MINUTES OF A REGULAR MEETING
Wednesday, July 12, 1978

Chairman Michael Stewart called the Regular Meeting of the Planning Comm lsslon to order at
7:49 PM In the Council Chambers of Town Hall.
A. ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Chairman Stewart, Commissioners Carico, Dochnahl, Lachenbruch and vanTamelen.
Absent: Commissioner Kuranoff.
Staff: City Manager Robert Crowe, City Planner/Engineer John Markl and Deputy City
Clerk Susan Buttler.
B. CONSENT CALENDAR:
Commissioner Lachenbruch requested a change to Page 3 of the Minutes of June 28, 1978,
third paragraph from the bottom, third and fourth lines from "between neighbors" to
4 "with the owner".
MOTION SECONDED AND CARRIED: Moved by Commissioner Dochnahl, seconded by Commissioner
Carico and passed unanimously to approve the Minutes of June 28, 1978, as amended above.
C. PUBLIC HEARINGS:
LANDS OF STAMSCHROR-SILVER, File C.U.P. #8029-78. 25231 La Rena Lane, Request for
recommendation of Approval of Conditional Use Permit for Secondary Dwelling with-
out kitchen facilities - continued from June 28.
The City Planner/Engineer reiterated many of the concerns previously discussed by the
Commission and Council relative to the use of the existing secondary dwelling, there-
after, Chairman Stewart advised of his discussion with the City Attorney and questioned
the Applicant about the opening under the wet bar.
Mr. Stamschror. Applicant, noted that it was for the installation of a small refrigerator.
MOTION SECONDED AND RESCINDED: Moved by Chairman Stewart, seconded by Commissioner
Dochnahl and rescinded after further discussion to require as a new Condition: A fence
shall be installed along the property line adjacent to O'Keefe Lane and along the maca-
dam of O'Keefe Lane.
Consensus of the Commissioners was to the necessity of preventing separate access to
the secondary dwelling with a variety of input on the best methods of control.
MOTION SECONDED AND CARRIED: Moved by Commissioner Lachenbruch, seconded by Chairman
Stewart and carried unanimously to amend Condition 1. (e) to read: Remove driveway off
`, O'Keefe Lane and landscape driveway area. The applicant shall plant a minimum of five
trees of a type of their selection, ten gallon in size, between the cottage and O'Keefe
Lane. The location of each tree shall be acceptable to the Town Building Official and
the planting accomplished prior to the final inspection for the remodeling of the guest
cottage. These trees shall be maintained through September, 1980 and a deposit of
$500.00 made with the Town to insure such maintenance.

MOTION SECONDED AND CARRIED: Moved by Commissioner Lachenbruch, seconded by Commis-
sioner vanTame len and passed unanimously to add as new Condition 2: No vehicular
access to the property will be permitted off O'Keefe Lane.
MOTION SECONDED AND CARRIED: Moved by Commissioner Lachenbruch, seconded by Ccmmis-
stoner Carl co and carried unanimously to add as new Condition 5: It shall be the re-
quirement that the floor area be reduced to comply with Section 9-5.214 of the Municipal
Code and acceptable architectural plans for the achievement of this be submitted to the
Town staff prior to the issuance of the Use Permit.
MOTION SECONDED AND CARRIED: Moved by Chairman Stewart, seconded by Commissioner
Dochnahl and passed unanimously to add as new Condition 4: A covenant shall be recorded
prior to the property being sold or prior to final Inspection of the remodeling to serve
as constructive notice to prospective buyers.
MOTION SECONDED AND CARRIED: Moved by Chairman Stewart, seconded by Commissioner
Dochnahl and carried unanimously to add as new Condition 6: Any structural modification
to the secondary dwelling shall be cause for review of this Conditional Use Permit.
MOTION SECONDED AND CARRIED: Moved by Commissioner Dochnahl, seconded by Commissioner
Lachenbruch and carried unanimously to recommend approval for the LANDS OF STAMSCHROR-
SILVER, File C.U.P. #8029-78, subject to conditions as amended and with the following
Note to Council: These conditions are necessary to assure compliance with the pro-
visions of Section 9-5.1107 (a) of the Los Altos Hills Municipal Code when Code pro -

the precedence that has been established for similar uses within the Town.
Commissioner Lachenbruch then cited loopholes In Town Ordinances and offered suggested
changes for discussion at the next Planning Commission meeting. For clarity, these
recommendations may all be found under NEW BUSINESS at the end of this meeting.
2. LANDS OF TRAFICANTI, File TM #2083-78, Voorhees Drive, Edwin H. Smith, Engineer,
Request or ecommen a ono pproval of Negative Declaration and Tentative Map -
Continued from June 28.
Commissioners first discussed the original map, leaving the placement of Voorhees
Drive as It is, and then the revised map with re -alignment of Voorhees Drive.
Mr. Traficanti, Applicant, spoke for those sharing this private road as wishing to
leave It undisturbed and that there was sufficient building room for each lot with
this proposal.
Mrs. Gottlieb, Pathway Committee, requested a dedicated pathway easement where the
permissive use now exists In order to provide a safer route to St. Nicholas School.
Considerable discussion then followed with Mr. Traficanti and Mrs. Gottlieb on the
historical use of this permissive pathway, the need to establish links If dedicated
now, privacy Infringements and presentation of signed document by those living on
Voorhees Drive against the pathway dedication.
MOTION SECONDED AND CARRIED: Moved by Commissioner Dochnahl, seconded by Ccmntssloner
[ Carico and passed by the following roll call vote to limit consideration to the first
Tentative Map submitted, leaving Voorhees Drive where it Is.
AYES: Chat man Stewart, Commissioners Carico and Dochnahl.
NOES: Commissioners Lachenbruch and vanTamelen.
ABSENT: Commissioner Kuranoff.

