ROIs, CALL: Present: Cafmissioners Neves, vanramelen, Dochnahl, Kuranoff, Chairman Stewart Absent: Commissioners Carico and Iachenbruch Also Present: Consulting Engineer/Planner John Markl, Secretary Ethel Hopkins OONSEN1' CALENDAR: Item 1, the Minutes of September 27, was withdrawn from the Consent Calendar and corrected as follows: (a) Page three, paragraph two, amend the third line of the remarks made by Mildred Saviano to real: for various activities and trespassing such as parking by Foothill College students.' (b) Page three, item 1 of the motion on the Lands of Yelton should be corrected to read: 'The request for two conditional exceptions and a variance is not justified.' (c) Page three, item 3 of the same motion should be amended to read: 'The site is not physically suitable because of shape, drainage and mise problems for the type of development planned.' MIPION SECONDED AND APPROVED UNANIMROSLY: It was moved by Commissioner Dochnahl and seconded by Cammissioner Reeves that the Minutes of September 27 be approved as amended. M7TION SECONDED AND APPRNED UNANIMOUSLY: It was moved by Commissioner Dochnahl and seconded by Ccnmissioner vanTamelen that the remaining item on the Consent Calendar be approved, naively: Acceptance for Filing of Tentative Map: LANDS OF DAWSON, File #'TM 2094-78. PUBLIC HEARINGS: 1. LANDS OF HORTON, File #TM 2066-77, Altamont Road, Sandia & Associates, Engineer 13.66 Acres Gross, 11.80 Acres Net, 6 Lots, 31.5% Average Slope, Request for Reocnnendation of Approval of Negative Declaration and Tentative Map John Markl discussed the subject request as covered by his staff reports of Septem- ber 6 and October 5, with particular emphasis placed on the results of the recent field trip, pathways existing and proposed, the size and shape of the various lots in the subdivision, landscaping, tree preservation, slope density and dedication of open space. plANNING COMQISSION KmIPFS - October 11, 1978 L Page two PUBLIC HEARINGS: (continued) 1. LANDS OF HORION, File #TM 2066-77: (continued) Commissioners had a short discussion on the developrent problems with lots 2 and 6 of the subdivision, and the hearing was then opened to the public discussion. Alan Lambert, 141 First Street, Los Altos, Developer, discussed the development of Lot 2 the location o the driveway, spoke against a pathway along Versailles Court, requested that Condition 14 be deleted, and requested that Condition 16(d) be deleted in view of the proposed dedication of open space. Tim Sandis Sa=s & Associates 812 Castro Street, Nbuntain View, Engineer, commended the Staff for the thoroughness of the staff report, stated that Lot 2 was not a poor lot for development, enphasized that the alternate route for the pathway was prefer- able to the Proposed pathway because the Pathway Proposed for the subdivision would obstruct privacy, and stated that conditions inposed for the subdivision were reason- able and acceptable. In response to Commissioner van'Iamelen's request that the lot line on Lot 2 be moved, Mr. Sabdis stated that the lot line had been moved somewhat; and in response to Comnissioner Stewart's inquiry on available drainfield area on Lot 3, Mr. Sandis stated that Int 3 would meet the requirements of site development. Fran Stevenson, Pathomy Committee, spoke for retaining the pathway as proposed on the list of conditions. far Nancy Horton 1940 Dry Creek Ldoad San Jose, noted that they planned to use the Pri- vate water line on the property for landscape purposes. Carol Gottlieb, speaking as a citizen and as a meter of thePathwa Committee, said s suppo proposedpathway or the Lands o Horton, but that she wanted the path to be constructed two or three feet frau the roadway area with header boards and Neary fines. She asked that conditions be clarified so that path areas would also be separated frau driveway and road areas. Alan Lambert stated that path construction with Neary fines would be no problan; however, header boards could break and injure horses. Again, he stated his preference for the alternate plan for the pathway, citing that with the latter plan, privacy would be maintained for property owners. Mrs.Mary Stutz, Pathway Committee, discussed the proposed pathway on the Catholic urc property. Considerable discussion was given by Commissioners and the public to the matters of whether horses should be permitted on Versailles Court, whether a more appropriate name could be suggested by the Historical Society for Versailles Court, landscaping for erosion control, the desirability of the alternate path plan, and the way in which the pathway could be routed around the water tower. The public hearing was closed, and Commissioners began a review of the Negative Declaration and list of conditions. M7TION SECONDED AND PASSED UNANIyDUSLy: It was moved by Commissioner Dochnahl and seconded by Commissioner vanTamelen that a Negative Declaration be recommended for the Iands of Horton, File #TM 2066-77. 16, kw PLANNING Ca4USSION MINL= - October 11, 1978 Page three PUBLIC HEARINGS: (continued) 1. LANDS OF HORTON, File #TM 2066-77: (continued) The following conditions were amended or added to the list of conditions: Condition 5: PASSED By CONSENSUS: It was moved by Chairman Stewart and passed by consensus that Condition 5 be amended with the addition of subparagraph (a): Special attention shall be given to the proposed storm drain pipe within the ten foot (10') storm drain easement over Int 3. Condition 8: PASSED BY CONSENSUS: To amend the first line of Condition 8 to read: 'The applicant shall install one additional standard fire hydrant...' (The rest of the sentence remains as written.) PASSED BY CONSENSUS: It was the consensus of the Connission to delete Condition 8(c) on the October 6 list of Staff Suggested Conditions and to add instead the following Condition 8(c) taken from a