MINUTES OF A REGULAR MEETING
Wednesday, July 12, 1978

Chairman Mary vanTamelen called the Regular Meeting of the Variance and Permit Commission
to order at 6:31 PM In the Council Chambers of Town Hall.
A. ROLL CALL:
Present: Corm lssloners vanTamelen, Dochnahl and Lachenbruch.
Staff: City Planner/Engineer John Markt and Deputy City Clerk Susan Buttler.
B. APPROVAL OF MINUTES:
PASSED BY CONSENSUS: That the Minutes of May 10, 1978 be approved as submitted by
the Commissioners present and with the consent of absent members.
C. PUBLIC HEARINGS:
I. LANDS OF JONES, File VAR #7053-78, 14486 Llddicoat Circle, Reduction In Setback
for Pool, R.L. Stanley, Engineer - Request for Recommendation of Approval of
Variance Request.
Mr. Markt referenced his staff report dated July 8, 1978, outlined history of the
property and Introduced slides of the area. Commissioner vanTamelen questioned whether
pool consideration had been done during the Initial Building Site Approval process,and
Commissioner Lachenbruch suggested that reference to Variance restrictions were only
necessary In the report when they did exist.
Mr. Jones, Applicant, offered reasons for the proposed site being the only desirable
and practical location.
Discussion then followed on problems posed by the placement of the retaining wall and
methods of preventing entry from that side of the pool.
MOTION SECONDED AND CARRIED: Moved by Commissioner Lachenbruch, seconded by Commis-
sloner Dochnahl and carried unanimously to add as new Condition 4:
4. A detailed plan, showing the following safety .features, shall be presented
at time of Site Development meeting:
(a) A hand rail to be Installed along the five foot (5') bond beam side
of the pool (along the waterline).
(b) The pool shall be completely enclosed by fencing to prevent unauthor-
ized entry.
(c) Provisions shall be made to discourage jumping Into the pool from
40 above the bond beam area.

MOTION SECONDED AND CARRIED: Moved by Commissioner Lachenbruch, seconded by Commis-
sioner vanTamelen and passed unanimously to add the word "meeting" after "Site Develop-
ment" on Conditions 2 and 3.
MOTION SECONDED AND CARRIED: Moved by Commissioner Lachenbruch, seconded by Commis-
sioner Dochnahl and carried unanimously to recommend approval of LANDS OF JONES, File
VAR #7053-78, with conditions as amended.
2. LANDS OF DEVEZE. File BSA #6107-78. Moody Road, Paul Nowack, Engineer - Request
for Recommendation of Approval of Building Site Approval Request.
Prior to Introduction by the Planner/Engineer, Commissioner Lachenbruch cited his
concerns relative to: (1) The inability of this Request to come under routine matters
as normally handled by the Variance 8 Permit Commission; (2) Provisions for architec-
tural and structural constraints that may be utilized; (3) Methods of alerting property
owners of marginal building sites of the tax advantages of dedicating Open Space to the
Town; and, (4) The need to establish guidelines for future consideration on similar
borderline requests.
Mr. Sheble, Owner, felt that the layout of the property was deceiving and that the
house being considered would resolve many of problems.
Discussion followed on the steepness of the terrain, retaining wall designs and dlrec-
tlon to Staff to try to advise on certain tax advantages as applicants' requests may
warrant.
MOTION SECONDED AND CARRIED: Moved by Commissioner Lachenbruch, seconded by Commis-
sioner Dochnahl and passed unanimously to agenda LANDS OF DEVEZE, File BSA #6107-78,
before the full Planning Commission because It is a matter of considerable general
Importance to the Town due to the continual development within the Town of marginal
properties. Further requested was that Staff provide opinions relative to architectural
constraints on the size and placement of structures that might be built and that they
advise of reasonable architectural controls that might be Imposed.
F. ADJOURNMENT:
There being no further new or old business to discuss, the meeting was adjourned at
7:32 PM by Commissloner vanTamelen.
