Dewar &Kelyn J. Dewar ("Dewar's") have offered to dedicate Right of Way to the Town on Lands of Dewar adjacent to Moody Road and WHEREAS, the City Council of the Town has read and considered that Dedication of Right of Way; NOW,THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The City Council of the Town of Los Altos Hills wishes to accept this Offer of Dedication at this time. Section 2. The Town of Los Altos Hills shall enter into and the Mayor is hereby authorized and directed to execute the Dedication of Street Right of Way, a copy of which is attached hereto. Dewar & Kelyn J. Dewar ("Dewar's") in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ("Town"), effective as of the date of execution by the Town. RECITALS A. Dewar's own property located at 27761 Moody Road in the Town of Los Altos Hills, California, being that certain parcel of land described in the Certificate of Compliance in Exhibit "A" and shown in Exhibit "B" filed for record in the Office of the Recorder of the County of Santa Clara, State of California, on April 22, 1994, in Book N408 of Official Records, pages 1731 to 1734. B. Dewar's desire to dedicate a portion of this property to the Town for Street Right of Way and Town wishes to accept such a dedication. NOW, THEREFORE, IT IS AGREED by the parties as follows: 1. Right of Way. Dewar's hereby dedicate to the Town a portion of the property as described in Exhibit "A" and shown in Exhibit "B" attached hereto for Street Right of Way purposes, including, but not limited to, construction and maintenance of vehicular, pedestrian, bicycle and equestrian facilities. 2. Acceptance. The Town has accepted this Dedication of Street Right of Way by Resolution No. 36-94 and has authorized the Mayor to execute this document on its behalf. 3. Binding Effect.
