RE: REQUEST FOR A LOT LINE ADJUSTMENT; LANDS OF NICHOLSON AND
YANG; MAGDALENA ROAD (APN# 336-42-021) AND 11639 DAWSON

RECOMMENDATION: That the Planning Commission:
Forward a recommendation of approval of the lot line adjustment.to the City Council,
subject to the applicant's submittal of a legal description and plat map (prepared by a
registered civil engineer or licensed land.surveyor) for each of the parcels and recordation
of the certificates of compliance.
CODE REQUIREMENTS
Review authority for lot line adjustments is outlined in Section 66412(d) of the State's
Subdivision Map Act, which states that:
"A local agency or advisory agency shall limit its review and approval to
a determination of whether or not the parcels resulting from the lot line
adjustment will conform to the local general plan, any applicable coastal
plan, and zoning and building ordinances. An advisory agency or local
agency shall not impose conditions or exactions on its approval of a lot
line adjustment except to conform to the local general plan, any
applicable coastal plan, and zoning and building ordinances, to require
the prepayment of real property taxes prior to the approval of the lot line
adjustment, or to facilitate the relocation of existing utilities,
infrastructure, or easements."
Pursuant to Section 9-1.311 of the Los Altos Hills Municipal Code, the City Council shall
approve conditional) approve or deny each application on for issuance of a certificate of
compliance with the provisions of the Subdivision Map Act of the State of California.
The lot line adjustment will be effectuated when a certificate of compliance is recorded
for each parcel with the Santa Clara County Recorder's Office legitimizing the newly
created lot lines.

DISCUSSION
Parcel A is a 12.56 acres parcel located directly south of Highway 280. The property is
currently undeveloped with access provided by an ingress egress easement on the adjacent
property to the east (Lands of California Water Service Company). Parcel B (11639
Dawson Drive) is developed with a single-family residence, a pool, and an accessory
building. Access to this property is provided by a driveway off of Dawson.Drive.
The applicants are proposing to adjust the boundaries between the two parcels which will
result in an exchange of approximately 1,500 sq. ft. between the two properties. The
Town has recently received an application from the owner of Parcel A to subdivide the
12.56 acres parcel and the lot line adjustment will facilitate future access to the upper
portion of the lot from Dawson Drive. The subdivision application is currently under
review by the Planning Department and will come before the Planning Commission for
review in the near future.

CONCLUSION
The proposed lot line adjustment will result in lots which are consistent with the Town's
Zoning and Site Development Ordinance and the purpose and intent of the General Plan.
.The net acreage of both properties will not fall below 1.0 acre and no existing structures
on the properties will be rendered non-conforming as a result of the lot line adjustment.
Upon approval, the applicant must submit to the Town a copy of the signed and notarized

grant deeds, with legal description and plat exhibits prepared by a licensed surveyor or civil
engineer, and the Town will prepare certificates of compliance for recordation.
CEQA STATUS
The project is categorically exempt under Section 15305(a) "Minor Alterations in Land
Use Limitations" of the State CEQA Guidelines.

A. PLANNING DEPARTMENT:
1. Any changes or modification to the approved map shall first be reviewed
and approved by the Planning Commission and City Council, depending
upon the scope of the changes.
B. ENGINEERING DEPARTMENT:
2. This approval shall be of no force or effect until such time as the
applicants submit legal descriptions and plat exhibits (prepared by a
registered civil engineer or licensed land surveyor) that meet the approval
of the City Engineer and until grant deeds and certificates of compliance
are recorded. Upon approval from the City Council, the applicants shall
submit a legal description and plat exhibit for each parcel, prepared by a
licensed land surveyor or registered civil engineer, which meets the
approval of the City Engineer. Once the legal descriptions and plat
exhibits are approved by the City Engineer, the City Engineer shall
direct the City Attorney to prepare certificates of compliance for each
parcel for recordation with the County by the City Clerk.
