HomeMy WebLinkAbout37-94 • 5 L 6 PA GS5 O 9 RESOLUTION NO. 37-94 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ACKNOWLEDGING BUT REJECTING IRREVOCABLE OFFER OF DEDICATION FOR STREET RIGHT OF WAY AT 27761 MOODY ROAD,LANDS OF DEWAR WHEREAS, Donald R. Dewar and Kelyn J. Dewar have offered to dedicate a Street Right of Way to the Town along Sherlock Road on Lands of Dewar and WHEREAS, the City Council of the Town has read and considered that Irrevocable Offer of Dedication of Street Right of Way along Sherlock Road; NOW,THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The City Council of the Town of Los Altos Hills hereby acknowledges the Irrevocable Offer of Dedication. The Town chooses not to accept this offer at this time,but reserves the right to accept the Irrevocable Offer of Dedication by resolution of the City Council at any time in the future. Section 2. The City Clerk is hereby directed to record the Irrevocable Offer of Dedication executed by Donald R. Dewar and Kelyn J. Dewar, a copy of which is attached as Exhibit "A". Dewar & Kelyn J. Dewar ("Dewar's") in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ("Town"), effective as of the date of execution by the Town. RECITALS A. Dewar's own property located at 27761 Moody Road in the Town of Los Altos Hills, California, being that certain parcel of land described in the Certificate of Compliance in Exhibit "A" and shown in Exhibit "B" filed for record in the Office of the Recorder of the County of Santa Clara, State of California, on April 22, 1994, in Book N408 of Official Records, pages 1731 to 1734. B. Dewar's desire to dedicate a portion of this property to the Town for a public right of way and Town wishes to acknowledge but reject such a dedication at this time, but wishes to reserve the right to accept the Offer of Dedication in the future. NOW, THEREFORE, IT IS AGREED by the parties as follows: 1. Right of Way. Dewar's hereby dedicate to the Town a portion of the property as described in Exhibit "A" and shown in Exhibit "B" attached hereto for street right of way purposes, including, but not limited to, construction and maintenance of vehicular, pedestrian, bicycle and equestrian facilities. 2. Acceptance. The Town has acknowledged but rejected this Irrevocable Offer of Dedication of Street Right of Way by Resolution No. 37-94 and has authorized the Mayor to execute this document on its behalf. 3. Binding Effect.
