
March 1, 1978. He drew particular attention to the problem of providing both an
easement for future road widening and a path easement along Elena Road. He stated
that construction difficulties must be emphasized.
Discussion began with Commissioner Lachenbruch asking whether a conservation
easement existed along the southerly property line and Commissioner Perkins asking
whether the six conditions for granting of a variance had been complied with.
Mr. Markl noted that the Open Space -Conservation Easement had been designated
by the General Plan; and that due to the size and shape of Mr. Duwe's lot,
+4W a ha dship did exist. Other limiting factors were the leach field at the back
of trhe property and the existing drainage swale that held a fair amount of ground
water at certain times of the year. Thereafter, the hearing was opened to the public.

request. ana Rs pTlage with the six conditions for granting of the variance.
He stated that he would not object to a path on Elena Road, but would not like
to see the mature trees removed in the event that Elena Road is widened.
Discussion continued on the virtues of retaining the path easement on Elena Road,
whether provision should be made for the widening of Elena Road, and whether a
conservation easement should be required on Dr. Duwe's property. (The Commission
felt that the conservation easement on Dr. Duwe's property could be continued
onto the Packard property if that property ever came in for subdivision.)
Dr. Duwe expressed the desire to retain a fence and a vegetable garden in the
conservation easement area, and it was the feelinq of the Commissioners that
these uses could be accommodated. At any rate, it was felt that activities in
the conservation easement area should be worked out by Staff. Discussion was
concluded, and the following motion passed:
MOTION SECONDED AND UNANIMOUSLY PASSED: It was moved by Commissioner Perkins,
seconded by Commissioner Lachenbruch, and passed by unanimous vote that the
Lands of Duwe, File #VAR. 7046-77, Variance Request be recommended for approval
subject to the following conditions:
1. The reduction in structural setback for the proposed garage addition,
as shown by the plot plan and topographic survey dated June 3n, 1978,
shall be limited to the following:
(a) From 30 feet to 20 feet for sideyard setback from the southerly
property line common with Lands of Packard.
2. Dedicate a twenty foot (20') wide Conservation Easement extending from
the southwesterly corner of the property for a distance of one hundred
eighty feet (180'), easterly along the southerly boundary line.
3. Dedicate an easement ten feet (10') wide along the southerly side of
Elena Road for path purposes only.
Conditions 2 and 3 on the list of recommended conditions were deleted.
ADJOURNMENT:
There being no further new or old business, it was moved by Commissioner VanTamelen
and seconded by Commissioner Lachenbruch that the meeting be adjourned. Adjourn-
ment occurred at 7:47 P.M..
