Home My WebLink About21-94 Ilk RESOLUTION NO. 21-94 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ACKNOWLEDGING BUT REJECTING IRREVOCABLE OFFER OF DEDICATION FOR ADDITIONAL STREET RIGHT OF WAY AT 27223 SHERLOCK ROAD,LANDS OF MASCARENHAS AND CHARKOWICZ WHEREAS, Desmond Mascarenhas and Dona Charkowicz have offered to dedicate Street Right of Way to the Town along Sherlock Road on Lands of Mascarenhas and Charkowicz and WHEREAS, the City Council of the Town has read and considered that Irrevocable Offer of Dedication of Street Right of Way; NOW, theCityCouncil of the Town of Los Altos Hills does THEREFORE, RESOLVE as follows: Section 1. The City Council of the Town of Los Altos Hills hereby acknowledges the Irrevocable Offer of Dedication. The Town chooses not to accept this offer at this time,but reserves the right to accept the Irrevocable Offer of Dedication by resolution of the City Council at any time in the future. Section 2. The City Clerk is hereby directed to record the Irrevocable Offer of Dedication executed by Desmond Mascarenhas and Dona Charkowicz, a copy of which is attached as Exhibit "A" . RECITALS A. Desmond Mascarenhas and Dona Charkowicz own property located at 27223 Sherlock Road in the Town of Los Altos Hills, California, being that certain parcel of land described in the Certificate of Compliance filed for record in the Office of the Recorder of the County of Santa Clara, State of California, on September 18, 1990, in Book L481 of Official Records, pages 1898 to 1901. B. Desmond Mascarenhas and Dona Charkowicz desire to dedicate a portion of this property to the Town for a public right of way and Town wishes to acknowledge but reject such a dedication at this time, but wishes to reserve the right to accept the Offer of Dedication in the future. NOW, THEREFORE, IT IS AGREED by the parties as follows: 1. Right of Way. Desmond Mascarenhas and Dona Charkowicz hereby dedicate to the Town a portion of the property adjacent to Sherlock Road, as described in Exhibit "A" and shown in Exhibit "B" attached hereto for street right of way purposes, including, but not limited to, construction and maintenance of vehicular, pedestrian, bicycle and equestrian facilities. 2. Acceptance. The Town has acknowledged but rejected this Irrevocable Offer of Dedication of Street Right of Way by Resolution No. 21-94 and has authorized the Mayor to execute this document on its behalf. 3. Binding Effect. The Provisions contained in this Dedication shall run with the land and shall be binding upon and inure to the benefit of the respective successors and assigns of the parties to this Dedication. i • IN L 80PAGEI5 4. Intent. The Town intends to vacate this dedication if and when Sherlock Road is realigned and reconstructed as a public street in a manner so that the property hereby dedicated is deemed not necessary by the Town Council.