MOTION SECONDED AND CARRIED: Moved by Commissioner Dochnahl, seconded by Chairman
Stewart and carried unanimously to recommend adoption of a Negative Declaration,
LANDS OF TRAFICANTI, File TM #2083-78.
PASSED BY CONSENSUS: To remove the word "final" at the end of Condition I. (b) and
finish this sentence with: minimum standards in the development of this subdivision.
PASSED BY CONSENSUS: To change "Lot 2" in the last sentence of Condition 3. to read:
Lot I.
PASSED BY CONSENSUS: To add In the second sentence of Condition 6., after "No. 232":
and 9-4.1501 of Ordinance No. 239.
PASSED BY CONSENSUS: To amend the first sentence of Condition 7, "Lot 1" to: Lots
I and 2.
MOTION SECONDED AND CARRIED: Moved by Chairman Stewart, seconded by Commissioner
vanTamelen and carried unanimously to amend Condition 8 as follows: The free-standing
kitchen located adjacent to the secondary living quarters shall be modified to not
contain kitchen facilities, 220 wiring or related plumbing, and the overhead structure
connecting the main structure shall be removed prior to the filing of the Final Map.
MOTION SECONDED AND FAILED: Moved by Commissioner Dochnahl, seconded by Chat man
Stewart and failed by the following roll call vote to eliminate Condition 10. (a) and
W.
AYES: Chairman Stewart and Commissioner Dochnahl.
NOES: Commissioners Carico, Lachenbruch and vanTamelen.
ABSENT: Commissioner Kuranoff.
Mrs. Struthers Pathway Committee, spoke In favor of the dedicated pathway along
Voorhees Drive.
Mrs. Traficantl, Applicant, stated that the St. Nicholas policy did not favor the
children entering the School from this direction and the steepness of the terrain
as not being conducive to the proposed pathway.
MOTION SECONDED AND FAILED: Moved by Commissioner Carico, seconded by Commissioner
vanTamelen and failed by the following roll call vote to add the following new
Condition: Dedicate a ten foot (101) pedestrian easement from Lands of Clausen along
the southwesterly side of Voorhees Drive to the terminus of the bulb.
AYES: Commissioners Carico and vanTamelen.
NOES: Chairman Stewart, Commissioners Dochnahl and Lachenbruch.
ABSENT: Commissioner Kuranoff.
Mrs. Incerpl, Applicant, cited the problems with the proposed pathway traversing the
creek and Infringing on residents' privacy.
MOTION SECONDED AND CARRIED: Moved by Chairman Stewart, seconded by Commissioner
Lachenbruch and carried by the following roll call vote to amend Condition 10. to
read: Dedicate a ten foot (10') pedestrian easement within the right-of-way of
Voorhees Drive from the Lands of Clausen to the terminus of the bulb. If there has
been no connection from the bulb of Voorhees Drive to Hilltop, this easement Is to
be abandoned when Barley Hill Road joins Voorhees Drive.

MOTION SECONDED AND CARRIED: As It was past the hour of adjournment, It was moved by
Chairman Stewart, seconded by Commissioner Carico and carried unanimously to continue
the meeting until the finish of the remaining Agenda Items (LANDS OF BERRY HILL -
continued to the next meeting at the request of the Applicant).
MOTION SECONDED AND CARRIED: Moved by Comm lssloner Lachenbruch, seconded by Chairman
Stewart and passed unanimously to recommend approval for the LANDS OF TRAFICANTI, File
TM #2083-78, subject to conditions as amended.
3. LANDS OF BERRY HILL, File TM #2086-78 - Continued at the request of the Applicant
to the meeting of July 26, 1978.
OLD BUSINESS:
I. Re -submitted Model Community Noise Ordinance, Request for Recommendatlon of
Approval of Updated Noise Ordinance.
Mr. Gregorwich, Chairman/Noise Abatement Committee, advised of the background on
discussion at the committee level of the proposed changes and the sources from which
the data was complied.
Comments then centered on specifics of the term "airplane", County regulations and
their possible inclusion and motor vehicle noise levels along I.S. 280 versus through-
out the balance of the Town. Determination was to re -schedule this item for discus-
slon at the next Commission meeting and Chairman Stewart designated Commissioners
Carico and vanTamelen to work with the Noise Abatement Committee In the meantime.
NEW BUSINESS:
Commissioner Lachenbruch advised the Commission of the scheduling of the LANDS OF
DEVEZE Building Site Approval Request before the full Planning Commission by the
Variance 8 Permit Commission earlier In the evening due to the complex nature of this
request and requested that Staff advise applicants In the future of the tax advantages
of dedicating Open Space in lieu of subdividing marginal properties.
Ordinance revisions suggested by Commissioner Lachenbruch to be discussed at the next
Planning Commission meeting under Old Business:
Section 9-5.702-03 (k) - add the following: Any vehicular access to secondary
dwellings shall be by a common driveway with the primary dwelling.
Section 9-5.214 Dwelling, secondary - put a period after "feet" on the sixth
line (deleting "or forty (40%) percent of the gross floor area of the primary
dwelling, whichever is greater.)
Ordinance No. 239, Pg. 5, Section 9-4.603 (a), second line - replace "boundaries"
with "within its net acreage".

Ordinance No. 239, Pg. 6, Section 9-4.603 (c), second line - replace "within
which no straight line exceeding 350 feet can be drawn" with "within a circle
no greater than 350 feet In diameter".
There being no further new or old business to discuss, Chairman Stewart adjourned
the meeting at 12:31 A.M.