mmorandue on October 11 and further amended by the Planning Comiission: Condition 8(c) The emergency access easement over Iot 6 from Versailles Court to Chaparral Way shall be improved without macadam to the satisfaction of the City Engineer, and chained barriers installed in the location shown on the tentative map to prevent non-energency vehicular access. Condition 11: MOTION SECONDED AND CARRIED: It was moved by Commissioner Reeves and seconded by Ommissioner Dochnahl to leave Condition 11 as written. All Commissioners voted for the motion except Commissioner Kuranoff who voted against the motion. Condition 14: PASSED BY CONSENSUS: To delete Condition 14 as written and add instead: Parcel A is not a building site. Condition 15: (Additional condition to be added - all other conditions after to be renumbered.) PASSED BY CONSENSUS: To add as Condition 15 the following from the October 11 inBm to the Planning Commission: A private road maintenance agreement shall be established which runs with the land and is acceptable to the City Attorney. This agreement shall be provided to the City Attorney for review and approval prior to the filing of the final map (Section 9-4.712(b), Ordinance No. 239). Condition 16: (Additional condition) PASSED By CONSENSUS: To add as Condition 16 the following: The plans for slope planting and landscaping of the existing cut and fill slopes of Versailles Court from Altamont Road to Ste. 8.+00, as shown by the tentative map, shall be presented to the Planning Cmmission and Environmental Design Caamittee prior to the approval of the final map. Condition 17: (Additional condition) PASSED BY CONSENSUS: To add as a condition: unange the name o e private road Versailles Court to one that reflects the historic or aesthetic aspects of the area. The new name shall be reviewed by Staff. Condition 18: (Additional condition) NOTION SECONDED AND CARRIED: It was moved by Commissioner Kuranoff and seconded by Ca ssioner Reeves to add as Condition 18: The cul-de-sac construction for Versailles Court shall PLANNING CCt4IISSION MINurES - October 11, 1978 Page four PUBLIC HEARINGS: (continued) 1. LANDS OF HORIGN, File #TM 2066-77: (continued) Condition 18: (continued) utilize a shortened cross-section road curb, similar to that used by Hillsborough, for the purposes of narrowing the total pavement width approximately two feet; and further, lampblack shall be used to color the concrete so that it matches the asphalt as closely as Practical. Voting for this motion were CmTnissioners Stewart, Reeves and Kuranoff; against it, Ocxmmissioners vanTamelen and Dochnahl. Condition 15: Commissioner Kuranoff voiced his objection to the infringement of T6c o r privacy that would occur with the proposed pathway, and noted that Conditions) a more or less de facto pathway was already in existence on the Lands of the Catholic Church. He suggested that a good solution would be to require an easement along the water tank, and with minor grading to have a path on the Sisters' property rather than a path on three sides of the Horton property. MWIQN SECONDM AMID FAILED: It was moved by Commissioner Kuranoff and seconded by Commissioner vanTamelen to add as a pathway condition: Dedicate a ten foot (10') easement on Lot 1 only as required to by- pass the water tank at the property line, and dedicate a ten foot (10') easement along the northerly property line of Lot 2. Voting for the motion was Commissioner Kuranoff; against it, Commission- ers Stewart, Reeves, vanTamelen, and Dochnahl. PASSED BY EDNSENSUS: To amend the first sentence of Condition 15 by adding 'as shown by Appendix #10.' to the first sentence of the heading on Condition 15. MOTION SECONDED AND PASSED BY UNMDUUS VOTE: It was [moved by Commissioner Dochnahl, seconded by Commissioner Stewart to rend approval of the Lands of Horton, File #TM 2066-77 with conditions as amended. At 10:07 p.m. a short recess was called; the meeting was resumed at 10:23 p.m.. OLD BUSINESS: 1. Arastradero Road Improvement Project: Commissioner Kuranoff informed the Planning Commission of his efforts to meet with Palo Alto officials on the Arastradero Iniad Project, noting that Planning Commission members and interested townspeople had been invited to the public hearing to be held by the Planning Commission of Palo Alto at the City Hall in Palo Alto on Octo- ber 18 at 7:30 p.m.. He stated that a staff report would be ready on October 13, and then discussed plans by Santa Clara County to construct a bicycle and pedestrian path and a bridge on Arastradero Road. A short discussion among Commissioners followed. Comnissioner Reeves volunteered `. to pick up the staff report frau Palo Alto on October 13. Chairman Stewart asked that staff get a copy of the traffic study done several years ago on Arastradero Iniad, and then proceeded to state his concerns on the improvement project, namely the PIANNING CON4ISSION NIINUPES - October 11, 1978 E Page five OLD BUS s: (continued) 1. Arastradero Iniad Improvement Project: (continued) corner of Page Mill Road and Deer Creek, appropriate landscaping, arra the preventing of Arastradero Road from becoming a four -lane expressway. Chairman Stewart requested the secretary to seryl out copies of the Palo Alto staff report to all Planning Commission members, to send notices of the Palo Alto meeting to all residents along Arastradero [mad from Hillview to Purissima, and to notify the Town Crier that the meeting would take place. 2. Joint Planning Commission -City Council Meeting: Chairman Stewart informed the Commissioners that he had not yet been able to get together with the Council to discuss an agenda for the joint meeting on October 25. AWOORIZIEW: These being no further new or old business, the meeting of the Planning Cammission was adjourned on the motion of Chairman Stewart, seconded by Commissioner Imeves.
